To anyone considering applying for social security disability-DO NOT GET AN ATTORNEY!! At least not at first. I worked for social security administration (SSA) doing disability claims for over 10 years. I was a final decision maker and later a quality assurance person overlooking other people's decisions. Here's how the process works: the first time you apply for disability it's your 'initial' claim. You provide SSA with the names/addresses of the doctors who treated you so that SSA can obtain your medical records. You also fill out some forms about your work history and daily activities. Your entire information is summarized by an SSA employee for a doctor to look at. With the doctor's input, the SSA employee makes a final decision. There's no stage in the initial filing process where an attorney is able to become involved and argue on your behalf. Having that attorney makes no difference in the outcome of your case but because you've signed a form having him represent you, if you are allowed and have several months worth of back pay coming to you, that attorney who did absolutely nothing on your case will get a large percentage of that back pay. If you are denied, next step file again and this is your 'reconsideration' claim. It's the same process all over again except policy states a different person has to look at your claim. Once again, having an attorney at this phase will not affect the outcome as there is no stage in this process where an attorney can step in and argue on your behalf. if you are denied at reconsideration, the next step is to file for administrative law judge hearing. That's when you get an attorney, NOT BEFORE. Over the years, I saw many claims where the people were bad off. Either terminal cancer or full-blown AIDS or back surgery that went awry or Lou Gherig's The claimants are completely clueless about how the system works. The first thing they do is go to an attorney. These attorneys know very well these cases will easily be allowed in the first stage and need no attorney involvement whatsoever, but they wont tell you that because they know that when the claim is allowed and paid the attorney gets paid... for doing literally nothing. I remember one case I had for a woman with ovarian cancer had spread to her lungs, a case with a quick and easy allowance. I was about done with her case after having it only a week and she called me to tell me she had got an attorney. Once the form is signed, it's a conflict of interest for me to explain why the attorney won't make a difference. we are also not allowed to discuss decisions on the phone so I couldn't tell her her case was already an allowance. Many times the claimants who had not yet called an attorney would tell me they were considering getting one. in that case it's not conflict of interest to explain not to get one until the ALJ if it gets that far. Something else people need to realize is that SSA is not an adverse party to the claimants. If you happened to apply for disability but didn't thank you had a very strong case and were surprised that an attorney took your case, this is why. If you are denied and they don't get paid they haven't lost any time or money because they didn't do anything in the first place other than the cost of creating a paper file or putting your name in their system. They will take anyone who walks in the door. I have been wanting to share this information for years on social media but as an SSA employee I was afraid to. I left the agency last month. read more
