My partner hired this company to build our home in July 2025, with a promised completion date of November 27, 2025. She paid over $167,000 toward the project, including funds specifically allocated for materials and construction through her bank loan.
A critical component of this project was that the home needed to be built using specialized materials due to my Chronic Inflammatory Response Syndrome (CIRS). This was not optional; it was a medical necessity to ensure a safe and habitable living environment for me. This requirement was clearly communicated and understood at the time of contracting.
During the initial process, Nick Whitney presented himself as having a doctorate in healthcare administration and experience designing and building clean rooms for hospitals, which significantly contributed to my partner and I placing our trust in his ability to handle a medically sensitive construction project.
Despite this, no meaningful construction progress was ever completed. My partner was repeatedly told by Nick Whitney that the project was "on track," that materials were ordered, and that everything was moving forward; however, none of this ultimately proved to be accurate.
Early in the project, Nick Whitney requested that the bank release a substantial portion of my partner's construction loan funds to him up front. It also appears that he may have significantly underbid the cost of the project, potentially to secure the contract, and seems to have increased the price many months later, long after the project was supposed to have been completed.
Based on our experience and the significant lack of progress on this project, we soon became very concerned that these funds may not have been used for their intended purpose and may have been redirected elsewhere.
My partner and I believe that her construction loan funds that were supposed to go toward critical materials were not properly applied, and now, over 8 months later, she has yet to be provided with a clear, transparent, or verifiable accounting of where all her money went.
Additionally, multiple subcontractors have reported that they were not paid for work performed on this project and on other projects, which raises serious concerns about how project funds have been handled.
Multiple former employees have alleged that my partner's construction funds may have been misallocated to other projects and potentially used for personal expenses. While my partner and I cannot independently verify every detail of these claims, based on our personal experience, we both believe that these reports are credible and consistent with what we have encountered.
The lack of progress, combined with inconsistent and misleading communication, has left my partner and I in an extremely devastating financial position and has delayed critical access to a home that was intended to meet my urgent medical safety needs.
My partner has since filed a civil lawsuit against America's Best Construction, LLC and Nick Whitney alleging:
* Fraudulent inducement
* Breach of contract
* Misrepresentation
* Unlawful business practices
This matter is also currently under criminal investigation for alleged fraud and theft by the Daviess County Sheriff's Department, and there are additional pending lawsuits that have been filed against Nick Whitney and America's Best Construction, LLC.
Our terrible experience has been a complete nightmare that has resulted in significant financial loss, extreme stress, and ongoing legal action. Based on what we have gone through, I strongly recommend that others proceed with extreme caution and seriously consider other builders to avoid a similar experience.
