There's a reason why you go onto the Internet and all the reviews combined for Katz Lawyers does not average 2 stars. Hiring them is essentially paying you're guilty plea early, even if you are not guilty why. Seth Katz and his associates practice law by continuing and extending the timeline for the hearing in hopes that the officer doesn't show. This is not how anyone should practice law, and no one needs to go to law school and site for the bar exam to come up with such an outdated tactic. It's not only outdated, it's a violation of the ethics code:an attorney cannot "File a suit, assert a position, conduct a defense, delay a trial, or take other action on behalf of the client when the lawyer knows or when it is obvious that such action would serve merely to harass or maliciously injure another." Katz's boiler plate representation agreement, should not only be closely read, but looked at after reading the NY Bar Association Code of Professional Conduct. Seth is such s Marxist, that he thinks he can draft an engagement agreement that allows him to violate specific violations that are not allowed for attorneys to engage in. An attorney cannot change your plea from guilty to not guilty under the Ethics Code, "the authority to make decisions is EXCLUSIVELY THAT OF THE CLIENT and, if made within the framework of the law, such decisions are binding on the lawyer. As typical examples in civil cases, it is for the client to decide whether to accept a settlement offer or whether to waive the right to plead an affirmative defense. A defense lawyer in a criminal case has the duty to advise the client fully on whether a particular plea to a charge appears to be desirable and as to the prospects of success on appeal, but IT IS FOR THE CLIENT TO DECIDE WHAT PLEAS SHOULD BE ENTERED and whether an appeal should be taken." So, in any instance when Katz or his associates take it upon themselves not to advocate for you and argue on the merits, and carelessly enter a guilty plea, they have violated the code of conduct they are held to. Katz Lawyers, apparently, is unaware that, "In the representation of a client, a lawyer shall not: 1. Where permissible, exercise professional judgment to waive or fail to assert a right or position of the client." Seth Katz, is not available 24/7 as his website claims. He is not renowned nor a leading attorney in his field. Attorneys must respond to their clients calls and emails within a reasonable amount of time- a couple business days, at most. Seth and his associates, do not promptly respond. Seth is unprofessional. I've experienced Seth's appalling behavior firsthand, as well as associates, such as Kate McGauley, who are a horrible representation of the legal profession. If you need legal representation for DUI, DWI, Traffic Citations/Traffic Violations, LOOK AND GO ELSEWHERE. Speak with your attorney and make sure they are aware of your expectations, provide evidence, if it's available to you, and ask the attorney for their professional opinion and proposed strategy. If you want to fight a ticket in court, you'll need a different type of lawyer. This service will only postpone your court dates repeatedly to keep you from amassing too many points at once and eventually plead guilty (which is fine when you're actually guilty). I called Katz Lawyers in Mid-March of 2019 to take care of a traffic violation I received almost two years ago because I was moving across the country. I originally spoke to one of the lawyers (Seth Katz) and he mentioned that they would take my case and take care of everything. I provided my credit card information and they charged me for their services My hearing date with dmv was 4/23/19. Now I'm holding a suspension notice stating that no one showed up to court. I'm trying to call their phone number and all it does is go to an answering machine. No one called me back. I emailed the TVB notice to them and no one has gotten back to me. I will be reporting them to BBB. It's insane how they can just take your money and run. This guy is a piece of ,the lowest of the lowest. I cannot express the discontent I feel towards this individual. When I hired to represent me,he asked to be paid about 400 dollars up front,which I thought was high to begin with but I needed him so I agreed to pay it. He showed up to the first hearing date and postponed the next appearance for a few months later. He failed to appear and they suspended my license. Today I called the DMV and I have to pay a total of 400 dollars for the fine and the reinstatement of my license and this selfish idiot doesn't pickup the phone. I retained Seth Katz, Attorney at Law on July 19, 2019 to represent me on a traffic Violation. He was scheduled to appear for this violation October 30, 2019 at 1:00 P.M. at the DMV Office at17 Battery Place, New York, NY 10004 which he was well aware from erbally telling him and providing him a copy of the appearance document from the DMV when I retained him. In addition, he told me he was able to pull up this information in his office. Subsequently, I received a NOTICE OF IMPENDING DRIVER LICENSE SUSPENSION & REVOCATION letter from The New York State Department of Motor Vehicles dated November 7, 2019 which I received November 14, 2019 informing me that no one had appeared for this scheduled hearing. The letter specifically stated " As authorized by the Vehicle and Traffic Law, your license and/or driving privilege to drive in New York State will be suspended for failure to appear to answer the traffic ticket you received. You must answer immediately to avoid additional fees. If your license is suspended, in addition, to any other fines and surcharges, a $70.00 suspension termination fee will be due even if you are later found not guilty of the charge. I was also informed in this anxiety provoking letter that I may also have to post a $40.00 Bond in order to