Unfortunately, I was left wondering if my ex had bribed Mark. Mark pushed me for hours, over the course of 2 mediations , to give a specific dollar amount ( not a %) of the equity to my ex, in exchange for keeping the house. (The loan was in my name already) I argued that I used XXX,XXX of my inheritance (sep prop) as part of the down payment, and that the entirety of the equity was not a community asset. Since my ex had over 20 hidden accounts and refused to turn in his discovery, I asked mark to issue subpoenas. He didn't. Instead, he offered a deal to persuade me into signing the agreement: if I agreed to give my inheritance to my ex, he would represent me in a partition to divide undisclosed assets case next. With a free consultation he already gave me a great overview of what I could expect if/when he took on my case. He has reasonable fees, he will work with you without having to constantly make trips to his office unless absolutely necessary. My particular case took about 3 months to get handled, but the entire time he managed to help me stay informed, calm, and took care of everything with calm professionalism. Unfortunately, Mark didn't work out. He gave me the impression he was taking the easy route and just wanted to get the case over with and not looking out for my best interest. Whenever I would ask a question he would always refer " waiting on the other attorney to respond" which meant he didn't have the answer to it or didn't want to deal with it. He would immediately change the conversation if he didn't know the answer to a question. He is easily intimidated especially by other attorneys and he never takes charge when needed ( Been to court with him and have seen it). Although he is a new attorney, he needs to work on being more aggressive and not giving in to the other attorneys demands. He needs to work on being organized and communicating effectively with his clients. I've caught him in a couple of lies which was very disturbing. As an attorneys they are obligated to represent your clients in the way it would benefit them, not the other party. Always pay close attention to your attorneys actions and sayings. I have been in the market to get a will drawn up for some time, especially after the death of my uncle last year resulted in a messy estate with no will, and as a result my family was left to deal with his left-over bills and burial costs with no recourse besides their own funds. I went to Mark because I was embroiled in nasty guardianship litigation with 6 other people and all of us were represented by a single lawyer who had a bad habit of not returning my phone calls. One of my friends told me that they were friends with a young attorney who was interested in probate stuff and that he might be able to help.
