Disappointed by this attorney's role in my family's situation. Rather than acting in a way that…read moreappears to protect the best interests of two elderly parents who have been married for decades, the legal strategy seems to support separating them during an extremely vulnerable time. My father is a stroke survivor with significant cognitive limitations. In my opinion, the attorney appears to rely heavily on my father's statements without adequately considering how his stroke and cognitive impairments could affect his perceptions, memory, and ability to understand the family dynamics. To my knowledge, the attorney has never met or spoken with my mother before accepting my father's account of the situation. My mother also held my father's power of attorney but was prevented from exercising that authority after my sibling took actions that, in my experience, effectively blocked her from doing so. She became understandably distressed during this period. In my opinion, her emotional reactions reflected the trauma of being separated from her husband of many decades and the stress of being unable to care for him, rather than being viewed in the full context of what she was experiencing. When I was finally able to see my father after approximately three months without contact, he did not initially recognize me, his own daughter. During that visit, I observed that there were no visible photographs or reminders of his wife or daughter in his living environment. Given his cognitive impairment following a stroke, I found this deeply concerning because familiar people and objects can be important for maintaining memory and emotional connection. From my perspective, this situation has resulted in an elderly husband being isolated from his wife of many decades. I am also concerned that possible undue influence and financial dependence is not under scrutiny, as my sibling has no employment and relies on my father for financial support. Attorneys have a duty to advocate for their clients. However, when representing someone with significant cognitive impairment, I believe it is important to carefully evaluate their capacity, seek corroborating information when appropriate, and understand the perspectives of others directly involved.