reschedule the appearance of this violation. I was literally blown out of my chair when I received this letter. Before going to the DMV to prevent my license from being suspended, I called his office on November 14, 2019. Someone always answered the phone when I called. This time that was not the case. I left him a voicemail about this letter and asked that he return my call. I also called him several times theday and the next, as well, leaving more messages about the same matter. He still never returned my calls. However, his answering machine specifically states that all client phone calls are monitored 24 hours per day and calls will be returnedI gave him the opportunity to explain this and when he did not return my calls I went to the DMV paid the $40.00 Bond and rescheduled the ticket myself for July 2020. He had also insisted I pay the $40.00 Bond upfront when I retained him. He finally returned my call days later. I asked him what happened. He became argumentative and belligerent, never even providing me with a reason for his incompetence. I fired him and followed his procedure to terminate the relationship in writing and he would then mail a letter acknowledging the termination between us which he never did, violating his own policy. I had the right to fire him based upon these extenuating circumstances, which are unheard of for an Attorney who has admitted to the NEW YORK STATE BAR ASSOCIATION. This is fraud, it is robbery, it is unethical, cruel, draconian, insane, illogical and extremely unprofessional behavior that I am extremely surprised is allowed by The Grievance Committee of the State of New York is doing nothing about, which is where you file complaints about Attorney misconduct. What I am being told by the Grievance Committee is that they can only investigate Seth Katz, however, they have NOTHING to do with getting your money refunded. I am beside myself and am POWERLESS to do anything and this crook will most likely keep all of my money. What a system this is, huh? In addition, he has experience in fighting traffic violations, at least that is what he sells you and has on his website. The odd part is all he had to do was place a phone call to me before his non appearance or shortly thereafter letting me know what to expect and what I could do to resolve it before it got to this point. He also could have explained what he was going to do about the error, since this happened on October 30, 2019, 2 weeks before I received the suspense letter. He also could have mailed me a letter. He did neither. What type of human being is this. Subsequently, I have discovered 21 bad reviews here on Yelp describing the exact same problems, in the exact same order of events from other unfortunate souls who he has robbed from. Please review them. It also appears that some of them have been removed and a few positive ones added. I would venture to say that he is the one who is probably doing this, although, that is just conjecture. Do your research. I did not. If my license would have been suspended or even revoked which is even worse, my insurance rates would have sky rocketed significantly. If I could not have afforded this insurance increase, I would not have been able to drive my car to work, have been locked in to a 36 month automobile lease and probably lost my job because their is no public transportation to take me there, only by car. I then would have been stuck paying for a car lease and not being able to drive my car. What even worse I would have had to surrender my license plates to the DMV and had my vehicle parked on the street getting tickets. I don't have a driveway for the car. The staff didn't really follow up to my emails or phone calls which did make the process stressful. At the end of the day they took care of business. He wanted me to pay him about 5 minutes into our first ever phone conversation and then when I inquired about meeting at his office to consult with him, he became incredibly indignant and his tone immediately turned hostile. Instead of discussing the matter further with me he cut me off in mid sentence and said "I suggest you find another lawyer" and then hung up on me! All because I didn't want to give him my credit card information right away! Had a terrible experience with Katz Lawyers. They take your money and barely do a thing. Their lawyers go in to court with little to no knowledge of what happened. The only thing they do is post pone the court date. They do not contact you prior to going to court. They do not contact you after to let you know the outcome. I had heard the advertisements for Katz Lawyers on 1010Wins and WCBS880 News Radio in the past. Due to the insane demerit points system in NY State, I always said to myself that if anything did occur in NY State, I would utilize Katz Lawyers. Well, sure enough the day came that I needed to retain Katz Lawyers. I received two silly and ridiculous non-speeding moving violations in Upstate NY. Both of the violations were solely revenue and points generating line items. After receiving the violations, I plead not guilty and called Katz Lawyers. Within 25 minutes of me leaving a voicemail, Seth called me back. I explained the situation to him and he took on my case! At that point, I did not need to do anything. The court Upstate kept moving out my court date. I would receive letters in the mail stating the date was being moved out by 6-8 weeks at times. During this time, the Katz Lawyers were there to represent me. Finally, after the 7th postponement, a court date was set and adjudicated. The Katz Lawyers team was able get both tickets thrown out and I had to pay a non-moving violation fine! This was fantastic to hear and I do not think this result would have occurred with self-representation. So, KUDOS to Katz Lawyers. First off, I just want to say that as a person who has a CDL-A license, I have a lot to