I told Mr. Kazachki from the very beginning that I did not want to move from the apartment and that I did not want to settle, I told him I was offered settlement many times before without a lawyer and I did not except those offers because I am fighting for my rights. when a person is fighting for their rights it's because they are trying to protect themselves from the opposing party that is wrong. I could've settled on my own and excepted those offers before but I chose not to, I needed an Attorney to represent me during Jury Trial not for settlement, I told Mr. Kazachki this from the very beginning of contact before I even signed the agreement, on top of it all the 3-Day Notice I received from the plaintiff was defective, everyone knows this, the case could have been dismissed the day I met with Mr.,Kazachki at the courthouse the day of the hearing, unfortunately after being publicly yelled at by Mr. Kazachki at the Courthouse i was intimated by him, because I was already going through a tough time, he made me feel as if I had no choice but to try to settle, he intentionally decided he was going to steer me into settling even though I specifically said I do not want to settle and I do not want to move. Unfortunately, I was forced to represent myself in court because he left after I did not agree with the settlement he wanted me to agree to for his benefit. Mr. Kazachki is rude and very unprofessional. He cursed at me publicly in the courthouse hallway in front of everyone, I don't think he realized we were in public and that other people could hear him, he said he has the right to yell at whoever the "eff" he wants to and treat people however the "eff" he wants to??? This was very humiliating, I could not believe how awful he was treating me, as if he was a royal majesty because he's an "Attorney" and I was just a peasant client. He only cared about settling my case with the plaintiff so that Mr. Kazachki could get paid. I am not certain who exactly does Mr. Deian Kazachki think he is and Why he feels he can be so verbally abusive to vulnerable clients already going through a tough time. He made my situation worse and then left me at the courthouse alone without representation when it was time to speak to the Judge, Mr. Kazachki could have easily gotten my case dismissed due to a defective 3-day Notice but he didn't because all he cared about was settling my case so that he could take a large chunk of the money!! There were numerous false statements in the conclusion of representation. Additionally, The bank account information to transfer the funds was not provided to me until the morning of the court hearing, how exactly was it that I was suppose transfer the funds before the bank account number was provided to me??? I NEVER VISUALLY SAW ANY OF THE "WORK" They CLAIM TO HAVE PREPARED on my case because they found every excuse Not to send me a copy of my file when I requested it then they had the nerve to send me a demand letter for payment via courier service when they could've easily sent me a copy of my file via courier service as well but they didn't. They gave me some lame excuse that my file was too big to send via email. They are going to respond to this post stating that they were so considerate of my situation, and they met at the courthouse and drove all the way from far far away without the retainer fee type of BS!! They only cared about getting paid as fast as possible and never cared about actually going through with the trial or getting my case dismissed!! They knew their intentions where to try to get me to settle with or without the retainer fee because they were going to take most of the money in the settlement anyway if I decided to settle. Then they had the nerve to send me a $4,000 bill for a file they NEVER EVEN PROVIDED ME A COPY OF EVEN AFTER I REQUESTED A COPY, I NEVER EVEN SAW my "File" and Now he has the nerve to try and sue me after he DID NOT REPRESENT ME IN COURT FOR JURY TRIAL, and for trying to settle the case I could've settled without him which he already knew, the proof of the offers I was being sent by the plaintiff were provided to him, he knew what his intentions were and he knew he never intended to actually represent me during jury trial which is what I hired him for. The Plaintiff's Attorney was even in shock when I told them the bill Arbat Law sent me was $4,000!! What should you expect from your lawyer? Your lawyer should: 1. Act ethically and abide by the Rules of Professional Conduct and the California Business & Professions Code. 2. Represent you zealously and use all lawful and ethical means to present or defend your case. 3. Allow you to make the final decisions regarding how your case will be handled. 4. I have chronic pain and I didn't want to be alone so I got a roommate to keep me company. When she went nuts, I hired Dan to help me get her out. I ended up doing cash for keys before Dan was ready to take her to court, but without Dans advice and counsel for that month, I don't know if I would've been able to get her out. We had issues with a landlord/management company who saw a possible way to bump up rent when I moved into my apartment (joining somebody elses lease). We did everything by the book and they tried every tactic to undermine. Including all kinds of fraudulent filings, eviction notices etc. It became a test of endurance. At many points it looked like they had the advantage despite foul play. Dan managed to block most of their aggressive threats (forced eviction being one) It was a scary time and Dan was always patient and calm, when at times we found it hard to be.
