Since I needed to provide verification of date of birth to start Medicare, a trip to the office was required. Fortunately, there is a location just 2 miles from us in SW Austin. The facility is large, clean and institutional. Wouldn't expect anything different. The waiting area is large, with lot's of seats. There were clean restrooms and water dispensers. You cannot bring in food/drink, no biggie. Once we arrived, I expected a decent wait time, so brought the spousey to join me and we just enjoyed each other during the wait. When we entered, not really knowing next steps, I went to ask the gentlemen in a uniform for direction behind a counter. I barely got out, Good Afternoon, I was.... well cutoff.. and told, check in at the kiosk as he pointed to the thingy to my left and went back to what was more important than helping me. Look, I feel for these folks who have these jobs. I'm sure they work with a great deal of angst from folks, not getting what they think they deserve from the system and may be the target of their discontent. However, it would be nice if he would of let me finish my statement, perhaps a smile, but not today. Hit up the kiosk, checked in, got a ticket and we sat and watched the monitor for when it was our time. As you are informed, your wait my be longer or shorter then others already in the room. Depends what you are there for. My number was called and we were greeted by a smiling agent, who took it from there. He eliminated my fears that I may have been a little late to apply, took my identification, including my Dutch birth certificate, passport and TDL to make copies. Came back, let me know I was all set and would be receiving stuff in the mail. Polite, efficient and pleasant interaction. I believe we may have been waiting 25mins. It was pretty quick IMO. We headed out and I made a point to walk out by the counter, smiled really big at the same gentlemen and thanked the dude and wished him a good afternoon. This blew him away by the look on his face, he managed a smile and wished me the same. Kill them with kindness is always a moto for me. For reference, I was there on a Friday a little after noon. The reason for my visit was to file paperwork and get it notarized so that I can defer my property taxes since you can do that when you turn 65. I got here before the lunch rush on a Tuesday which meant there was no waiting and parking was available. Turning in the paperwork and getting it notarized was easy and convenient and at no cost to me. The person at the front desk was very helpful as was the notary. It seems to be a more pleasant experience to defer ones taxes with a 5% annual penalty than to actually protest ones taxes. Either way, they get their money in the end. At least it was a pleasant experience.

I have two cases that have never been addressed. One was entered into system assigned to civilian…read moreassistant to then APD COP. The other was entered as a case but bungled so miserably they lost notarized , written testimonial evidence. The exact type of evidence is REAL WRITTEN DOCUMENTARY evidence that demands protection during receipt, storage, transfer , disposition and disposal. The OPO is a duplicate office of the APD internal affairs but a far less competent and far below satisfactory performing agency. But the APD internal affairs cant be trusted to investigate dirty police. That is why the city commits waste and abuse duplicating agency in place office. The OPO lost the evidence , then fabricated excuses , then lied but have said im " banned " from the building. Banned is comparable to a rock song from guns and roses. Banned due to words used and verb-age. This is only introduction. There is plenty meat to outrage over. Pending At this point i have 2 open case with the city of Austin Office of Police Oversite. 10/20/22 my pov was towed from a paid parking space. It was on my Chase Bank debit card. I was assigned a case worker and to date there has been no official response to why my pov was towed despite paid to park status. Led Zeppelin would say "Its been a long time since I rock and rolled." But in thos case with Austin OPO ots just 3 years due. Back to case number 2. I slight storm entered and left the 78750. Im driving my 2008 Dodge south between Lake Creek and Spicewood Springs Im in my own lane and stayed there. From behind i am hit by late model Cadillac Denali. Right away the driver is trying to evade contact. I get out of my pov at great risk and locate white in color SUV. That is how i will refer to at fault vehicle going forward. I make contact with 60-65 yoa white man with his window down. He agrees to meet in strip mall parking lot. Ive snapped a picture of his tag and have my documents in hand. I get close enough to observe a heavy odor of alcoholic beverage emitting from his person. I am dialing 911. As his breath knocks me over , he starts his car and is leaving. The 911 operator tells me " no police available and orders me NOT TO FOLLOW. The driver gets away. The city of Austin has a responsibility to man 911 with trained competent emergency operators. They do not, did not and will not. 911 tracks all police officers 24/7 and know exacting location of all on duty police. Its not even a new technology. Its been around for decades. There is an officer on scene at a less priority call that can break free and look for two tons of steel on wheels operated by a drunk. That is a weapon that will /can/would/might wipe out you and family. The entire handling of this has been a ridiculous escapade of emergency service failure. I completed a APD affidavit issued to me by OPO. I got it notarized and took it to the OPO. I hand delivered to OPO and went on my way. No receipt was issued and that was OPO failure 1. A piece of notarized affidavit issued a written piece of real evidence . It requires a CHAIN OF CUSTODY. The mishandling of evidence brings instant credibility issues to the OPO. The unwillingness to do a job as assigned and required by a civilian assistant to then COP Chacon is unacceptable and stands alone on its own dis merit. Janet Jackson is performing superstar. She is from my hometown. Its only reason I know who the administrative assistant that wont do her job a few years ago. Right away I experienced