I HIGHLY recommend Mr. Tomasik. I came to Mr. Tomasik after realizing that my previous attorney was trying to settle my case for far less than what it was worth. The first attorney never spoke to me after we signed the contract. All our communication was held through the office assistant, and sometimes it took more than a week to get a call back. Having had this experience, I can say that Mr. Tomasik is so much better. First of all, he is very knowledgeable and extremely thorough, and also very compassionate. If you've been injured and are seeking compensation, the insurance companies try to get you to accept the smallest amount of compensation as possible, even if it is your own insurance that you have paid good money for.. If you try to seek compensation on your own, you are unlikely to get very much. The second question you are asking yourself is, "Should I hire Joseph Tomasik?" Again, the answer is yes! Mr. Tomasik and Jessie Butala are a LEGAL DREAM TEAM. My accident was an incredibly scary time in my life and my brain and body did not function as I was used to after the event. Mr. Tomasik was kind and patient with me and gave me a thorough education on how everything would work. The insurance company of the responsible party paid out the max amount in short order, but it was not adequate to cover the costs of my injury. We had to then go to my insurance to ask for compensation via my Underinsured Motorist policy. That is where the real battle began. My insurance continuously tried to stall settlement. After 6+ months they suddenly argued that I needed to file for Worker's Compensation. I was immediately denied and then my insurance company tried to demand that I appeal the decision and accused me of lying in my paperwork. At that time, Mr. Tomasik wrote them a strongly worded letter demanding that they present evidence of my supposed lies or provide us with a payment. Within a few days, they agreed to pay me the max amount of my policy without forcing me to go to arbitration. You might think this is where the story ends, but accidents aren't so cut and dry once you start to look at medical bills. My medical insurance withheld payment for all of claims related to the accident because it is the responsibility of the auto insurance to pay it. They had to await the settlement before they would adjust my bills and pay for anything. This meant 6+ months of very expensive bills stacking up. Jessie consistently handled all of my bills, accounting for all of the costs, and then worked with my medical insurance and my medical providers to settle all accounts after the settlement finally came in. Mr. Tomasik convinced the medical insurance not to take any reimbursement from my initial settlement with the insurance of the responsible party and we settled everything after the final settlement. This actually ended up being the best possible scenario for me to receive the most money out of my settlement. My experience with Joseph E. Tomasik was brief (because it was just a phone call) however; it was informative, helpful and non-dismissive. I was treated with respect and understanding. I could hear his professionalism and his love for his work. He gave me true and honest advice that gave me hope and courage to file my own case in small claims court. Although my case was too small for his office to handle he did not have to speak to me as kind as he did. He did not have to listen to what I had to say but he did; and as much as he did not represent me in court I know he would give 100% of himself to a paying client. I emailed and called many attorney's in the area when I had my accident at a small chain store here in Berkeley. I even contacted the Attorney's Network on-line and they suggested a few attorney's.
