Regarding the rental term, our concern is NOT that the lease contained a written six-year guarantee. Before we signed, Jody verbally represented that the landlord planned to remain overseas for approximately six years while their children attended local universities. We relied on that information in deciding to rent the property and understood it to be a stable, long-term rental. Regarding the $300 late fee, our concern was not simply whether the payment processor was down. The payment issue occurred after the management company changed its payment system, and we had a three-year history of timely rent payments. Once we became aware of the problem, we promptly hand-delivered payment to the office. We paid the $300 fee, but continue to believe tenants should not bear the cost of a payment problem arising during the management company's system transition. Regarding cleaning, we understand that tenants may choose their own cleaner. Our concern was the manner in which the company's preferred cleaner was recommended, which left us with the impression that choosing another cleaner could affect our deposit. That communication created unnecessary concern during move-out. Regarding the security deposit, our concern is not the amount of the refund or the deductions, which we understood and approved. We specifically asked for information showing the receipt and handling of the original deposit during our three-year tenancy. Management confirmed that the deposit was held in a Broker Trust account, but did not provide the transaction-specific records or ledger we requested. That is the issue we are seeking clarification about. We appreciate the company's response, but our experience and the company's characterization of events are different.

It was due to a leak upstairs that the seller claimed he fixed. We had an inspection and there were a lot of problems with the house that seemed minor, but the seller said he fixed them. He didn't fix most of them to our satisfaction. A month after we moved in we discovered we did not have A/C as indicated on the appraisal and the inspection. We found out because it was a very hot day and the house was hot upstairs. I called our warranty company Old Republic which has proven to be USELESS! They sent out a Technician who first told us our system was outdated and there was no way to repair it. 4-5 HVAC installers later confirmed the A/Compressor in our backyard was not connected to the nice new Nest thermostat. In fact, we did not have A/C because a wire was loose or cut that could not be connected without opening up the wall. We were told we could buy a wireless connection that may work for $1500.00. We continued to have installers come out and give us 3rd, 4th and 5th opinions and estimates. A few months later we had a Mini Split A/C/Heater installed that cost $12000. I was in communication with the Agent Daniel who was always going to get back to me after speaking to their lawyers. He always deferred to the useless warranty company. There were a lot of other issues e.g. floors lifting, a hole in a bathroom wall that was covered up with a mask. We discovered a lot once we moved in. The straw that finally broke the camel's back was the hot tub issue. I loved the hot tub that came with the purchase. I informed our agent that I needed to be sure it worked because it was one of the reasons I wanted the house. The seller put in the contract that the hot tub had some issues but a technician was coming to repair it. So fast forward, we got A/C installed, but when the A/C installer came he informed us that the hot tub was not hooked up to code. He said it could cause a house fire. He said the wires used to hook up the hot tub were the wires to hook up the A/C and they are the wrong size. Therefore, he disconnected the hot tub. We now have to hire an electrician to come hook it up correctly and according to code. The cost to reconnect the hot tub is $3000-4000. This is my first purchase. We trusted Daniel, our agent. Instead of doing the walk through for the 2nd time without furniture in the house, we let Daniel do a video. The last walk through was hurried because Daniel said he had somewhere to be. I imagined that when I purchased a home it would be a celebration and that we'd be overjoyed. It has been quite the opposite. If I had to do it over again I would not have purchased with this agent or realtor. I have family and friends that are agents and I should have gone with someone that we knew, and who had our best interest at heart. We have spent $9000 on replacing the floors, $3000 for repairing the leak. The shower was replaced and some of the plumbing that could prevent a leak in the future. We also had to have the ceiling closed and repainted that was damaged by the leak. The backyard was cleaned up and landscaped because it looked like a jungle costing $1700.00. We had to have the fireplace cleaned and repaired for $400.00 (the seller said he had this done) in the pics there was a glowing bright big flame. When we took possession of the house we couldn't get a flame. There was a rusted window in our living room that we had to replace for $300 just for the window. It will be additional $ to install. So, almost $30k in 5 months after closing is overwhelming. I have spoken to everyone involved and they all passed me along to the next person. Daniel and Greg were the agents, Lyle West was the Listing Agent. I even spoke to the man I was told was in charge named Phil, he was not empathetic and just cut us off in mid conversation and said sue the seller. Potential Buyers BEWARE. Please thoroughly do your walk thru and if something was repaired get the info. on who repaired it and make sure to get it in writing. Go with an agent you know or somebody you know knows. The seller is denying that he knew about how the hot tub was hooked up. He said it was A/C while he was in the house, so I guess someone disconnected it by the time we moved in. Also, let me mention there was also an infestation of house centipedes and bugs that behaved and looked like roaches to me. We had to get an exterminator and have them come every month. I am very very scared of bugs so this made the house very uncomfortable for me. We also later had a pop-up encampment develop directly across the street from us. The presence of the encampment has come with a lot of trash and junk also right across the street from us. Please Do Your Homework! Do not regret the biggest purchase of your life! The stress has been overwhelming between the loan officer and the agent.

I was a first-time home buyer, engaging in what was my largest financial decision and investment of my life, and Fidelity National Title Danville simply blew it. I was counting on them to do their job and provide an accurate settlement statement. This is the main job of a title and escrow company, and they couldn't even get that right. This forced me to come out of pocket for far over a thousand dollars to cover the shortfall of funds in my loan, and they made the mistake - twice. In addition to this, their communication was extremely poor, screwing up a basic appointment with a notary which forced my wife and I to sign our loan docs very late at night. They were completely asleep at the wheel, not even knowing or confirming when I'd sent them a massive down payment as part of the transaction. When you purchase a home, you depend on the title company to accurately handle the transaction in a detailed, focused, and pleasant manner. Fidelity National Title Danville failed miserably at this. When I voiced my concerns they either sent me bizarre emails talking in circles, or ignored me. They flatly refused to do anything to compensate me for the incompetence they showed and inconvenience this caused me. Fidelity National Title Danvile made my first home purchase a stressful and infuriating experience. Avoid Fidelity National Title in Danville, CA at all costs. They're horrifyingly unprofessional and don't deserve your business.
