Can't seem to get the lawyer representing my husband to call back or go in to talk to him. He admitted during the last court date that, yes he got the discovery, but hasn't had a chance to review it. Just scrolled and thumbed through it in front of my husband and gave no defense other than he's a father to 2 autistic boys and is a major part of their life. Didn't defend him at all. Have court on 22nd. If he doesn't have a defense built and is ready, or says oh I haven't had time to review it yet I'm calling the state bar and explaining we are being miss represented. They are now claiming there's a new / now 2 victims. There's always been 2 since before we hired them. I have the original discovery from before we hired them and it plainly states 2 not 1. After reading quite a few other reviews about this law office and hearing mixed opinions from people, it's clear that not everyone's experience is the same. Just like outcomes in a court, there isn't any two situations that are the same. It seems to me that people base their reviews on the outcome of their court cases, which is the wrong way to go about it in my opinion. Your attorney, no matter how good they are or how much they know the DA or the judge, cannot control the ultimate decision of a jury or a judge, and to blast your attorney because of that is wrong and just stupid. I unfortunately have needed representation for some false charges brought upon me by some shady officers and have been working with Glen Sandler since the beginning and I have been more than happy with every decision and action he has done. Glen is an absolute beast of an attorney, he knows the system, he knows the DA's and the judges, and can almost predict how each one is going to think. He has kept me informed every step of the way, assuring me an outcome I was hoping for. It's kinda tough to review a law firm because each client has wildly varying cases with factors that can affect the service one receives. Well my situation was a total cluster*uck. I was looking at felony charges with serious jail time. I retained Earl Carter initially out of desperation and because they were located close to the courthouse. When I was assigned Sean Davitt, I immediately appreciated his candor and non-nonsense approach as well as his sense of humor. He was definitely a straight shooter. However, I became anxious when I saw how busy he was juggling multiple cases, including mine, in the Riverside Court. I told him that I had hopes of getting my charges reduced to misdemeanor and avoiding any jail time. For the facts of my case, I knew this was a long shot but I wanted to see what Mr. Davitt could do. After pretrial negotiations, Davitt came back with two offers. The DA gave a joke of an offer of no jail time as long as I accept the felony conviction, meaning I would not be able to get any decent jobs afterwards and I would have to surrender my arsenal of guns. This was not acceptable. Davitt then told me about the judges' offer of misdemeanor reduction but with 28 days jail and 64 days community service. Of course Davitt advised me to take the judges' offer because it was much more beneficial in the long run to not have a felony record. So I took that offer, hoping that I would be kicked out of jail early due to the massive overcrowding in the jails due to the federal realignment mandates. Here's where Davitt was genius. He didn't tell me that there was a good chance of my early release from county jail until after I signed the conviction forms. He didn't want me to get my hopes up because there was still a small chance I could serve the whole jail sentence. So I prepared for the worse, but in the end I only served 4 days out of my 28 days. Next Davitt secured me house arrest instead of the initial order for community service. After I enrolled in LCA for electronic monitoring, Davitt told my case manager that I should be qualified for 4019 credit, meaning that my 64 day sentence should be cut down in half, getting two days credit for each day served under house arrest. So long story short, don't believe those reviews that claim Earl Carter & Associates are a bad firm simply because those reviewers had a bad outcome in their case. I had reasonable expectations and I knew the limitations for what ANY private lawyer could do for the facts of my case. This is the key, you can't expect miracles, but Earl Carter, and Sean Davitt in particular, did more than what I hoped for so I definitely consider it money well spent. Speaking from experience, county jail is not that bad as long as you're lucky enough not to be stuck with some crazy psychopaths. But the true horror of jail that NOBODY ever talks about is the 24-48 holding period of pure hell you have to endure while they look for an empty jail cell to put you in. Being stuck in a tiny 9x10' cell with 14 other recent convicts is truly inhumane! People were sleeping on the dirty floor or under benches or toilet trying to get some shut eye from the bright 24/7 lights. It's basically torture through sleep deprivation. If you get Sean Davitt assigned to your case, make sure to point out his picture from the website! read more

