Readers should review the actual court records and applicable Texas law before reaching their own conclusions. My husband and I recently appeared in court regarding our lawsuit against First Financial Bank concerning a wrongful foreclosure. What concerns us most is that, as of our most recent hearing, First Financial Bank and/or its attorneys have still been unable to provide sufficient evidence establishing that the required foreclosure notices were properly sent and served on us. Specifically, we have requested evidence concerning the alleged mailing of certified foreclosure documents by First Financial Bank's attorney, Joseph D Austin of (Hart & Kelly Law Firm), including documentation such as the mailing records, certified-mail information, tracking information, return receipt, affidavit of service, or other competent evidence establishing when and how the required notice was provided. This issue is extremely important because Texas foreclosure law establishes specific notice and procedural requirements. Texas Property Code § 51.002 addresses notice of sale and service requirements, while Texas Rules of Civil Procedure 735 and 736 govern certain foreclosures for which a court order is required. Whether a particular foreclosure requires a Rule 736 proceeding depends upon the type of lien and the circumstances involved. During one of our earlier hearings, Judge Morris also questioned First Financial Bank's attorney about why the foreclosure had not been filed through the court. We believe that question raises an important issue that deserves a clear answer based upon the specific type of loan, lien, and foreclosure procedure involved in our case. Questions for the Court As a student of the law, I respectfully pose the following questions: How can a person reasonably know what property they legally own, what property they may have lost an interest in, or what legal action has been taken against their property if they were never properly notified that a filing had been made? What constitutes legally sufficient notice to a property owner when a court filing may affect that person's ownership rights or interests in the property? If a person was not properly served or otherwise given legally sufficient notice of the filing, how are they expected to have a meaningful opportunity to appear, respond, contest the claim, or protect their property rights? How does the lack of proper notice affect the fairness and validity of proceedings that may result in a person's property rights being altered, restricted, or extinguished? From a due-process perspective, can a person be expected to comply with or be bound by a proceeding affecting their property when they were never reasonably informed that the proceeding existed? What safeguards are in place to ensure that property owners receive actual or legally sufficient notice before a court takes action that could materially affect their ownership or property interests? As homeowners, we should have a meaningful opportunity to know what legal action is being taken against our property and to exercise whatever rights Texas law provides. Our concerns are not limited to this one proceeding. We are also aware of other lawsuits involving First Financial Bank regarding their Criminal Conspiracy, including matters identified as: Former Judge Sadler v. First Financial Bank Bienes Raices Ventures, LT v. First Financial Bank Taylor et al. v. First Financial Bank DigitalDoors v. First Financial Bank Stone Strong, LLC v. First Financial Bank Christopher Jones v.
