    After coming here more than a 15 times to both observe how court worked and sue a crooked…read moreunlicensed contractor in small claims, I have dealt with probably 12 people in both of the court room and in the clerks office. Overall, I would have to say that the experiences have been very very poor. It seems like very few people had any understanding of what they were doing. First, the day of my small claims case, though I came down and observed the regular magistrate a dozen times in the previous weeks, I had the unfortunate luck of a substitute magistrate. She was in such a hurry to get to other cases done that she came across as scatterbrained and was not focusing on my case when we were in front of her. I clearly explained what I was trying to achieve in a holding a second defendant accountable if the first one did not pay me back. I explained this to her numerous times because she didn't seem to understand. She was so unfocused that she did not clearly instruct me/us that both defendants needed to sign the stipulation in order for me to achieve my goal of holding them both accountable. If it had been the primary magistrate, she probably would have found against the defendants simply because one showed up 30 minutes late and the other one was over an hour late making a circus out of the entire thing from the beginning until the end. We were in the process of finalizing everything when the second defendant came in the door. What we had talked about was that it would be a default judgment against the second defendant if he did not show up. ALL she needed to tell me was that he needed to sign the form as well as the primary defendant. It was a total cluster. In the courthouse both defendants agreed to be responsible. This means we sign a stipulation and they have 30 days to pay me. The second defendant, that was over an hour late, verbally agreed to be responsible if the first defendant did not pay me, but no one ever mentioned that both defendants needed to sign the stipulation. The judge handed us over to the clerk and was no longer paying attention to help verify the things were done correctly. Since I have never been in a court room, and this is small claims court, a person needs a judge that's paying attention. Because the "fill in" magistrate did not do a thorough job, I, the plaintiff, got screwed out of $7500, $8200 If you include all the fees including serving the defendants and the total amount that this guy really owed me. Next, in dealing with the clerks office for many things including filing motions, figuring out how to properly fill out the paperwork, and trying to get an interrogatory sent, out of ALL my visits I think I had two people who were knowledgeable and seem to know what they were doing and 9 or 10 who had no clue and either gave me such general information it was useless, or flat out wrong information. Up to two stars for the couple clerks that did answer questions correctly and knew their jobs. Overall, my advice is that if you have to use the criminal justice system here in Colorado Springs, it is not helpful for small claims plaintiffs looking for assistance on things as simple as how to fill out more than two defendants on a form, much less anything more complicated. I suggest it's worth the extra effort to try to find a lawyer to help you maneuver your way through the system, even if it is a small claims case. The whole thing was a joke and the crook, who has now stolen over $38,000 between four people, and seemed to know how to manipulate the system, wins.
