My family put together a 4 day mini-vacation (July 15-18, 2016) for my wife and me, as a gift for our 50th wedding anniversary. They rented a large house to accommodate our whole family of three children and their spouses, and our six grandchildren. They also booked two excursions for all of us to go on. One was a river tubbing excursion, and the second, a white water rafting excursion. The white water rafting excursion was booked and paid for with Raft NH in Gorham, NH. The amount paid was $648.00.
On the morning of the rafting excursion, July 17, 2016, it was raining hard and the weather forecast for the day was a strong possibility of rain and severe thunder storms all day. The hourly forecast showed a 70-80% chance of thunder storms at 2 and 3 pm. Our appointed time of arrival at Raft NH was 1:30 pm. All of our party had deep reservations about being on the water with the very strong possibility of a thunder storm occurring.
Because of these circumstances, I telephoned Raft NH at 9:19 am to voice our concerns. I was informed by the woman who answered that there were no refunds given regardless of circumstances. I was further told that if there was in fact a thunder storm, then they would wait until it was over, and then go. When I questioned the possibility of it occurring while we were out on the water, I was told that they would put ashore, and we would wait under the trees until it stopped (which is the one thing you should never do in a thunder storm).
I told the woman I was speaking with that the whole thing was quite absurd and that I would probably speak to an attorney. (I never said I was cancelling the trip, but that I would speak with an attorney). The woman said she would let the owner know.
Later in the day, the sky cleared and the sun came out partially, and so, we decided it was better to try taking the trip, rather than losing the $648.00, and we went to Raft NH and arrived at 1:15 pm, fifteen minutes earlier than our scheduled time. When we went into the office, we were told that there would be no trip, because I never called to confirm that we were going, and they had sent the bus driver home, and there would be no refund. Take note, that when we arrived, there was a bus with a trailer attached parked out front. All the rafts to be used were also there. The bottom line is that we were present and ready to go fifteen minutes before we had to be there, we were denied the service that had been paid for.
After leaving Raft NH, we went a short ways up the street to a Walmart. Fifteen minutes later we returned past the front of Raft NH and the bus was gone. (Question, if they sent the bus driver home, who drove the bus away?) Also, later on in the day the owner called twice. On the second call he offered us a 25% refund. The group rejected the offer, and instead decided to seek a legal remedy. read more
