    A family has had concerns due to counselors ethics. etc. A child had to deal with a counselor J.R…read more who told him in a home visit that he would wear a red MAGA shirt for exposure therapy relating to the parent. This upset the child as the child felt the MFS counselor was targeting the parent in a negative way. Keep in mind that it appears this counselor should not have been assigned to this child as he was not a clinician but a recovery support specialist. Since taking on the "team" approach at MFS, there has been more concerns especially in the past approximately 3 years. The parent's response to this is that it just shows the mentality of the counselor. This child's PHI files were also released unencrypted & unsecured in a 5th attempt (prior 4 failed to be sent) to 2 free emails after the parent requested a USB from the Executive Director P.M., who said this could not be done but the parent advised it could be. Parent DID NOT KNOW the over 1000 pages of the child's PHI files would be sent in an unsecure, unencrypted fashion, until they were sent. -------------------- QUOTED: "Sending PHI to Free Gmail Without Encryption or a BAA -- Is It a HIPAA Violation? Yes -- sending a child's Protected Health Information (PHI) to a free Gmail account without encryption and without a Business Associate Agreement (BAA) is a HIPAA violation." "Bottom line: Sending a child's PHI to a free Gmail account without encryption and without a BAA fails multiple HIPAA safeguards and is a violation. To comply, use a secure, encrypted channel and ensure all recipients are authorized and protected." -------------------- After the unsecure, unencrypted PHI file release on 7/24/26, it was found that MFS Wheaton was now looking for an Executive Director dated 7/25/26. QUOTED: "Metropolitan Family Services (MFS) is searching for an Executive Director to lead their commitment to empowering individuals and families in DuPage County to reach their full potential." Job Summary Location Wheaton, IL Job Type Full Time Salary $130k - $150k Date Posted 2026-07-25 Expiration date 2026-08-24 Also this: https://www.totalhipaa.com/gmail-hipaa-compliant-email-messaging/#:~:text=HIPAA%20mandates%20that%20 The parent is also having concerns relating to their counselor starting from approximately the end of May of 2026, whereas A.L. advised the parent on 7/15/26 or 7/23/26, after the counselor cancelled 2 prior appointments when parent really needed to counsel on the 2 specific dates. Emails were sent outlining the incidents to the counselor, with A.L. before she cancelled & on the dates mentioned, stated, in part, she had a life outside of MFS and the parent should have empathy for her. It would have been nice if A.L. had empathy for her client. A.L. also did not like the parent not consenting to transcription, told the parent she was ending the zoom (7/15/26), that parent needed to get another counselor but parent pointed out when clients come to the office or a counselor goes to the home there is no recording or transcription. Then when the parent would reiterate what A.L. was saying, A.L. would deny she said it & would say well if you allowed transcription, then... This is not conducive to a client especially when a counselor knows the medical conditions, living situation, etc. & appears to press buttons causing an increase in those medical conditions. A new counselor was requested sent to P.M. as it is appearing that A.L. can no longer be objective, unbiased, etc. but there has been no response. Parent is in need of another counselor. "Next step: Start with your local MFS intake, then file a HIPAA complaint with OCR, and if applicable, contact the counselor's licensing board. This multi-pronged approach maximizes your chances of resolution." As the parent states, "Nothing is meant to be accusatory, false, misconstrued, misinformation, misleading, et al., nor is anything meant to be done in an inappropriate fashion but done only in an attempt to protect us."
