My experience with The Trademark Guy (aka Kevin); $450 original filing + $550 USPTO action = Zip, Zero results. Read on... 1. Filed mark for us in Sept of 2020, 2. No follow ups, no communication (without us reaching out first, always), 3. We checked in with USPTO, saw on Feb 9 USPTO sent communication to Kevin and his attorney who works with him to respond..., - We never got a notice or email from Kevin of that status. Instead WE followed up with him in March... Which was a MONTH later when we happened to go in to USPTO to check the status. 4. After talking with Kevin, he explains it will cost us "more" money blah blah blah to have their lawyers do an action response to USPTO. We agreed on terms, etc. - We paid for additional services on March 31, 2021, which is fair, we had no qualms about paying for Office Action response. 6. We went into USPTO to check status again on April 26, 2021. Saw crickets. Radio silence. They seriously did nothing for another month. 7. Followed up with Kevin over email. He sends back a cryptic note: "Oh the attorney is researching and says it's difficult... , remember, we have 6 months..." Basically the brush off, hogwash. 7a. All the Attorney's I got an estimate from responded (after I explained the attorney working with us was a DUD); that if you know what you're doing, it's NOT DIFFICULT... Opinion: ** Professionals communicate on-going with a status. ** Kevin and his Attorney want easy peasy TM work, that he can pocket quickly, but going the distance after being paid, that's not their specialty. ** Kevin never told us there'd be "further" delays (on their side) once he and I recapped next steps prior to paying the additional $550. ** We asked for our $550 refund. They initially tried to short refund us and only refund $537.75 for wasting our time and doing NOTHING? We got every dollar back. ** Kevin is the middleman and the Attorney pockets the money and drags his feet. I will be reporting the attorney and making a complaint here: http://www.calbar.ca.gov/Public/Complaints-Claims ** See our email correspondence (wiped out some parts for TM confidentiality). We want to show people the POOR communication and chasing we had to do to, which wasted our time. MAJOR TIP: Knowing about Office Actions responses is important. We ended up going to Online Trademark Attorneys onlinetrademarkattorneys.com. They have flat rate fees. Once you're a client, you have direct contact with the lawyer, NO middleman. Super buttoned up, nice folks that actually know what they are doing when it comes to responding to Office Actions. read more
