They failed to properly handle a subordinate Deed of Trust during closing, leaving us with a massive debt that was supposed to be paid off during the sale. Now, a year and a half after moving on with our lives, we're being told we owe $38,355.88 because they didn't do their job correctly. The mortgage company is threatening legal action against us, while Southwestern Land and Title completely ignores our calls, emails, and attorney communications. They won't even acknowledge their mistake. Our attorney has confirmed that they failed to: - Properly verify all obligations were satisfied during closing - Execute required processes for the transaction - Ensure complete transfer of property free from undisclosed obligations We're now facing potential litigation because of their incompetence. Save yourself the nightmare we're going through and choose a different title company. What should have been a fresh start has turned into a financial disaster because this company failed to perform their basic duties. The particular document in question I was asked (required, obligated, forced, compelled...) to sign declared my agreement, as buyer, to the seller's state of mind and knowledge of circumstances that I have no way of confirming and I would infer to be otherwise. The document also declared that in any event any subsequent dispute between the seller and buyer was NOT a matter of which the title/escrow team had any knowledge. (Again, I infer otherwise, or they wouldn't require me to agree to a signed release.) I am taking all other business in the area to other companies.