Public Defender screwed me , their deal was 4 with 80 or trial max if I loose. Public Defender apologized for screwing up my case and told me there's only on guy that can help you his name is Sean Davitt. I hired him over the phone and a year later he got me probation. I was on state parole and on bail because my po lifted my hold. Those of you that have been up state know you don't get probation once you have been up state. I would hire Sean again in a heartbeat! At first when I went in for my initial consultation for a DUI charge in 2017 the man I spoke with (I don't remember his name) was very professional and I felt very confident in my choice. Until I was also on the phone during the DMV hearing and the Lawyer was fumbling through his words and just accepted what they said without rebuttal at all. He just said "ok" and moved on. We obviously didn't win that DMV hearing. Then when it came to the actual trial, my lawyer kept postponing it which I didn't quite understand and it took almost a year of just rescheduling to get an end result. Then once everything was said and done, I was called into the office for my case verdict. Mr. Devitt actually said "Well your blood alcohol was a .10 so there wasn't much I could do." Umm . . . That's your job and what I paid you for. I felt like they didn't even try to fight for me. Yes they are reasonably priced and take payments but find someone better, the judgement and fines would have been the same if I just pled guilty and represented myself, at then I'd still have $1500 in my pocket. Attorney that represented me was Miguel A. Tovar, he looked at the facts of the case and saw how the police officers used excessive force and falsely arresting me for not answering their questions. We took it to jury trial and both police officers testified, long story short did not look good for me but Miguel was on point and got the officers to contradict themselves, he put on an awesome and vigorous case and sealed the deal on closing arguments and in the end jury came back with a not guilty verdict. Horrible, Mr. Davit promised me that he spoke to DA and I had a guaranteed deal. I complied with everything the DA asked for. It took 2 years of my time with this joke of a law firm. On my last court date, Mr. Carter was there. I didn't get the deal I agreed upon. I said no deal. He went back in and came back out of the courtroom. He said the DA wont budge. It was a new DA on the case. And if it were up to her.... she wouldn't even entertain any part of the deal that was offered. Mr. Carter was rude to me after I didn't want the deal. He is a crappier lawyer than a public defender. I didn't pay him to just take a bogus deal.... I paid him to fight for me. It was not the case. Before the court session started..... he was all smiles and joking around with the DA. What a QUACK!!! I wasted my time and hard earned American currency on this bogus of a Law Firm. Last May 2014 I retained the services of Earl Carter at the Rancho Cucamonga Superior Courthouse. Miguel was the attorney assigned to my case. I was facing three years in state prison for 2nd degree commercial burglary. Due to his working relationship with the DA and judge, Miguel was able to get my arrest warrant recalled and I was released on my own recognizance. We spent $5,000 with this Attorney's office and probably would have done better having a public defender. My husband was in county jail for 13 months before he got sentenced and only got ONE visit from his lawyer! I was unhappy with the customer service this office had given me. Had filed for bankruptcy that was discharged but one of the creditors issued a lien on our property. When I called this office to seek their help, I was told that they no longer do bankruptcy and was told to find another attorney to represent me even though the attorney still works in the same office. I put my trust on them thinking I was represented well but it so happened that it was lack of knowledge on their part for not filing a motion to counteract the creditor from issuing a lien. To make matters worse, they don t call you back after leaving a message nor answer your emails. All I needed is an order to avoid lien, not to be neglected or be given the run around. Even if the office had major change in the services they provided, I was still a customer they had dealt with prior to the change. This company doesn't live up to their statement for more than 30 years of experience. Not a way to treat a customer. read more

This is a great law firm. I had a lawyer to represent me 3 years ago or so. Someone thought it was ok for them to mess with the legal system and lie to falsely accuse of putting my hands on them. When I went to court the first time I had no idea what I was doing. So to let time go by I decided to take matters into my own hands and fix the mess that I landed myself in the first round. I went to the down town area to look for a reliable and well experienced law firm. I came across this company they introduced me to a wonderful lady at the time who was working with this company. I explained everything to her. She and I would keep into touch on a daily basis, and reassure me that everything will be ok for me. The day of my court hearing I was so worried to even attend because my thought process was how will the judge understand I was falsely accused for something I never did the first time around. The first judge just went off the other persons lies and same with the police when they came out to the scene. They had no legit proof. At least when I had my lawyer to represent me this last time around the judge made sure to ask for legit proof not basis it off as a he said she said outcome. At the end he favored me and lifted the order in my favor because he can see I was innocent to begin with. No one wants to deal with a pathological sociopath psycho. Not even the judge did read more

TERRIBLE: Wow, please don't do business with this firm. I recently was charged with a DUI, and was completely devastated. I didn't know what to do. I called about 5 firms getting the information i needed. Apparently there is a suspension process separate from the court system and run by the DMV. This hearing is to see if there is reason to suspend the persons' license. I retained the Carter law firm, and in the advertising it stated that all aspects of the DUI will be taken care of, including all sides of the DUI. I started to relax having paid a lawyer to take care of my court issues. Lo and behold, I get a letter in the mail from the DMV stating that my license was suspended. I call up the DMV to get the results of the hearing, and they (Mary from the driver safety office) told me that the hearing was canceled by my firm. What the heezy? I finally got through to the firm, and they dont have a straight answer. About three months of trying, it actually took so long that my license was reinstated, and I still didn't have a coherent answer. That is just the DMV part of the problem. When you pay this firm the advertised price, it does not mean that they will do anything for you in court. My plea bargain had the same restrictions as people who didn't have lawyers, and when I said that I would like to go to trial, my lawyer said to my face, "You haven't paid us to do that." Their San Jose office is on the third floor of a shitty building, and when they send out letters to their customers, they lick the back of the envelope and make sure it sticks to the documents. My husband is fighting a bogus DUI charge. My husband was driving to Home Depot at night to pick up some extra supplies for his job the next day. A lady called 911 she said he swerved and was drunk. He swerved because he was tired not drunk. He then went back to his hotel pounded drinks with his coworkers, he went outside without keys mind you as he was reaching into his car through his window to grab his cigarettes an officer asked if that was his truck he said yes and the officer arrested him, he didnt read my husband his rights but hey Earl Carter and Associates could care less about any of this. No one from this office ever called us or returned our calls. We were always told by a receptionist that the attorney was not in then when we would finally call and would be transferred to someone it was almost always an unlicensed assistant. The ONLY thing this office did was win my husbands DMV case then request extensions for 1 year in court now my husband has been assigned a court appointed attorney. Dont waste your time or money with this office they are extremely unprofessional they wont do anything for you and then will tell you if you want us to continue we want 4300.00 more, what the hell no you havent done anything to prove you are worth it.
