I hired Eric Ridley as my attorney because his website made the bankruptcy process seem simple and straightforward. Unfortunately, my personal experience was very different. A large portion of my debt came from my son's high school football injury and his seizure disorder, so I was already overwhelmed and going through one of the most stressful periods of my life. Roughly three years ago, my sweetie hired him to handle what turned out to be a hotly contested bankruptcy case involving a staggering amount of student loan debt. As most folks know, student loans are virtually impossible to discharge in bankruptcy, even when there are mitigating circumstances, such as extended poverty, unemployment, or health problems on the part of the debtor. Without going into personal specifics, this case was beyond difficult, even with a long list of good reasons why the debt should be discharged as an "undue hardship." Despite clear evidence that the situation was beyond hopeless, the U.S. Dept. of Education held the argument that somehow, somewhere, money was going to rain down from the sky to cover the 20-year-old debt. They insisted that the income-contingent repayment plan (which allowed the balance to exponentially spiral upward) was a sufficient remedy. Eric has spent the last three years walking us through the process, holding our hands during our darkest moments, taking our calls at odd hours, and working patiently, diligently, and steadfastly on my beloved's behalf. He has battled hard for a very long time. After three years of what seemed like an endless fight, my love has been freed of this tremendous albatross that has interfered with every aspect of his life. For the first time since he graduated college 22 years ago, he can walk upright without the crushing burden of gargantuan debt. When you use the Yiddish word "mensch" to describe someone, it means that they are a person of integrity and honor. According to Leo Rosen, a mensch is "someone to admire and emulate, someone of noble character. The key to being 'a real mensch' is nothing less than character, rectitude, dignity, a sense of what is right, responsible, decorous." Eric Ridley is a mensch. When I hired Eric, I was recently separated from my 13-year marriage, and unfortunately, left with most of the joint debt, in my name alone. After not being able to pay our credit card bills for a few months, and pleading with our creditor, I ended up getting sued in Sept 2016 by that creditor for the $20,000 we owed them. I found Eric online and called him. He answered the phone an I picked his brain for about 20 mins. Together, we explored several options, but came to the conclusion that a BK was my best option. Fast forward to my court date in Jan 2017, when I was assured by Eric that all should go smoothly and I would be granted a normal discharge. Well, it wasn't and this was the start of the downward spiral my case took. The trustee noticed assets in my family home, and even though it was supposed to be protected, they decided to go after the house to pay off the creditors. Now, we are in March and the trustee has hired a lawyer at $550/hr, which I am expected to pay for, to go after the house. I didn't know what to do. Eric stayed on as my counsel, and helped me through the whole process... for FREE! Simply because of how sideways this whole case went, he couldn't fathom charging me any more for his time. Unexpected and immensely appreciated. So we battle back and forth with the lawyer, and finally have the money to offer to pay the creditors off in full, because we just want this over with. Eric advises against it, and says to just wait out the creditor claim period, which is 90 days! So, we waited and low and behold, at the end of the filing period, only 1 of the 3 creditors filed a claim, saving us over $26,000 out of our $29,000 debt (which is a good thing, because the lawyer and trustee on the other end cost me over $10,000 alone)! Most cases don't end up a nightmare like mine... Eric did what he was hired to do (and way more), was easy to get a hold of via text/email and usually called back within a reasonable amount of time (unless he was in court that day). We engaged Eric to assist with a business fraud issue. The person whom we had issue with sued us first. Eric counter-sued in superior court assuming the other party would back down. They did not so Eric spent time attempting to negotiate a settlement. That went nowhere fast and cost us Eric's time. In our circumstances, we did not have extra money. We discussed whether it might be simpler to declare bankruptcy. Eric's expertise appears to be in bankruptcy but he did not take the time to understand the debt involved. Consequently his recommendations did not show a good strategic approach. We wasted money and are still not finished.
