UPDATE, posted 9/19/18:
I contacted the BBB, who investigated my complaint (Finex already has a F rating with them). Finex never responded to their inquiry. What I ended up doing after Finex ignored the BBB was I sent a letter to the credit reporting agencies with all my documentation. I was able to get the debt removed from my credit report. These people are scammers.
I have had 10 other people message me about this review, who have had the same thing done to them. Go straight to the credit reporting agencies, don't even deal with these scam artists.
Original Review from 2013:
I am writing this review in hopes that business owners will read this and take their business elsewhere. Yes you may have people you want to collect money from, but there deserves to be a certain level of respect.
Here is my story. Noting first off that I am an innocent that is not liable for the debt Finex group wants to collect from me.
I joined the US Army in 2006 leaving a vehicle in the care of my father, he subsequently sold the vehicle properly filling out a "Release of Liability" and submitting it to the CA DMV. I have not resided in CA since 2006. My father moved from the address the vehicle is registered to. Just a few days ago I had my credit checked for an impending move, a debt from Finex popped up (to my surprise). I contacted my father whom I have a strained relationship with and spotty contact with. He looked through his records and found a notification that the car had been towed, he had never told me about this.
I go through my own records, find the release of liability and draft a letter disputing the debt. I on my own fruition contacted Finex, innocent people don't go contacting creditors ok... I give them my information, they keep asking me for my current address (I'm not dumb, and I want to see where this goes before they get any thing from me) I told them my current address was not relevant to the conversation and give them the address the debt should be listed under.
I tell the creditor my story, and I am transferred to the lovely "Toni" who proceeds to treat me like a criminal. I am told that the car was registered in my name, I am liable the "Release of Liability" means nothing. They cannot bother the new owner for money because "that is extortion" he could sue them. Yeah right. If I want the debt to go away, I have to pay it, then find him to sue him for the money what is the difference between me trying to get money from them and me trying to get money from him? I am not a debt collector, that is her job, so why would I try to find someone to collect money from them?
I get off the phone with her, and do my own research. I find the full original of the CA DMV Release of Liability form. Right on the form it states (to paraphrase) "When the information on this form is properly completed and recorded by the DMV, liability for parking and/or traffic violations and civil litigation resulting from the operation of the vehicle after the date of sale becomes the responsibility of the subsequent new owner." Boom there it is I am not liable.
I contacted them again this morning, and get transferred back to the ever defensive accusatory Toni, she is sticking with her story interrupting me as I read this form to her. She cuts me off and I am told "If I want to be like that I need to get an attorney".
So instead of taking information from me for the liable party, fixing the mistake on my credit they decide they are going to attack who is right in front of them.
I will be getting an attorney, and I'd rather pay 2 grand in legal fees than see it go into the hands of this business. They are all around wrong and have messed with the wrong person. I will probably add "Defamation of Character", "emotional distress" and have them pay my legal fees in the case I have against them. read more
