They instead tried to put a lien on our property. Now they are sending us to collections, for a job that is still not complete - with a contract that was not signed by the homeowner.
ONE: The work is still not complete as of October 31, 2024. (in fact it is not complete as of Nov 18, 2024)
TWO: The original installation team walked off the job due to a dispute with either the installation Supervisor (Raul) or ProGreen.
THREE: After the original installation team left, we were advised to "guard" our property and we were asked by the installation Supervisor (Raul) to watch his tools for fear the first team may come back and retaliate by vandalizing our property and/or his tools. This was very concerning and stressful. We had to be sure someone was home and watching things 24/7. We did not sign up for that.
FOUR: The second installation team delivered the rocks to the wrong location, which caused delay, they were also delayed because one of the workers borrowed the company truck and caused it to be impounded, another company truck would not start, and it went on like that.
FIVE: Against our wishes, the second installation team that was brought in, worked way past dark, with no light, which may explain the seam issues. It was also very noisy for our neighbors.
SIX: After repeated calls to your corporate office to address these issues as well as get a timeline for completion, i.e. to fix major seams, there was no return call until August 27, 2024.
SEVEN: A supervisor came to the residence on August 27, 2024, and conceded that there was still work that needed to be complete. The seams needed a lot of attention and there was fill that still needed to be done. These were his words.
EIGHT: In this same meeting, on August 27, 2024, this supervisor was threatening and intimidating, touting his MMA background and telling us how he has hurt people. While this was unprofessional, concerning, invasive and presumably intended to intimidate us and keep us quiet, we still wanted to know what kind of compensation we should expect for all the issues, drama, problems, and delays we experienced, not to mention we wanted a final completion date. When we asked this, the supervisor started actually, screaming at us- that we better pay, or he will put a lien on our home. He called us losers and threatened us.
On this same afternoon, we went to Denver Police Department, District 2 and filed a police report that is public record. We have not decided whether to press charges or who will be included in the complaint.
NINE: We have pictures, and video of the Installation Supervisor passed out drunk in his truck in our driveway with his truck running and beer in his lap. We also have doorbell camera footage of your supervisor bringing the beer to the workers mid-day. This has all been shared with the Supervisor at ProGreen.
TEN: The work was promised to be completed in 1-2 days, and while it is still not complete, it wasn't even to the point where it is now for 5 days which caused us to postpone our outdoor event.
ELEVEN: You did not get the signature of the owner of the property on the contract for service.
TWELVE: Interest should not be calculated, just as payment is not due, until the job is complete, which it is not at this time.
FURTHER ACTION REQUESTED: Please contact the property owner to resolve this dispute. We would like to resolve this in a fair manner.
