My experience with Kathleen as a mediator was almost comical. I went into mediation with a…read morespreadsheet showing our complete financial picture and a desire to split assets 50/50 and come up with a spousal support number that was in line with our situation. But Kathleen said we weren't going to do financial disclosure since this was "transformational mediation." Instead of looking at the actual numbers, Kathleen asked my wife how much she thought I could earn, and how much she thought she could earn. Then Kathleen applied the statutory guidelines to these made-up numbers (but fully extrapolated beyond the statutory threshold) to calculate the spousal support amount. Then she essentially bullied me into agreeing to that amount. One exact quote was "Eric, you can do it. You've made it through difficult times before." This process cost us around $5,000, and fortunately I called it off without agreeing to anything. I then spent around $10,000 in lawyer's fees, and my ex-wife may have spent a similar amount, trying to get back to a range of maintenance numbers that actually fit our financial and professional situations. In the end, my ex-wife and I settled out of court on a total maintenance amount that, while still above the extrapolated statutory guidelines based on actual incomes, was 35% less than the amount of maintenance Kathleen had pressured me to agree to.
