At the window try their best to be helpful, but they are hamstring by the process. Unfortunately, the system work against defendant. Sadly, this is not a court where an individual can get true justice. More and more an individual is punished for exercising is constitutional right to trial. The commissioner will refuse traffic school after trial for 90% of all case. He also will suspend licenses for anyone charged with speeding in excess of 15 miles over the posted speed limit. I Fought the Law, and the Law Won....Not! Last July, I was pulled over within a Contra Costa County Community for allegedly going 50 in a 35 mph zone. I fumed to myself as the Officer and I went through the "process", and later stuck the paperwork in the glove compartment so I wouldn't have to look at it. Over the next couple months, I continued to seethe and debated the following choices: 1. Pay the $284 (!) Fine and the Traffic School Supplements. 2. Appeal via the Written Submission Process. 3. Appeal at Traffic Court in Person. I also had the Lyrics from the old Branded TV Series (Staring Chuck Connors) singing through my head (with a few edits): All but one man was found guilty, There in Walnut Creek (Traffic Court), And they say he sped away ... Branded! Marked with a coward's shame. What do you do when you're branded, Will you fight for your name? He was innocent, Not a charge was true, But the world may never know ... At one point (Option 1), I had the check written and the envelope addressed and stamped. But at the last minute, I just couldn't in good conscience plead Guilty. I tore it all up, hopped in my car, drove to the WC, and waited in a short line for the Option 2 Paperwork and the requirement that I pay the bail forward (cash or check only). I then sat on that for a couple weeks and finally wrote out my plea and mailed it just before Gayle and I flew off to Spain. I figured that I was screwed regardless, but figured that if the Law erroneously deemed me guilty, they were going to have to earn it (in this small way) in terms of my due process rights. A week after I returned, the envelope from Court landed in my mail box - NOT GUILTY! I'm not really sure which of my arguments convinced the Court or that maybe the Police Officer in question decided not to "show up" or otherwise respond. However, as a public service, here's a lightly edited version of my successful Plea: I honestly do not believe that I was speeding at the day and time specified on Ticket #XYZ. My clear recollection is that I was driving at the speed of traffic (~35-40 miles per hour) of which I mentioned to the Officer. I also stated that there was a car behind me and ahead of me and that consistent distances were maintained between those 2 vehicles. Also, after receiving the Citation, I returned to the same stretch of road and confirmed my speed. I would also like the opportunity to review specific information regarding the measurement of my speed at the time of the Citation. In particular, I'm interested in obtaining: - Objective proof that the Officer was actually using a Speed Gun. I asked to see it at the time and my request was declined. It's entirely possible that a more imprecise visual method was used. If a Speed Gun was used, I would like to obtain copies of: - The Manufacturer's Manual - Any related Police Department Procedures directly related to the use of this device. - The Officer's Training Records (including any Tests) on this device. - Calibration Records of the Speed Gun that show that they were done on a regular basis per Manufacturer's specification. Please note that I asked the Officer for a phone number/address that I could contact to receive this information. He was emphatic that I absolutely had no right to any of this information. I believe that I have the legal right to review any objective evidence against me that would confirm the associated burden of proof on the Police Department's part. read more

No one likes being here. Not the Jury Duty people. Not the people who have to show up for court because they got pulled over for a citation. Not even the people working here. My recent experience... The employees were 10 minutes late, opening the doors. Afterwards, it was another 10 minutes because they didn't prepare for checking people in (metal-detectors, pat downs and what-not). The 'admin' people who work there are sassy as F too. Honestly, I don't understand why I still have to pay the different for a ticket when YOU messed up on billing the citation. Anyways. Review #243 - 2016 Well, here's another place that I'd NEVER imagine myself writing a 4-star review for... Going to court is probably one of the worse thing that I could ever imagine doing on any given day, especially traffic court. My nephew got a speeding ticket and we ended up here twice because the first time we showed up, we were told he had to bring a parent or legal guardian since he was under 18, which I'm neither. The reason for my good rating is because I felt like we were treated like human beings rather than looked upon as criminals like other courthouses that I've been to. The officers up front who were checking us in were kind and polite, the cashier was helpful and nice, even the bailiff and judge were nice. I'm been to the Richmond courthouse plenty of times--so, if you want to see why I think this courthouse deserves a 4-star rating, you'll have to go experience the ghetto first. read more

