Instead, we were informed that the sellers were attempting to retain our $10,000 earnest money, which immediately turned an already difficult situation into a serious dispute. What was most concerning to us was the lack of clarity and transparency surrounding the sellers' position. When $10,000 of a buyer's money is at stake, communication should be prompt, professional, and straightforward. We have requested an explanation of the contractual basis for the sellers' position and have preserved the relevant emails, documents, and communications regarding this transaction. The matter remains unresolved and has become serious enough that we have escalated our concerns to the Designated Managing Broker of Realty Executives Success, are seeking assistance from a real estate litigation attorney, and intend to submit a formal complaint to the Illinois Department of Financial and Professional Regulation, Division of Real Estate regarding the handling of this transaction. Homebuyers should be able to expect professionalism, transparency, and fair dealing throughout a real estate transaction, particularly when a substantial earnest money deposit is involved. Based solely on our own experience with this transaction and the way this dispute has been handled, we would not recommend Bobbie Soris.
