What is the difference between Chapter 7 bankruptcy, and Chapter 13 bankruptcy? CHAPTER 7 is a bankruptcy generally used as a means for individuals to completely wipe out most debts in a legal proceeding conducted under the jurisdiction of The U.S. Bankruptcy Court. As a general rule, most Chapter 7 bankruptcy cases are no asset cases wherein creditors do not receive any money as payment for those debts listed in the bankruptcy schedules and the debtor is relieved from any obligation of paying back those creditors. Under the new bankruptcy law, effective October 17, 2005, there are number of additional requirements to satisfy in order to be eligible to obtain a discharge of your debts in a Chapter 7 Bankruptcy, including passing a means test or income test. For individuals with income too high to pass the means test, you will be required to pay back at least some of your debt in a Chapter 13 bankruptcy. CHAPTER 13 is a bankruptcy designed for individual debtors who have some regular flow of income seeking an adjustment of debt. Chapter 13 bankruptcy is used primarily for people with mortgage and maintenance debt, or other secured collateral who wish to keep their assets, yet need time to stretch out these arrears or back payments in a Plan to deal with their creditors...

He works countless hours for his clients and goes above and beyond for us. I highly recommend Phillip and thank him tremendously for all his support.

But the thought of it was too stressful. So I informed Phil that I needed time to think about it. The first meeting we had, Spring 2019, was surprising to me. He came off as someone who was patient, calm. Of course throughout our meeting, I never felt judged or rushed into committing anything. I truly appreciated that. He even agreed to meet with my husband. Everything about meeting him, however many times and throughout our email correspondences, he was always professional and straight forward. I did pay the initial deposit so that he can do his analysis and also signed a contract with him regarding the terms, payment, etc. By the Spring of 2020, I was ready to proceed. It took almost a whole year to proceed because in between I was moving to a new place, I became pregnant, and tending to my emotional well-being on top of life's stresses proved to be challenging for me. Plus I had to save up money to pay Phil. So when I reached out to him after our last meeting in 2019, he was gracious enough to honor the amount we agreed the year prior. Obviously his fees had gone up, but he was just amazing. I was so very thankful. Him and his employee (his son extraordinaire) were on point with keeping me informed with the status of my petition. I was always able to get all of my inquiries addressed; always. With their busy schedules, and let's not forget COVID, I was grateful that they were there for my family and I throughout the process. Should you consider working with Phil's team, understand that the process takes weeks to months (you need to be patient), trust them (they will not dupe you), they won't rush you into committing to anything, and you will never ever feel like you are being judged.
