I had a very unique case attacking the constitutionality of my traffic stop. In short, I was pulled over for weaving and speeding. Thankfully I had a dashcam in my own vehicle because the police MVARS was very grainy and my own personal dash cam (which reads and overlays the speed directly on the video recorded as well as 360 degree views of the road and cabin of the vehicle) was pivotal to righting this injustice and I don't think I could have done it without Chris and Toby on my side. After exhausting all legal remedies available to me and loosing my DMV hearing, despite a strong presentation of evidence (including a subpoena to the officer that failed to fully comply with the subpoena and produce calibration records for his own vehicles speedometer) that should have tipped the scales in my favor, the Van Nuys DMV Hearing Officer N. Gernade still ruled against me suspending my driving privilege's and license for a period of 4 months as well as additional requirements imposed by the DMV. I decided to then file a Petition for Writ of Mandate in the Superior Court asking for an Order to the DMV to SET ASIDE this illegitimate and unjust suspension. Initially I was self-represented and I drafted my initial petition and an ex parte motion. As my hearing date began to approach, I spoke with Chris and his team and decided it was in my best interest to hire a professional to take over the case. This was the best decision possible as I doubt I would've been able to present this case as perfectly as he and his team did! In my Writ, the judge's Tentative Ruling was in my favor beating not just the weaving issue, but also the speeding issue citing various case law precedents and using your plain naked eyes to see for yourself that it was impossible for me to be speeding or weaving at a rate or level of significance for the officer to have ever come into contact with me to begin with. This ruling not only allowed me to win my Petition and have the DMV overturn their order retroactively (cleaning my record), but also meant my entire traffic stop was an unconstitutional violation of my 4th Amendment Rights and all evidence received thereafter couldn't be used. Although the Judge disagreed that the hearing officer acted in an arbitrary and capricious manner and denied attorney fee recovery pursuant to Government Code §800, we were allowed to file a motion for costs to be recovered that was granted! I am very pleased with the outcome of this case and if I ever have any further issues or know of any, I will definitely refer them to Chris and I highly recommend anyone to hire him.
