This was supposed to allow me to deduct the investment services I've paid for and other expenses from my investment earnings and reduce my tax liability. They created the LLC promptly, but before I transferred my accounts to it I read "Green's 2026 Trader Tax Guide" by Robert A Green CPA. In it I learned that having the transactions go through a single member LLC does not get around the requirements of achieving Trader Tax Status. I now believe this would be a questionable practice that would potentially result in back taxes and penalties if challenged by the IRS. I just sent a certificate of cancellation to the state for the LLC (cost $220) to avoid having to pay ongoing annual franchise taxes of $300.

It's never been that difficult for me (probably partially because I did work a season at H&R Block in another life), though admittedly it does tend to take a chunk of time and that small nagging feeling in the back of my mind hoping against hope that I didn't mess up and I don't get audited. This year, however, I had a few special concerns dealing with real estate and I knew that finding a CPA to answer some questions would be a good move. We found Rob Haertel (head of Tax Accounting Corporation of America) on the UACPA (Utah Association of CPAs) website and after narrowing the search down to a handful of prospective CPAs, checking online reviews, and making contact with everyone on our list, we decided to go with Rob. We liked that he has been in the business for approximately 40 years and that he could answer questions dealing with small businesses and real estate (he is also the president of Capital Assets Financial, a mortgage lending company). Rob was very professional and pleasant to work with. I was very satisfied with the way he went through the tax preparation with us and made sure that we knew what he was doing and why, giving us useful information along the way. He spent as much time as we needed to answer all of our questions; and, despite the fact that we were there longer than anticipated, we never felt rushed or pushed out the door.
