I cannot recommend Elliot highly enough for these types of matters. He is super responsive and extremely knowledgeable in this field. My specific case involved some complexities around the statute of limitations and tolling (see more info below). I was under the gun for timing when I called a number of Lemon Law attorneys on a Friday. Elliot was one of the only ones to call me back and did so on a Friday evening, then spent an hour helping me get the claim submitted. If we hadn't done that, the timing wouldn't have worked out for me to successfully do this claim. I don't know about you, but I I want to work with the guy that is calling people back at 5:30pm on a Friday. Just to educate everyone a little bit on this subject. California lemon law has a six-year statute of limitations, but there is also a tolling period that goes along with that legislation. What that means is that you can add on the number of days your vehicle was out of service to the six-year statute. In my case, it had been out of service over eight months and therefore still qualified. Almost all of the firms I called had very low-level people answering their phones, going through a basic checklist, and they failed to understand this concept. Therefore, most of them told me they could not work on my claim.

I called him with a potential Lemon Law case. The ONLY reason he didn't take the case was because the source of potential dangerous fume entering car or leak had not been discovered yet by the 3 Kia Dealerships. 1 Independent shop verified it though but couldn't figure out where it was located. Under the Song-Beverly Consumer Warranty Act (California Lemon Law): Kia does NOT have to successfully diagnose the problem for your claim to be valid. If they can't find or fix it after a reasonable number of attempts, that can still make the vehicle a lemon. California focuses on: Whether a defect exists that's covered under warranty Whether it substantially impairs use, value, or safety Whether Kia was given a reasonable number of repair attempts --not whether they figured out the root cause. What counts as a "reasonable number" in California? There's no strict universal number, but courts often use these guidelines: 2+ attempts if it's a serious safety issue (stalling, braking, etc.) 4+ attempts for non-safety issues 30+ total days in the shop for any warranty issue Even if every invoice says: "Could not duplicate" "No problem found" Those visits can still count. Why your situation can actually be strong Cases where dealers say "we can't find anything" often become good lemon law claims because: You consistently reported the same issue The manufacturer had multiple chances The problem was never fixed That legally looks like: They were unable to repair the vehicle--regardless of diagnosis I had a good case needless to say with TONS of documentation supporting it. What makes it worse is after a horrific situation occured the following day at the last dealership my car was at I called Deanna hysterical. I am disabled and also suffer from Autism so this break down was particulary awful. I needed kindness which Deanna provided. When William got on the phone he told me he still needed that problem found. That I cant sue people for being mean. And when I mentioned fraudulent documents being made from the dealership which falls under Common law fraud, state consumer protection acts, and specific regulations like the Federal Trade Commission (FTC) Used Car Rule he still showed no interest and in a stern voice told me to take my business elsewhere. Would not recommend. I have several other lawyers interested in helping me now. I even filed the Lemon Law letter all by myself when I was asking for help. Would not recommended. Deanna- go open your own Law Firm you will be highly successful. Stay compassionate!!!!!!!!!!!!!

At first I believed she was an excellent attorney and was very hopeful. That changed quickly. She heavily promotes the recent bench trial verdict in In re Durable Power of Attorney of Dock Dean (Case No. 23STPB13044, Los Angeles Superior Court) as a $47 million victory on her firm's website and in press releases. In reality, this appears to be self-promotion. She went after the easiest targets among the three defendants, obtained a large judgment that has not yet resulted in meaningful recovery for the estate, and is now billing my father's estate for hundreds of thousands of dollars--amounts that independent tax and estate planning professionals have told me provided no real benefit to my father. Her most serious error was representing two beneficiaries with unequal interests in the estate--the victim's son and granddaughter--creating a clear non-waivable conflict of interest. This led to her actively pitting me against my niece and permanently damaging our family relationship. She has since become adversarial toward me in court filings, including making negative statements about me that appear to violate basic attorney ethics rules. What should have been her breakthrough case instead exposed disloyalty and poor judgment. I also experienced her overstepping her role as an attorney. She repeatedly tried to control aspects of my personal and financial life and offered financial advice without any qualifications to do so. Her communication style was often intimidating and made me feel pressured rather than supported. Former employees have posted concerning reviews on Glassdoor about the work environment at Evans Law Firm, which aligns with my experience. I strongly advise anyone considering hiring Ingrid Evans to trust their instincts and look elsewhere. She is not the dedicated advocate she presents herself to be. Half these reviews are fake... she asked me to write a review last year way before the ending of my case, and I promised her I would write an accurate and truthful review at the conclusion of our engagement.
