We used Tsong Law for two surrogacy journeys. Our first experience was positive, which is why we…read morechose them again. Unfortunately, our second experience was completely different. Communication with Rainie was frequently difficult and untimely. When our surrogate breached the agreement she drafted, we turned to them for basic guidance about what the contract required and how to proceed with mediation. We were NOT asking Tsong to represent us. Instead of answering our questions, Rainie made an unsolicited and insulting comment saying we could not afford their additional representation. Considering the enormous financial commitment families have already made by the time they reach surrogacy--often including IVF, donor services, agency fees and the surrogacy itself--the insinuation was as absurd as it was inappropriate. Even worse, Tsong did not provide a single referral to anyone who could help. We spent weeks contacting attorneys and repeatedly explaining an incredibly painful situation before finding appropriate representation. Ironically, even firms that could not take our case still provided referrals. We expected attorneys specializing in surrogacy to at least be able to point their clients in the right direction when a matter falls outside their scope. Our surrogacy agency directed us to Tsong when the breach occurred. Rainie later characterized that assistance as services that "exceeded the scope of representation," but we had turned to them for guidance regarding the agreement their own office drafted. This was particularly upsetting. The last issue involved the $3,900 pre-birth-order fee. Tsong's records showed PBO drafting beginning May 8, with payment scheduled from our escrow on June 11--just one day after the 20 weeks referenced in our agreement. Our son died immediately before that date, and we only learned of his death on June 10. We politely asked Tsong to return the fee, but they refused, stating work had already begun. Later, we reviewed their own agreement against our billing documentation and requested the refund again. They then agreed to return the full $3,900. Rainie wrote that we "could have simply asked for a discount or refund without unnecessarily besmirching our team." We HAD already simply asked for the refund. They said no. She also emphasized the additional uncompensated assistance Tsong claimed to have provided and informed us they would never represent us again, but we had already decided MONTHS prior that we would never use them again. Tsong did refund the full $3,900, and I want to fairly acknowledge that. What is so upsetting is how legitimate concerns were ultimately reframed as though WE had somehow become the problem after the death of our son. IPs need responsive legal counsel MOST when something goes wrong. Based on our experience, I cannot recommend Tsong Law to families who want confidence that their attorneys will provide timely guidance--or at LEAST help point them toward appropriate counsel when a surrogacy journey becomes complicated. They should also be able to do this without insulting their clients or making assumptions about them, which is something else I cannot confidently say about our experience with this firm. NOTE: We retained the complete emails, communications, invoices, agreements and documentation supporting the events described above and can substantiate our account if the accuracy of this review is challenged.