I have not been to court in a long time but since Officer D. Gregory from the Orinda Police department pulled me over for a Hollywood stop I had pay a fine of $289. So to be fair yes I didn't make a complete stop and count to 6 but I did make a stop just like everyone does everyday. It is obvious that Orinda cops have nothing better to do than to hide behind a bush and trap people this way. If I would have gotten a speeding ticket than I wouldn't be as upset but this is a quick way for them to make money. The deputy and signs all over the court state that no citation reductions will be given so unless you are going to fight the ticket save yourself some time and just pay online. If you end up getting judge P Fangan don't bother fighting your ticket even if you have evidence showing your ticket has no validity. This judge with not allow you to take traffic School, there is not fine reduction, and there is no community service even if you are bellow the poverty line and your license will be suspended for 7 days. Corrupt court on a money grab. After getting a ticket for traffic violation I did not commit, I sent my payment for the traffic violation on time. But they take weeks to open their mail. So they keep adding on more fees, and if you contest it, they take a long time to answer, have you fill out forms, then ask you to pay more and more. So they added on over 685 dollars after I already paid 237. I hate them so much! The lesson learned is don't mess with the government, they have the power, you don't have the power, you just get one vote for corrupt politicians in a corrupt and sick system. They keep taking more power and taking more money. Abusive and unjust, they prey on the those they should protect and serve. I wish we could find some justice against this corrupt court, like a class action lawsuit against them for extorting money from the people. I want to share my experience appearing in Traffic Court in Walnut Creek, Department 59 of the Contra Costa County Superior Court. I received a citation for a Vehicle Code violation on April 14, 2011. I appeared at the Court Clerk's counter at the Walnut Creek courthouse on June 24 and told the clerk that I wanted a trial date. I was given an August 26 trial date, and was told to appear at 2:00. I arrived at the courthouse on August 26 around 1:30. After passing through the metal detector at the entrance, I proceeded to Department 59, which is on the first floor past the Clerk's counter. There was no need to check in anywhere. Commissioner Joel Golub was presiding, and called the calendar right at 2:00, noting which of the approximately 20 defendants were present. All in the courtroom were sworn to tell the truth by the courtroom clerk. The Court then proceeded to call each case, although I couldn't tell in what order. When a matter was called, the defendant and the officer that issued the citation came forward and stood at two podiums very near the judge. After the commissioner asked if the defendant pleaded guilty, not guilty or no contest, the officer then gave a formal statement of the circumstances that led to the issuance of the citation, going over the facts in some detail. The defendant was then allowed to ask questions of the officer, to clarify facts, or point out inconsistencies or gaps in the officer's testimony (not to make his or her arguments). The defendant next was allowed to make a statement, the officer was allowed to respond, and the defendant was asked one more time for questions or statements. The commissioner then ruled on the matter, almost always finding the defendant guilty, and set the fine to be paid. The defendant was given the opportunity to pay the fine to the courtroom clerk, or to do so later. In my case, the officer did not appear, and the Court dismissed my matter, so I didn't have to pay any fines. A few pointers: - Show up to the courthouse early; you will have to go through the metal detector, which can be backed up; you don't want to be late - Refer to the commissioner as "Your Honor," and listen closely to his instructions or questions; Commissioner Golub has been hearing traffic matters for a long time, and is a little stern at times, but seemed pretty fair (that doesn't mean he favors the defendants, but he will listen to what you have to say) - You are not allowed to bring food or drinks into the courtroom (but you can bring bottled water); you may not read or use your phone (and of course you should silence the ringer) - Dress decently; you don't need to wear a suit or dress, but don't wear cutoffs or gym shorts, either read more

