The most despicable group of lawyers, (Trygstadt, Schwab, Trygstadt), misrepresenting themselves as 'Education Lawyers', yet are 'solidly' in bed with LAUSD !!! Lawrence Trygstadt too $10k from me, as the fee for the 'Motion to Dismiss', and when I rebutted this fee to my attorney, Rosemary Ward, who was 'a surrogate for the Trygstadt, Schwab, Trygstadt Law Group', stated to me, "That's what it is !" Then, after a 'gleeful' win at the hearing, a 'STAY' !!! Subsequently, two weeks later, I received a bill from Trygstadt, Schwab, Trygstadt that the 'balance due'...$20,000 !!! I agreed to meet with Lawrence Trygstadt (CEO) to discuss the fees, ($10,000) as previously 'charged', without any 'retainer', w/ Ward and Schwab. In that meeting, I asked, "Where is Richard Schwab?" Trygstadt stated, "He's busy with another case." When I handed Rosemary Ward a statement for her to sign, regarding my $100.00 an hr fee, she literally refused stating, "I'm not signing anything!" The meeting ended, obviously. I subsequently received a 'formal' letter from Trygstadt, Schwab, Trygstadt requesting I dismiss them as Council. I refused, as I had already paid them $10,000, so, '**** YOU' When at the court 'second' hearing, Rosemary Ward, my attorney was not present. Now mind this...Rosemary Ward, who specializes as a 'LAUSD/ Teacher advocate 'Legal Representative', failed to show as my 'only' legal representative. She had represented my legal arguments fighting LAUSD, in excess of $75,000...and now sitting in the 'back-pockets' of Trygstadt, Schwab, Trygstadt...refuses/fails to appear at the most critical stage of the most important 'Constitutional' argument at the Superior Court...actually leaving me to 'HANG OUT TO DRY' with Lawrence Trygstadt to represent me. Without any legal representation, Judge Chalfant, knowing this 'mis-representation' was questionable asked Trygstadt, "Where is Ms. Ward?" Trygstadt responded, "She's ill." When the case was referred back to the Office of Administrative Hearings (OAH), 'to my suprise' Judge Dash (a very fair Judge) 'unseemingly' was removed, and a 'PRO-LAUSD' Judge was now sitting before me...HELLO !!! WHY WAS JUDGE DASHED REMOVED FROM MY CASE ??? Simply because all City Councils pay the Judges, under the table $57,000 yr., as a 'STIPEND'...can you believe it !!! (LAUSD, Police, Fire depts., etc) are all 'protected' by the City Counils in every county in the state, except for Mendiceno, Humboldt, and Marin !!! UNBELEVABLE !!! TO MAKE A LONG STORY SHORT... They have a strong reputation among school district employees about defending their rights and they have battled it out with many large school districts. I appreciated that Daniel and I were able to meet within a few hours of leaving a message. I was an unrepresented director and Daniel knew how to navigate the various public sector HR processes to make sure that my rights were protected at every stage. Daniel listened to my concerns and addressed all of them throughout my case, which really impressed me because other attorneys would discourage me from asking about those things. I hope to inspire others in similar circumstances to not give up their careers and to stop school districts from abusing their powers. Knowing the facts of my own situation, I felt the district investigation would work out for the best and trusted that the process would work in my favor. My "teacher jail" situation proceeded with union representation, which was terribly inept. All of the thousands of dollars I paid in dues were returned with a revolving door of union volunteers that held my hand through the process with no action on my behalf. Nothing came from the procedural meetings with the district, except for stepping closer to an inevitable teacher dismissal. I then sought legal representation outside of the district. I interviewed and consulted with over 20 law firms, all coming to the same conclusion - the work required on their end would not match their potential financial investment. I then tried to take the matter into my own hands, representing myself with the assistance and support of my wife and other housed teachers. This process was exhausting, lasting over a year, resulting in me just wanting to move forward for the sake of my family and mental health. District representatives repeatedly suggested, at my dismissal meetings, that I resign, essentially offering nothing in exchange for a complete exoneration of the school district. I would never be able to hold them accountable for obliterating my career with their misactions, adding yet another blow to my weary optimism. The district is well versed to add insult to injury, wearing most teachers down who are too financially exhausted and besieged to continue to an OAH hearing. Once dismissed, there is no income, state unemployment denied, leaving many to give up at this point. But I chose to escalate my defense and appeal my case to an OAH hearing. And the district scaled up their attorneys - 3 of them at this point. I have to say that an OAH hearing is just like any other trial with loads of paperwork, deadlines, legal vocabulary, and submissions. My spouse and I were in over our heads. As the trial date loomed closer, we realized that we would go down in flames not because my dismissal was merited, but because I lacked legal expertise. I chose to try once more to find an attorney who would listen to the details of my case in hopes of getting the representation I truly deserved, or simply go ahead with the resignation. I made an appointment with Dan Kolodziej, at Trygstad, Schwab & Trygstad. Finally, I encountered a professional with the skill and aptitude to quickly internalize the facts and subtle idiosyncrasies of my case. I left him boxes of paperwork, relevant to my case, to review. I hired this firm to represent me in a case and when I met with the initial lawyer that was covering my case. I was given a retainer agreement of 3,000$ and the lawyer said that would include all costs including flight and transportation fees. I thought it was a fair price and agreed to the terms. Fast forward a month after the case was handled and I got an additional bill for 1,707$!!!!! When I called to speak to the lawyer who handled my case, I found out that she quit and no longer worked for the firm. I spoke to Mr. Trystad in regards to the fees and he said the retainer was only a base fee and anything additional would be charged to me! I stated to him that those were not the terms I agreed to with the initial lawyer, and he said he would send me an itemized statement and the contract. Pretty much tell me I was out of luck! The worst part is that the original lawyer I hired didn't work there so it was pretty hard to prove a case. The work they did for me was minimal....it was a textbook case, and the "hours of research" were bogus because this is the type of law they deal with on a daily basis. May 4, 2016 I am embarrassed to say that I have always been apprehensive about hiring an attorney because of the many negative stereotypes that have been attached to this much needed field.
