Situation: Had a tenant for 30 years who frankly used fear and intimidation on my family (landlords) to entrench himself on the property. During that time, he brought an endless stream of homeless people onto the property. The extent of trash was so bad, the health dept put my mother on notice. Basically our home was a way station for the homeless people in the neighborhood to take showers, eat, and have bad drug trips in our public throughways - 24x7 for years. My family never could stand up to this person, because he would immediately become verbally violent with any attempt to being held accountable for descent behavior. My mother passed away and I take over the estate. I got a recommendation from a friend/SF landlord who works with Daniel on occasion with bad tenant situations. Ironically, when I showed the property to a real estate agent for some professional guidance, she saw the homeless situation firsthand. I told her I had hired a lawyer. She asked me, " I don't supposed you hired Daniel Bornstein, did you?" I said yes. She replied, "Good. He is the best." Two completely unrelated people rubber-stamped Daniel. Long story short, this was a very painful experience due to the declaration of war the tenant made in response to the notices and action we asked him to take to correct the situation - right down to death threats. The day we spent in court was where I really witnessed what this man is made of. I am surprised at all the great reviews here. My experience was very different. I guess the office is so busy that they can't handle more business. It was hard to get an appointment--and time can be of the essence when you're a landlord. I finally got Daniel Bornstein on the phone a few months ago, and he said he was busy (in a rude tone) and gave me his email address and told me to put the problem in writing. So I did. Then I didn't hear back, so I emailed 3 more times. Then he ccd Daniel Cheung, who also didn't get back to me. I finally got Daniel Bornstein on the phone one last time, and he was typing so much during our brief conversation that I didn't really get any advice, or additional information. He didn't really take the time to understand the situation (late rent payments). I am not sure he is informed about landlord/tenant law, or how bright he is. He seemed hyper, and couldn't focus. I got an emailed invoice that night for $300. He never told me his fee structure, I never signed an agreement, nor did I get any help, so I wonder what exactly the $300 is for. I would not recommend this firm. I am a master tenant in my rent-controlled apartment and I looked around for a lawyer regarding a subtenant that was wreaking absolute havoc in my place. I just completed an eviction of one of my tenants from my small apartment house in San Francisco. since this building is under rent control ordinance, it's a big deal. especially if you make a deal with the tenants on just a handshake. He helped us with 2 negotiations to take control over our property the last 2 years. 10 minutes with him is equivalent to multiple sessions with other lawyers, and he has a deep understanding of the ever-changing tenant regulations in Oakland. In our initial calls on each issue, he helped us map out the key issues, risks, and questions. He helped us understand the economic value of our options, and the various paths we might use reach a smart buyout with full release of claims. We deeply appreciated his coaching on how to "grow the pie" and create positive interactions (high road). Tactics to facilitate transition (e.g., movers, storage, cleaners) were great recommendations. 1) In our owner-move in process, he handled the initial eviction and then transition to constructive buyout. He spoke with us many days on short notice and responded to our emails within an hour to keep negotiations moving. We appreciated how timely and pointed he was. Let me begin by saying that if there was a way to leave Bornstein Law a zero star review I would do it. When I needed help dealing with a nightmare primarily what they did was add to my trauma through an almost complete lack of communication, incredible degrees of condescension when they did communicate and the continual message that we don't care about you one iota but will cheerfully bill you $400 per hour for the privilege of being ignored and abused. The gory details: Earlier this year I allowed two "friends" to stay with me as they'd fallen on hard times. A few months later when I asked them to leave they refused, assaulted me in my own home, threatened me with firearms and drove me out claiming tenant's rights. And sure enough, turns out that after 30 days in my place if they didn't want to leave I'd have to evict them. And couldn't go back to my place because they'd threatened me with firearms. They eventually ended up changing the locks so I couldn't get in. Needless to say, this turned into a nightmare involving criminal, civil and tenant issues. At this writing I've been living on friend's sofas, driven out of my own home, for four months waiting for this eviction to finally go through. Looks like still another month to go and then who knows what... So I hired Bornstein Law. Unlike other firms Bornstein Law offered no free consultations. Rather it was a $200 up front fee for a 30-minute consultation. Okay, I figured, these guys are good, busy and don't have to give their time away. Fine. I paid the money. A few days later I got on the phone with Daniel Bornstein. He spent exactly 12 minutes with me to tell me: yes, he'd handle the case and please send a $4000 retainer to get started. That'll be $200 please. I was a bit put off that I didn't get more information from Mr. Bornstein about what to expect although I asked several times. He seemed to be in a hurry to get off the phone. That should have been a heads up. Nonetheless, I wanted to get moving and figured this guy is a no nonsense, get things done kind of guy. Again, fine. Once he received my retainer he turned me over to one of his lawyers - Liana Ayrapetyan. For the first six weeks or so it was a matter of filing/sending/and serving paperwork. Straightforward stuff. But even during this period, when I'd reach out to Ms. Ayrapetyan - who knew what a horrendously difficult predicament I was in being basically homeless - it would take multiple days and usually several emails to get any response. And even that was never more than a curt two sentences. Never was I given any context or idea of what to expect. When I did manage to catch her on the phone - only once over months - again it was clear that I was an annoyance and that she couldn't wait to get off the phone. Her entire attitude was cold as ice and utterly uncaring. This attitude never changed during the time I used Bornstein Law. In fact, it only got worse. A few weeks after this I received some threatening legal documents from the "friends" I was in the process of evicting. Not sure what they were about I FedEx'd the documents to Liana and asked her to a) let me know that she'd received them and b) explain what they were about. Simple enough. But neither ever happened. I received no acknowledgment of receipt and only three weeks later when I pressed Ms. Ayrapetyan did she say that essentially it was nothing of import. Why she couldn't take 30 seconds to let me know that after receiving the FedEx as I'd asked is beyond me but speaks to the utter lack of care that Bornstein Law in general Ms. Ayrapetyan in particular demonstrated before my terminating my relationship with them and hiring someone else. Interestingly, though, when I received my invoice they charged me $200 for the supposed 30 minutes it took to review these "insignificant" documents. So they had time to look at them and bill me but couldn't take 30 seconds to shoot me an email and spare me weeks of stress and not knowing. Now that's a lawyer who's got your back. And it gets worse. A few weeks after this I received more threatening legal documents which I again immediately forwarded to both Ms. Ayrapetyan and Mr. Bornstein desperately asking for advice. I followed up with multiple more emails over the course of the coming days as well as multiple urgent, distressed phone calls. NO ONE ever called or emailed me back. Instead what I got was an invoice letting me know that my retainer had been used up and that it's been a pleasure doing business with me. Goodbye! THIS IN THE MIDDLE OF MAJOR LEGAL DRAMAS THAT I DESPERATELY NEEDED HELP WITH. THEY SIMPLY CUT OFF ALL COMMUNICATIONS. Even when I called to see about replenishing the retainer they simply refused to talk to me. Only a week later, after an irate phone call to Mr. Bornstein, did I get a call from him.