The entire system is a joke and a disgusting way to pay for the salaries of court administration and more lazy cops who have nothing better to do than enforce non-dangerous violations of the law. Judge Fagan is perhaps the worst judge I've ever met. He always sides with the cop no matter how good your evidence is. When I asked for proof that I was going the speed indicated, the cop said he had none yet the judge still allowed the case to go forward. This scumbag Fagan fails to uphold the law and is only eager to maximize your fine. He wouldn't even allow me traffic school despite the fact that I qualified for it. Until the people of Contra Costa County stand up and demand an end to excessive ticketing, we will continue to be raped by these animals. After reading the reviews, I was afraid of what my experience might be. I showed up at 8am, to pay my first traffic ticket. There's a parking lot (yay!), there was a line of about 10 people going in (pretty easy), then once I get into the county clerk, there is another line, waited for about 30 minutes in line (not bad). Too bad I could only give one star I would have given them negative 100 starts if I could. First of all the traffic law system is the most corrupt system in the overall California justice system. The root cause is simple, the whole system runs on traffic ticket fines. The police officers got paid for appearing in the court, the court commissioner is hired by the court, (That's why you never see a judge in a traffic case, all of them are commissioners). The court bailiff is hired by court and they think themselves a judge too even they didn't get a high school diploma. First of all when you entered the courts, you see a crow of people defend themselves for their tickets. Well too sad for them, this court is not a place to exercise the constitutional rights to defend themselves, they are just source of revenue of this highly corrupted system. Second you will wonder, why all the people there are grassroots, and surprisingly lots of them are minority ethical groups. The answer to me is simple, elite people won't get ticket with their fancy cars, if they got caught, their lawyer will do the work. Who will go to this crappy place try to fight for ticket of hundred dollars? Of course the grassroots. Apparently the commissioner, Jennifer Lee for my case, doesn't care too much of justice and constitutional rights. She knows well who is paying her payroll check and she did a pretty good job keeping her job. Not only herself, the court bailiff will not be just like a security guard, he will be proudly acting like a supreme court judge and asserting his privilege to stop defendant, educating them, yelling at them, throwing your presented evidence away, and above all, using force against defendant, he will not hesitate to drag you out of courtroom to end your hopeless fight against the corrupted traffic system. read more

So I'm writing this review for other folks like me who like to at least know a little about what they're up against when it comes to situations that involve the court. So I received a ticket for driving on suspended as well as no proof of insurance. As soon as you sit down the judge (it was a woman the day I went) tells you she does not reduce any fines because she wants to be "fair" to everyone. She does give you the option of community service if you can't afford to pay. Oh and she will lecture you about driving when you're not supposed to. Also for any correctable violation you only have 48 hours to pay the dismissal fee or you will be forced to pay the full amount. Honestly if you can afford a lawyer I would encourage you to get one read more

I needed to pay a traffic fine, and went to the Walnut Creek office to pay in person. The clerk (paid by the tax payers) behind the counter was rude, unfriendly with no people skills. I walked toward her window as the person in front of me finished his business. She looked up and rudely told me "I haven't called you up here yet" As I am a tax payer who pays her salary, I was taken aback. So I got back in line a waited for 5 minutes while she sat at her station and did nothing. When finally called forward I slid my payment notice through the too small slot in the window. It slid through and landed on her desk (that the tax payers paid for). She looked up and said, "you threw that paper at me". The slot is 6" wide, there is no throwing possible. The transaction was handled very badly, I will be contacting her superior (a person that is also paid by the tax payers). The name on the receipt is KJOHN1, she has a bad attitude and obviously either hates her job, her life, herself, and most likely not in that order. If she toughs out her unbearable job until retirement, she will enjoy a cushy check and medical benefits that she didn't contribute toward (paid by the tax payers). read more

