BUYER OR LABORER BEWARE: Omega Painting & Construction performed services for a customer, and issued a laborer a hot check. They paid a laborer/Alfredo Simental with a check dated 3-3-17, in the amount of 1500.00. The check they issued to the laborer was returned to a check cashing establishment by their bank for insufficient funds. The owner/Zimbalist Odhams (D.O.B. 2-28-68) of Omega Painting & Construction was kindly contacted many times by numerous check fraud agents over a period of 16 months; via text, voice message and direct contact, in regard to his hot check. During that time the owner made many promises to resolve his bad check, but he failed to follow-through on his word time after time. The owner complained of money problems, so his elderly female victim graciously granted him an easy payment schedule to resolve his bad check. He missed his first easy payment, and over 15 more first easy payments were set up over a year's time, and he broke his word on each one of those payment promises too. The owners' unusually irresponsible and unreliable behavior caused his victim to believe he must be in bondage to a serious addiction and/or suffering from a serious mental illness and/or emotional disturbance, so he was offered a very generous one-time settlement in order to close his file by a certain date. The owner/Zimbalist missed his settlement payment date, and 5 subsequent settlement payment dates. As of the date of this public service announcement, the owner still hasn't fulfilled his moral and legal responsibility to resolve his bad check, nor has he paid one dollar towards resolving his bad check. The owner was told numerous times his victim is a small business owner of a check cashing establishment, who is a kind, pleasant elderly woman that works 7 days a week, 14 hours a day, often standing on her feet. Sadly, knowing his victim is a hard working elderly woman wasn't enough to jar his conscience into righteous action on his bum check. That says a lot about how he treats the women in his life. I digress. In addition, during all the contacts the check fraud agents had with the owner/Zimbalist, not once did he apologize for his bad check, nor did he apologize for repeatedly breaking his promise on his scheduled payment dates. Very telling! This means he is either completely clueless about the pain or suffering he caused his victim with his bum check, and the many broken promises on scheduled payments or he is operating his business and/or personal life as a stone cold sociopath. You'll have to be the judge on which you believe is true in light of the evidence laid out in this objective review. The laborer who cashed the owners' check was also contacted by his victim to recover her funds, and he indicated the owner/Zimbalist "screwed" him over and owes him money too. Texas law requires a bad check to be resolved within 10 days of when it's returned by the bank, otherwise it's presumed the bad check writer had knowledge of insufficient funds and criminal and/or civil complaints may be filed with the Courts against both the check signer and the receiver of the funds. Note: Court action would have been taken months ago, but the owner/Zimbalist has an address on his check that is an open driveway space, which fits perfectly between two small business storefronts, one with a lower, and one with a higher numbered address than his ghost address. This means when he set up his bank account, he knowingly provided a ghost address. This strongly suggests he premeditated writing more than one hot check to victims. WARNING: If you are considering risking your hard earned money by doing business with this company and/or Zimbalist Odhams, you need to think again! You need to seriously consider this hot check case, and its ramification for you as a customer and/or laborer. When this company does work for your home or business, if they don't pay their subcontractors or they issue them bad checks, you take a risk of having a lien placed on your property by the subcontractors. The best predictor of future behavior is past behavior. Based on the grossly bad conduct of the owner/ Zimbalist in response to his hot check, there is an above average likelihood you could get the same callous treatment if you hire him/his company, and have an issue with their work and/or product or if they issue their subcontractors bad checks or don't pay them. The decision is yours who you decide to engage in a contract with, so do your research and choose wisely. You'll sleep better at night! P.S. Be somewhat skeptical of overly positive reviews, because they are often coerced from customers in exchange for discounts or they are written by the business owner and/or family and friends.
