In my case, they falsely claimed I "never paid a cent" to Kimball Apartments yet they advertise to be part of the military Rental Partnership Program for service members Active and SelReseve. That is simply untrue. I have receipts proving consistent payments and multiple attempts to resolve the matter in good faith. During the FY25 budget freeze, my military pay was delayed due to federal audits and funding interruptions. I notified them of the situation and obtained new employment by October, yet they refused to accept any payment arrangements or full payment for the balance. They even reversed utilities I had already paid. Their strategy appears to be forcing quick defaults and misleading the courts rather than negotiating lawfully. I was issued a writ of possession prematurely, based on statements to the judge that were not factual. I have reported their conduct to the U.S. Navy for review. Their behavior has also overwhelmed many real estate attorneys across San Diego, creating backlogs and delays in legal representation for tenants who are simply trying to defend themselves. This pattern is causing a ripple effect across the housing legal system. If you are dealing with this firm, document every interaction, keep copies of all emails and payments, and contact legal aid immediately. Also consider reporting their practices to the Better Business Bureau and the San Diego Housing Commission -- this may warrant a class action review. Gave them a letter from my CO saying as soon as our pay is released or available we as sailors can pay the backed log rent.