Let me preface my story by saying that I am a solid law-abiding citizen, age 41, college-educated, professionally employed, homeowner, normal-looking, normal-acting, normal-dressing guy with only one moving violation in 25 years of driving, and absolutely no criminal record of any kind, served on a jury 2 years prior. Not that any of these personal characteristics should have a bearing on our treatment in the Justice system, but I wanted to set the scene. I received a ticket for a red light . . the standard outrageous confiscatory fine of $490 that California levies for this offense in a blatant taxation-by-citation ripoff. The point of this Yelp review is not to relitigate my ticket (doing so is a 10-page essay with exhibits and diagrams and accompanied by videos) but suffice it to say I did not do it and I was determined to prove my innocence in Court. So I asked for a court date and received a date. Then, I received a series of notices every few weeks notifying me that my hearing had been "continued" (that was legalese that I had to decipher; hey CC court, why don't you clarify these notices by making it clear that this gibberish simply means "hearing has been rescheduled and you do not have to come on the original date"). Eventually, I moved out of state (to Seattle) to take another job, yet I had still not had my trial because it kept being postponed. In California, you are allowed to do a "trial by written declaration" for most moving violations. So I wrote to the Court explaining that I was moving 800 miles away and accordingly I was respectfully asking that my trial be changed from a courtroom hearing to one by written declaration (as I would have been entitled to had I requested it initially), and I included with my submission of my evidence, including diagrams and video of the light timing cycles and such. Much to my unpleasant surprise, I received a letter back from the Court saying that Commissioner Golub DENIED my request to change to trial by written declaration. And there is some pretty scary stuff that can happen if you fail to appear for a court date . . . drivers license suspension, additional fines, potential criminal record, etc. I could not believe this. It was not going to be practical or feasible to fly down to the Bay Area from Seattle just for a court date, and if I did, I'd end up spending more on travel than the cost of the ticket . . . and I might end up with airline change fees given that they kept changing the date on me on short notice. Seems I had only two choices: (1) Change my plea to guilty for something of which I was not guilty (and it was not clear that you could plead guilty through the mail) or (2) Hire an attorney. I went with option 2. I spent $250 on an attorney. It turns out it was worth it because upon presentation of the evidence, the court (after yet another 3 continuations of hearing) reduced the ticket to a non-point violation and refunded the differential in the fine, a differential that paid for the attorney. That was the only semi-positive aspect of this experience, though true justice would have meant complete dismissal of the citation. read more

unbelievable travesty, Totally unfair. Our 17 year old son got his 1st speeding ticket. My husband and him went to court on the court date listed on the ticket and were told they needed to wait for the paper in the mail, which didn't come for another 3 weeks or so. We thought we would just pay the fine and or traffic school for him, but the notices stated must appear in court. They went to court this am thinking we would pay a fine and some traffic school. My straight A student who is preparing his essay and college applications received 20 hour community service. Just don't understand how the system could do this with no options. Don't bother fighting your ticket, there is no justice to be had here. It's all about generating revenue! Took my son to WC Traffic Court. What a farce! Judge Fangan sided with the police officers on every case, found everyone guilty, despite some obvious mitigating circumstances and even blatant lying by the officers. Each officer started his statement saying he had checked his radar gun before going on shift, and vowed that it was working to specification. Come on guys, do you think we are stupid? No matter what the defendants said, in every case the judge found them guilty. Didn't reduce one fine, disallowed traffic school in every case. In short this is just a kangaroo court for the purpose of making money. Judge Fangan should be disbarred and the officers should be ashamed of themselves. read more

Department 59 is total joke. I went today to show my proof of insurance and pleaded no contest to the speeding charge. Judge Joel didn't accept the proof of insurance I brought because it didn't have my name. Even though I explained that it's a company vehicle. So I drove back to Oakland, went to my job to get a document saying that I was insured during the date I was cited. Got back to the court house by 11am to set a 1:30p appearance. Got back to department 59 by 1:15p, sat thru 2 hours of people trying to be lawyers which was pretty pathetic. After doing all of that, the judge never called my name, they said I was late and to come back tomorrow. read more

I have to say after reading all the negative reviews I was quite Leary about going to the court! I must say it was a very pleasant expierence, as going to Traffic court can be! I walked in at 8:30 am and walked right up to the window, not a person in line ahead. The Asian lady who helped me was very pleasant! Since I could not get mine ticket reduced at the window (non correctable ticket for not having a CA license) I decided since I had the time I would try to see the judge and see how it went! What did I have to loose? I did have a Dr License from another state but the officer said I was un licensed on my citation, fine $548, ouch! 2 citations, the other for not using a hands free device, yes talking on my Cell with out my headset, which by the was I NEVER DO, except when there was a CHP in the car next to me headed north on Benicia Bridge! Saw Commisioner/Judge Fagan, and showed my valid license from Another state and my new Ca one and he reduced my Unlicensed citation. I saw many people come and go and he was very fair with all of them, most young people there with their parents got community service! People who asked for community service got it. Restored my faith in the law, there are very decent people and judges who for the Superior Courts, thank God! Commissioner Fagan Rocks! I ended up paying about 1/2 which was better than the entire amount! read more

