Attorneys have an obligation under the California Rules of Professional Conduct to avoid conduct that harms minors or undermines the integrity of the legal process. Under California law, only the parent with legal custody may authorize a minor's participation in such interviews (Fam. Code § 3025.5). The opposing parent had no legal authority to give that consent. Mr. Weinberger's repeated involvement with the child, in my opinion, violated both the law and ethical duties owed by attorneys. We will be reporting Mr. Weinberger to the California State Bar for investigation under, among others, Rule 4.2 (communication with a represented party without consent) and Rule 8.4 (misconduct involving dishonesty or prejudicial conduct).