lose if I were to get a moving violation and citation while operating a comercial vehicle. I hired this firm based on a recommendation from another lawyer. I got a ticket for cell phone use back in 2014. They told me that the strategy was to get the ticket delayed to avoid suspension of my license. The thing is I am left with the possibility of a huge surcharge by my insurance company for this alleged infraction. The most disappointing thing is that Mr. Katz never told me that plea bargaining is an option in NYC. In fact, my friend told me that he used the ticket clinic and got a "U turn" ticket plead down to a parking violation with no points. This looks to me like a case of malpractice that they a) never told me or never knew & c) if they knew, didn't advocate for that outcome. I wish I had checked the reviews online before paying them a retainer to handle my speeding ticket. This office is running a scam. I spoke directly with the owner Seth Katz who kept postponing my court date and then finally did not show up for my court date which resulted me in having a suspended driver's license. I am out $450 for Katz fee, $70 to reinstate my license as well as having to hire a driver since I was unable to drive my car for 5 days. I went to court for it and they said I would bring it down to have to pay $333 with three points on my license. I didnt want points so I postponed the court date and called up Seth Katz. He went into court for me so that I didn't have to, postponed the court date, and got the ticket reduced to jay walking with 0 points and $210 fine. Yes i had to keep on top of the case monthly and call them, yes i got the answering machine most times but all and all i was happy with the end result. They always called back within an hour or two of my voicemails, i didnt have to appear in hempstead court and wait on that heinous line again , i got no points, and i paid the fine online. Mr Katz explained they show up to a court date and seek to extend it for up to 2 years, which helps the odds of the officer not showing up and the ticket getting dismissed, or at least having prior points fall off. Then he asked for $520 and never mentioned that it is a 50/50 shot (or less). Needless to say, found guilty at first court date, have to now pay tickets and absorb the points. Total cost of about $900 and points. Save the money, you probably have a better shot at begging the judge for mercy, or maybe plea bargaining with prosecutor. If they would have given me an option to rate Katz Lawyers at a (Negative-) start three times over, I would have. HORRIBLE, UNPROFESSIONAL, MONEY HUNGRY lawyers. My husband in a transporter, which means he needs his license to support his family! My husband had his license revoked which was NOT HIS FAULT, due to an accident he had a year prior. What they made sound as an easy win case, was NOT. They were more focused on receiving payment and the amounts of the payment we provided (2 large transactions total amount paid exceeded 5,000) in full. We should not have paid them all up front, but being that we were desperate to have this case resolved we trusted the lawyers. Never called us back when we called, we had to call several times seeking information ahving to leave many many messages with an answering service and a receptionist who according the them, NEVER gave them the messages. Receptionist were rude and unprofessional. When the lawyer finally did call back 3 or 4 weeks later, they had no additional information. Long story short, this went on over a year! They did NOTHING!! My husband got his license back because of all the calls him and I did to Albany, DMV, and courts OURSELVES. Wish I had read these reviews prior to using this firm for my traffic ticket. I called about a ticket I had gotten in February. I received a call back from one of the attorneys at the firm the same day. She went over what the process was and put me at ease. She took my credit card information over the phone and said she would send over the paperwork I needed to fill out later that day. That was the LAST time I ever spoke to an attorney prior to my court date. I filled out everything and sent it over. I didn't hear from them so I called to confirm they had received my paperwork. Now the reason I hired an attorney to handle a low point traffic violation was because they are familiar with the system and defenses that actually work. I realize that my input may not have helped the case at all HOWEVER. As a client I deserved to at least receive a call back from the attorney or even someone from the office after calling four times. I'm a professional as well and when a patient calls me, regardless of what it's for, either myself or someone from my office will return the call. This was never honored despite my multiple attempts to contact the attorney and after being told that I would receive a call back. I have no idea what defense was made on my behalf. After the court date, I didn't receive a call from the attorney or the office letting me know that I had received a guilty verdict(which is the general theme here). I found out after logging on to the traffic violations website myself. When I called the day after, I was told that I had been found guilty and I would receive a letter stating what I had to do. I relayed to the person I was speaking with that I was very dissatisfied with the service that I received. I expressed how I called several times to speak with the attorney prior to the case with no response. The person I was speaking with began to argue with me about dates and times of when I called saying that he has a digital call log! He told me that several of my calls were made after five o clock! Do after hour calls not warrant a call back???? He then identified himself as the owner Seth Katz! I couldn't believe the owner of the firm was arguing with me about dates and times of calls!!!