Traffic court is never good but this place gets three stars when compared to other traffic courts. This court has enough parking to accommodate people. I went here to assist a family friend fight a traffic citation because I know something about that. Unfortunately a clerk told my friend that she could not have a trial by written declaration because she requested an extension which is not true. Unfortunately the officer showed up for my friends trial. The officer refused to accept a plea bargain to a 22526(a) blocking an intersection. My friend got commissioner Davis. My friend was charged with failure to stop at a circular red light signal. My friend was able to prove that the signal was an arrow signal and not a circular signal. Since the officer charged my friend with the wrong citation code she won at trial. My understanding was that every person who fought the cop based on contradicting the officer's testimony lost their case. Commissioner Davis did allow people who lost their case to take traffic school if they were eligible as opposed to some other judges. For those of you who are interested in fighting your citations I would strongly recommend the Nolo book, "Fight Your Ticket & Win in California." If you want to get a different judge or commissioner you can file a peremptory challenge. If you want to get the officer's notes and dashcam footage and body-cam footage you can file a discovery request. Unless you have a badge my advice would be to lawyer up or just pay the fine. It's your word versus the cops-you won't win. There won't be a discussion on reducing the fine. You will waste a paid day of work to wait 15 mins for the judge to tell you your guilty and that you need to pay in full. It's unfortunate for good, hard working people who don't break the law and feel that the punishment is unfair for something you know you didn't do. I will give one star for the clerks who are all very pleasant when I had to schedule my court date then unfortunately pay the fine. They deal with a high volume of grumpy people and still have a positive attitude. I've never been to court before and had no idea what I needed to do but they went over step by step what needed to be done and will even try and find a payment plan if the fine is too high to pay in full. read more

When I asked to appear before the court i was asked if I was going to be represented by an lawyer. I marked no. When my case was heard, the Danville officer presented a dark and rather hard to see video from his helmet cam. I'm no lawyer, but thought this was unfair, as a lawyer could have argued the condition of the video which I couldn't do. Seems unfair to me to to let them know that no lawyer would be present and the judge allows the police to provide their evidence that you do not have a lawyer to argue for you. I agree that it seems a waste of time to go to court in CCC. Not a fair playing field. read more

My experiences: Parking: not a problem. Had heard it gets full, but I never had an issue both times I was here. Entry: deputies were a little uptight, but then it must be boring duty. You must go through a metal detector, so be prepared. Clerks: these people are awesome; best part of the whole experience. They must deal with alot of PO'd people, but they were very cool and answered all my questions. Bailiff: again awesome. Lightened the mood a little with a few wisecracks during the explantion of court rules. Judge: completely uptight. Someone else said rubber stamp and I agree. Golum seemed to want to get through the stack as quick as possible. State your name and your plea. Anything else to say? Make it quick and get out. To Eric B. I had the same experiance with the Danville/Walnut Creek court and police there. I was in Daville and got pulled over by a woman police officer. I was going south of San Ramon Valley Rd and she was going north. I was at a stop light for about a min. She pulls up in the turning lane from the direction she was going and on a loud speaker and car was lite up like a Christmas tree - she told me to pull over. I had no idea what it was about so I asked her. She (officer) told me that I was speeding. I went to court about it. As I was entering the court house the conduct of all of the officers there was inapproperate. The male officers was giving cat calls to the woman officer that pulled me over. When it was my turn to face the judge the woman officer seem to be very flirtty with him. She showed me this paper that was to rate the time of day that I was supposed to pulled over thinking that I would forget the real time that I did get pulled over. Her radar gun paper read out said it was 9 am. The time I was pulled over was at 7:30 am. That I was able to read and understand. The judge was on her side. I felt so horrible because he did not want to hear what I had to say that went on. I argue with him about it. I asked him how can my car which is a 4 cyl. go from on stop light to another one - each 1 block apart from eachother from 0 mph to 50 mph in a 30 zone? The judge said that he does not know the preformace of my car. If he read the ticket he would have seen that my car was a 2001 Mitz. Galant ES which is the lower end of the Galants. And I did pay my fine because I felt that I was never going to win that case. They took my money and I wish I could sue them. I throw away the paperwork of everything because that's how unjust I felt. I still feel that I had been victiumized by Walnut Creek Court House. read more