barriers to effective communication from the OPO. On two separate instances , i drove to OPO and made contact with front desk. It was summer and I was advised the office was closed due to AC issues. Yet most or some other offices were open. I really dont know much else at this point. The next time I went to the OPO I eas advised the affidavit was lost /misplaced/thrown away or discarded with no known location available. Never again did I come aware the OPO ever had the paperwork. This has transpired pver a few years and I KNOW THAT DUI fatal accidents proliferate on the streets and highways of Austin, Texas. Its going on NOW. My car was total loss. Never recovering at all from impact of felony hit and run primarily SCREWED up by 911 dispatcher upon initial report. During first year of my case the OPO director was tired of dealing with me and i was advised by front security desk that am banned Director Ellis was advised of my intent and presence and came dowm out of his own office in person. Ellis is a veteran USMarshall agent. He should absolutely know how to receive, safeguard, process, transfer and dispose of REAL DOCUMENTARY EVIDENCE. But Ellis took wasted LEO resource and called on duty APD to trespass me. The APD arrived on scene and DID NOT TRESPASS ''me because he is street cop and know im not there as hobby. But, there is overpriced housing and the infrastructure that does not meet the need of the current population. Traffic can be crazy based on where you are trying to go. The list can go on. So despite being a registered voter since 1977, I've never had an actual jury summons. Till last…read moremonth that is. Figures. The date I was supposed to appear? Monday, March 16 (the first day of the pub's busiest week of the year, & the day before St Patrick's Day). I responded electronically, trying to find a gentle way to say "no fucking way" to the appearance date, & desperately hoping for some form of disqualification. Turns out you can "block out" certain dates you are not available online when you complete the e-response. Unfortunately, I appear to be of (relatively) sound mind, can read & write in English, am not a convicted felon & am not under indictment, so I was still qualified to serve. I assumed my week long block would bump me to next month, or maybe even several months out, but sadly this was not the case. My new appearance date? Monday March 23. I called the recorded infoline at 11am as instructed, hoping to hear I would not be needed, but again, not to be. I was instructed to appear at 1:15 to be sworn & empaneled for jury selection in this august edifice. The building is a gem, at least the parts of it that haven't been refit & crammed full of new stuff. It's a 1930 "Moderne" style building, & our courtroom was one of the original high ceiling rooms from the old days. But I get ahead of myself. When I checked in (part of a motley crew of five dozen of what can only be termed the 'teaming masses') with the avuncular bailiff straight out of Central Casting, I was given a number, & a short questionnaire. It included 4-5 questions on...wait for it... HERPES. e.g. "Have you or anyone you know well been treated for herpes?" & "How much do you know about herpes?" & "Do you think you know more/less/about the same about herpes as most normal people?" This gave me some clue about the trial, obviously a civil matter. This could be interesting. At about 1:30 sixty mostly glum conscripts are ushered into the gallery area of the courtroom, seated in rows & handed numbered foam-core paddles bearing juror numbers. We looked like the lamest Sotheby's auction ever. The process is called "Voir Dire" which is apparently a French phrase meaning "your entire afternoon is shot." The wordy Judge explained that we would be questioned by attorneys for the plaintiff, & for the defense, & they would have the opportunity to disqualify jurors peremptorily or for cause. As he was explaining this & I looked around the courtroom for the first time, three things struck me: a guy in the gallery (actually sitting in what would be the jurors chairs during the trial) was a technology executive friend of mine; the plaintiff was a strikingly attractive young woman; oh, & the defendant was a high-tech entrepreneur I knew quite well & with whom I had had a past business relationship. Oh boy. This could be interesting. I resisted the urge to jump up & down & yell "EXCUSED!" & let the process unfold. What are the odds? Had I answered the summons for the 16th, I would have been in another courtroom. On this date, juries were being empaneled in no less than 8 courtrooms. Of all the judicial gin joints in all the courthouses in Travis, I had to walk into the one where I knew the barkeep. I was questioned early, & revealed my association with the defendant & the fact that it might well color my decision making process in this trial. I thought I'd be excused at that point. No such luck. Juror pleas of economic hardship, sexual squeamishness, medical emergency had to be heard first. Four & a half hours later, I had learned that the lovely plaintiff (25 years younger than the defendant) had contracted herpes, that she & the defendant (and for all I know, others) had had an act of consensual sex, & that the plaintiff was claiming that the defendant knew he had herpes at that point, had not disclosed same, & had in fact been the one that infected her. For this she wanted punitive damages of $3.5 million. Yes. And some compensatory damages too. Yes indeed. And some medical/pharmaceutical damages. Yikes. I also learned that the burden of proof on the plaintiff in civil cases is not "beyond reasonable doubt" but rather "based on a preponderance of evidence." Mercifully, after a sidebar conference with the judge & the attorneys confirming my association with the defendant, I was excused, "disqualified for cause," five occasionally interesting hours later. I got to see the start of judicial sausage being made, but I'm glad I didn't have to wait for the finished product on this one. [Author's Note: I learned from a juror who WAS empaneled that the case DID actually go to trial, and was sent to the jury for a verdict, but was settled before a verdict could be rendered. Terms of the settlement were not disclosed.]
