Period…read more Based on my experience, I view this firm as part of what I call the "Theut Cartel"--a network of lawyers and firms operating within Arizona's conservatorship and guardianship system in ways that I believe can financially devastate the very families the system is supposed to protect. My experience with this system has left me deeply concerned about the enormous power court-appointed professionals can exercise over a person's property, finances, and legal rights. When substantial professional fees accumulate while the protected person has limited practical ability to challenge what is happening, the consequences can be devastating. I am also deeply troubled by the lack of a jury determination in these proceedings and by what I perceive as an unusually close relationship between repeat court-appointed professionals and the judicial system in which they regularly practice. Former Judge Lisa Ann VandenBerg later became Arizona's Presiding Disciplinary Judge. Based on my own experience with proceedings before her, that progression only increased my concerns about accountability within this system. Anyone facing an Arizona guardianship or conservatorship should obtain independent counsel, carefully review every accounting and fee application, preserve every court record, and scrutinize every professional appointed to the case. In my experience, once this machinery begins moving, challenging it can be extraordinarily difficult.