My experience in this traffic court echoes many others on this page. Every person there who contested his/her ticket was found guilty. The only tickets dismissed were the ones where the issuing officer was not present. There is a state agency with oversight of the courts, and there is a way to officially complain about a judge. Maybe if enough of us went through this process, this judge's record would be reviewed. Lazy, inefficient, dour. Poor customer service overall. No incentive to improve because their jobs are secure. I'm state employee and union member, and the county could improve it's service -- but, they choose not to. read more

Wow, I really didn't know there would be yelp reviews on this place as a government agency, but yah, after reading 2, I gotta beef it up. Went to traffic court March 2014 because my youngster son got a speeding ticket coming east on 24. He was at fault no doubt. The judge thankfully granted him community service in leu of the exorbitant fees and a one month license suspension, which he deserved for the amount of speed he was going. Well, the traffic court day went well I thought, but the clerk told me in one month I could come back and without him present to pick up his license. Came back to pick up license, i didn't know the hours of clerks office, well they close everyday at 1. Friendly Sheriff in front security made me aware. So few days later I got back out to get his license. It didn't dawn on me till later that the whole experience to just pick up the license was worth a yelp review. Wow, then surprised to see that many felt the same as muah!!!! The Sheriff and Xray man were in the security area. I was only one coming in then. No one batted an eyelash. As if I was a piece of wind. Sheriff was almost in a position of sleep it appeared. I didn't even know what to do cause the Xray machine wasn't on and I didn't even see anyone manning it. So, I stood there waiting for someone to say something, the sheriff barely muttered "come through" then suddenly the machine started up and by the time I got to the other side I saw the Xray man, not one person said hello, good morning, sheriff man didn't even get up stand up, nothing.....wow, for a security officer, officer of the law to behave that way, unbelievable. He was even in a vulnerable position where one could easily do something to him especially since he was so "out of it" and blazay.....I work in a hospital with security guards who are way more alert and ready than this guy. I would recommend not getting a ticket anywhere in C.C. county if you have to deal with this personnel. Even the clerk was annoyed with me telling me that I couldn't pick up my son's license, that wasn't their policy. Well, lady, then don't have your staff telling persons they can. The clerk that originally filed, filled out our paperwork was super friendly and sweet, but she wasn't there that day. read more

This is the worst court I have ever been at. Believe me. I have been in Hayward, San Mateo, Pleasantness but found WC the worst. They make you hate everything. Their service is so poor. I am not talking about the clerks. I found good people there who also agreed with me about their own court. I am talking about their judge. Not only they have no mercy, they don't believe you. I saw the judge made fun of someone too. I got the ticket in San Ramon for really a silly speed issue by those motorbike cops that I really hate. They have no advantage but to get money out of people's pocket and also raise their insurance. They never come to help you when you need it. They never save your life against criminals. They are just there to rob you legally. I got the mail and had 2 month period to pay it. I went to WC court in few days to get it lower as I did not believe I was 100% guilty, going few mile over with Prius! Ya funny. I am the only Prius got speed ticket! You know what the judge did to me? He not only ignored me and never really listened to me but also he change the due date to 48 hours. I told him I had a wife who lost her job and all our family including my 3 little kids depend on my income which is not really that much. He helped me by changing 2 months due to 2 days. He also denied my request for voluntary work which I had done before approved by other course in Hayward or San Mateo. He is still there and waiting for people like me and you. He will be the one who would pay off a lot on the day of judgement in front of the real Judge. Whenever I remember him, I just like to go much faster to revenge what he did to me. read more

I had the pleasure of speaking with K.J. at the W.C. Superior Court Traffic Call Center, not once but as luck would have it on two different occasions. This lady went above and beyond in customer service skills. What a delight to speak with. This lady is a GEM!, K.J. is the only experience I have with the W.C. Superior Court Call Center, but if the rest of the employees are 1/2 as helpful as K.J. you will find you have a great experience as well. read more
