Unfortunately, I let the negative reviews in here influence my decision and hired another attorney instead and it cost us valuable time. What immediately stood out to us was Bornstein Law's transparency. Their terms and fees are clearly listed on their website. That was a big relief after the other attorney was trying to get us to sign with their firm and start an eviction over a small issue (Bornstein Law's fees are more affordable vs the other attorney we talked to). During our consultation, we didn't have to spend a long time explaining every detail of our situation and Attorney Bornstein had already identified the issue and presented several options to resolve our tenant issue. He was direct, practical, and didn't sugarcoat anything. I can see how some people might interpret that as feeling unheard, but in our case, we appreciated his efficiency. He was also considerate enough to recommend options that would cost us less because our matter was not an eviction case. After the call, I realized why some reviews mention communication issues. At the end of our consultation, he accidentally placed us on hold, apparently thinking the call had already ended. Should we be upset about it? Maybe. But compared to finally having a clear path forward for our tenant issue, it felt like a minor mistake. We left the consultation relieved and confident about our next steps.

I opened a yelp account just to write this review. I manage my moms 4 plex in Oakland from LA. We had a dangerous tenant who did not pay rent for six months. I found this law firm on the Internet(mistake 1). I sent a a check/ retainer for $3000 to this firm or they would not talk to me first since I wasn't "local" ( mistake 2). This law firm never had time for me cause as I found out they focus on their landlords who "pay the biggerbills". I did not get a call from Tom or anyone in their office after three weeks after calling about twenty times. Finally my 82 year old mom found an attorney who got rid of the crackhead tenant within 14 days. Four months $4590 in legal bills later I realized I made mistake #3 and the biggest of my life - hiring this law firm. Find a law student go to legal aid before using this so called firm. If I seem angry - I am!!!! Yelp don't let Tom pressure you to take this review off - I heard that's what he does half a day. Let other clients judge for themselves but with open eyes not just reading the reviews he writes. read more

I'm embarrassed to say I used him. I thought he would be more sympathetic to my situation when he had a tenant renting our basement who become a nightmare and basically cost me half a year of my life. What should according to my current lawyer been a 30 day open and close shut case became a 5-month process because Shepperd kept delaying the case because he had "bigger" clients to work with" Do not give this man a retainer!!! you will never get a nickel back even if he just answers the phone which he never does he will keep all $5000 There are so many great lawyers in Oakland - use them. Go to the restaurant across the street from the courts where all the lawyers eat lunch and ask one of them if they know him. Watch their eyes roll, do not go near this man he is an embarrassment to his race - the human race. read more

I don't write many reviews but I could not help myself in the case of Mr Shepherd. Once he received his retainer he became rude and almost unreachable. He kept saying I'm close with all the judges and know every one in the court system. As a small landlord he convinced me that's the way it works in Oakland's opposed to the merit of the case. Thank god I found another law firm after two months of wasting precious money and energy. My new lawyer won the case for me. So I gained one victory and at the same time I learned a lesson for life. Don't pay a retainer if those are the first words that come out of a man's mouth read more

Please find another Attorney. The Shepherd law firm messed up my case not once but twice. Causing my family money and headaches. Our new attorney could not fathom how shoddy the work was that this firm produced. They extended the case three times because Tom had other obligations and did not file pertinent information to the judge. Of course they never forget to bill!! read more

He was not at all neutral and definitely took side. Wouldn't let me get two words out but allowed other side to say everything they wanted to. He then took the threats coming my way to try and get me to sign the agreement that would make false representations about me. Dave yourself and don't use him. Instead go to JAMS and use a real judge with experience. Someone who knows what they are doing. This guy doesn't !

Continuing from first review…read more.. Robert A. Miller made me subpoena a former roommate in order to get her to be a witness. This was unnecessary as her email to me was sufficient. Additionally, there are many instances where Robert A. Miller and David M. Sternberg revealed that they did not examine all of the evidence that I provided. Robert A. Miller kept stressing issues of my pet cat's bodily functions. There was not a single complaint (no email or text, but only something the landlord wanted to add to her retaliatory eviction) of cat urine smell from my two roommates and their partners. I stated that numerous friends of mine have visited and can be witnesses to support that cat urine smell was never an issue. Robert A. Miller responded that the plaintiff Juliet Welch would then call on the other four downstairs tenants as witnesses of cat urine smell. How can downstairs tenants witness what happens in my upstairs apartment when the units are separate and the downstairs tenants and upstairs tenants are not friends and therefore the downstairs tenants are never invited inside the upstairs unit. Moreover, the downstairs tenants have a senior dog and a new puppy, both of whom require puppy pads and potty training. The downstairs tenants also dogsit. There are multiple animals at the 61 Franciscan Way address. A week before my conference court date, Robert A. Miller and David M. Sternberg required an additional $18,000 in order to represent me, essentially abandoning me. At which point, I asked them to stop work. My new counsel reached a settlement of my staying until the end of December (as opposed to October) and $9000 in new money. The attorney fee agreement clearly states that the $5,000 (the one where I gave $10,000) would ensure the case goes to a jury trial. This is a breach of contract, fiduciary duty, and fraud. Neither Robert A. Miller nor David M. Sternberg went over the retainer fee agreement with me. As a matter of fact, David M. Sternberg did not even sign the retainer fee agreement until August 14th, 2019 after receiving the additional $5,000 (where I gave $10,000). I filed a Ca State Bar Mandatory fee dispute in Feb. 2022. Robert A. Miller answered to serve David M. Sternberg who did not agree to be served until November 2022. Robert A. Miller and David M. Sternberg ignored the CA State Bar Mandatory fee dispute so that the statute of limitations would expire. Robert A. Miller and David M. Sternberg responded after I filed small claims because the CA State Bar Dispute was not going anywhere. I called everyday and left messages and CA State Bar only responded once when I received a call back that they will not discipline attorneys for not answering. At the small claims court date, David M. Sternberg twisted the fee dispute to become legal malpractice to claim a one year statute of limitation. I never used the language of legal malpractice in any of my communication with Robert A. Miller and David M. Sternberg. Robert A. Miller and David M. Sternberg set themselves up nicely so that they can claim that any court proceeding waives my rights to pursue a fee dispute with Ca State Bar. Robert A. Miller and David M. Sternberg are unscrupulous lawyers who are greedy and take advantage of vulnerable clients.

I reached out to the Law offices of Robert Miller to see what steps I could take and what to do next since my requests to the landlord are going unanswered. Mr. Miller called me back within 24hrs of me reaching out and was very thorough in explaining what steps I should take before reaching the point of needing to officially engage legal counsel. Legal fees can add up quickly and I appreciated him pointing me in the right direction during our phone consultation. I intend on following his guidance and because of his willingness to help without my retaining him, when the time comes to engage counsel with this matter, I will absolutely be using his services.
