Once upon a time, I was training for the 2016 Olympics as a track cyclist. I took this very…read moreseriously. So much so that I got a job at a bike shop as a mechanic so I could learn to wrench on my own bike. I was nationally ranked (top 10 in the nation), trained with the Olympic team at the OTC (Olympic training center) with Jamie Staff in Chula Vista and was training with a para-olympian on tandem as her pilot. On my way to work, my car was hit by a semi-truck at the intersection of Northside Drive and Donald Lee Hollowell Parkway. The semi truck was entirely at fault. We were both traveling northbound. I was stopped in the turning lane (that turns left on Donald Lee Hollowell) and was waiting to merge into the lane on my right with my turn signal so I could continue forward. The semi-truck was in the farthest lane to the right. As I merged into the clear lane, the semi-truck driver flys past me and begins to merge in the lane in front of me. While doing so, the rear end (driver's side) of his truck hit the passenger side of my car because he didn't create enough space before merging. I even had two eye witnesses. I also had a passenger who wanted to remain anonymous, but was still trying to collect. I don't even remember his name, I was just giving him a ride somewhere being nice. APD took forever to show up and did a subpar job at determining fault. Anyone with some sense about them could have seen from where the damage was located on each vehicle who was at fault. Ultimately, the cop who showed up said he made his decision based on the rubble from the accident on the ground (that had been run over by cars the entire time we waited) and wrote us both a ticket. He didn't want to do his job. Mind you again, I HAD 2 EYE WITNESSES WHO STAYED AND GAVE THEIR ACCOUNT. They both said that the truck driver was at fault! The truck driver claimed I drove over a median, which was a lie. There were several cars in front of me at the light. The accident caused a pinch nerve in my thoracic spine that I still deal with to this day. It just felt like a lot of muscle tension back then and got worse over the years. I sought out an attorney and found Barry Goodman. I also found a chiropractor who was kind enough to pay for my massage therapy out of his own pocket until I received a settlement. While waiting on the settlement offer I was forced to ride Marta and my bike to the velodrome to continue my training schedule. While riding my bike down Church Street, I went to make a right turn on Neely Avenue. I checked behind me before turning and there were no cars. The minute I turned a car hit me! I wasn't even aware of what happened until my body stopped rolling and I was able to stand again. The inside of my helmet was cracked. There was a cop sitting in his car right in front of the police precinct by the street where it happened. It's almost like he was perfectly positioned to catch it. I felt fine and went straight to the velodrome to meet up with my training partner after the cop got everyone's information. I was definitely injured in this accident and wasn't able to tell until the next day when I noticed I could not put my full weight on my right foot for some time. I told Barry about this accident. The semi-truck driver's insurance low-balled me and I wanted to go to trial. Only offering me enough to cover my current medical expenses and the lawyer fees, and not enough to replace my car. I still needed treatment after the fact and could not afford it at the time being a college student and working full time while supporting myself. Barry refused to go to trial stating that their defence would be that my injury was created by the car accident. I asked the him why would that be a problem when you have X-rays from a medical professional that prove the injury existed prior to. I accepted the offer, only because I wanted to pay the doctor who was kind enough to come out of his pocket for my massage therapy. I told this to the Barry while signing the papers and giving him the side eye. He says to me, "sorry I have a daughter to put through college." I couldn't discern how his statement had any relation to my case. Back then, I had no understanding of how any legal procedures worked or what they cost. I didn't know Barry would of had to pay for the trial out of his own pocket. So I felt cheated due me being unknowledgeable and rudely threw away the business cards he gave me. I feel so silly now. Barry genuinely tried to help me now that I am able to see with a more informed perspective. He was efficient and very professional. Thank you Barry for your time and assistance that I had no comprehension of and I apologize.
