My fiancé and I are currently looking for a home to rent in the Oceanside, CA area. We contacted a Maximum Mortgage & Real Estate, Inc realtor about a property. He stated to us via text that we could visit the current homeowner and view the property that evening. We asked if he would be coming to the viewing. He stated no, he had a work conflict. We both found this to be abnormal for a realtor not to be present.
We visited the home and decided we'd like to rent it, but needed our daughter to see the property first. I then contacted the realtor via email about starting the process. He stated that we need to complete an application prior to him meeting with us to discuss the property. In my 21 years of moving and renting properties, I've never seen a realtor not hold an open house first then collect applications for a property.
We set up another time to view the property with our daughter on Sunday, 14 December 2014, at 9:30 a.m. Again, the realtor stated he was busy with church that morning and could not view the property with us. At this point, we and the homeowner were not sure of the process since the realtor was not involved with our meetings. We suggested to the homeowner they may want to contact the realtor and see if he could provide better assistance. We also suggested the homeowner may want to consider another realtor or conduct the transaction alone with legal assistance. At this time, the homeowner suggested we trade telephone numbers to facilitate the process.
At 1200 pm, Monday, 15 December 2014, I received a phone call from the realtor. He had no idea who he was talking to, what property we'd like to rent, and just seemed very scatter-brained. His conduct was, at the least, unprofessional and he displayed no tact. Later that evening, the realtor spoke to my fiancé about the property. On Monday, at two times, I texted the homeowner about speaking over the telephone so I could ask a few more questions about the property and the rent amount. The homeowner said yes, we could speak later that evening.
At approximately 7:30 pm, I spoke to the home owner and asked a few questions concerning the property, the realtor's involvement, or lack thereof, and the possibility of the rent being lowered from the current price. At approximately 8:05 pm, the realtor called and spoke to my fiancé about the telephone conversation between me and the homeowner. The realtor verbally stated the following to my fiancé: 1) we had no right to directly contact the homeowner even though he set up two meetings with the current homeowner without his presence, 2) we were to have no further contact with the homeowner, even though the homeowner gave us their telephone number, (to the best of my knowledge, the realtor has no legal jurisdiction as to tell who can and can't speak to each other), and 3) made a false accusation that we threatened the current homeowner and their family and had intentions to do possible harm to them.
In regards to the realtor's 3 statements listed above verbally stated to my fiancé, 1) the realtor showed no interest in attending the meetings between the two parties involved, which is unprofessional and unusual for someone committed to finding a solid renter for the homeowner. 2) As stated earlier, it was never made clear, nor do I believe I need the realtor's permission to contact and discuss any aspect of the property with the homeowner, especially when the homeowner gives the possible renters their telephone number on their own free will. 3) The realtor's final comment is a blatant lie and is nothing short of character defamation. My fiancé and I were highly insulted by the realtor and left stunned by the entire incident. This is the worst experience I've ever had with a realtor. read more
