When I was arrested by the police for the first time in my life as a 30 year old minority male, I was arrested within 30-45 seconds of an "investigation" and was taken to the precinct and endured an excruciating experience with my arresting officer. Immediately after being released from my arrest I inquired, emailed, and called various DUI/Criminal lawyers and contacted David O. We spoke over the phone in the evening and scheduled a time to meet where he learned about my encounter and testimony leading up to the arrest. I left him a great review on other sites. But much time has past and I have to say, as a lawyer, and thinking back on my case, even I, a civilian I feel would have done a better job. He does understand law but back in 2010 he didn't seem to fully know DUI. Told me he normally takes cases about workplaces. But we felt confident going forward with him. We went through the ENTIRE case, took multiple days and it was very exhausting like all of this normally is. The judge threw things out from the police as they didn't their due diligence with my arrest and something were sketch. So I was relieved to find that out. However, the county clerk in the office there turned over documents to the jury they were not suppose to (inner working of the cops, as when that cop took that stand it was 2 years after the fact and he said he didn't know to most questions asked)... they threw out my case because of that turning over of documents that shouldn't have been. Right then, David should have stepped up and told them no, we will proceed with this and we want to explain to the jury why these documents were thrown out. However, he decided to go with what the court suggested. Another year or so goes by and we have to redo this all over again (and again, as a lawyer I would have expected him to understand the outcome of the upcoming trial). We redo this trial and LOW and BEHOLD the cop remembers EVERYTHING! A year plus ago he couldn't remember jack. So he straight up lied to court under oath. David did nothing to correct or point this out, and we proceeded with a cop who sat there and seemed to remember all the details when a year plus ago he didn't. I was found guilty, because well this is me against a cop. Crushed by this, tears couldn't stop rolling down my face and David promised he would visit me in jail, which he did. However, this all could have easily been avoided had he done his due diligence and we proceeded with that first trial. He also asked if I would like to work for him, but literally the crush of defeat. The playing of BOTH trials running through your head daily, wondering how a cop could sit on stand saying idk to all questions, but years later remembers? And on top of that remembers something much further on down the line. I should have paid top dollar for someone, but seeing as how we felt we could really trust him to do his job, and try his hardest to protect me and the money put forward. It was a waste and I should have just stood trial myself. I felt I would have had a better chance esp with all the pluses I got from the first trial that everyone just let go by the way side. Good person in general, but not a good lawyer for DUI cases I feel. Go with someone that will likely help you get out of a situation that I feel I could have easily avoided doing time for. Esp when the arresting officer does so much wrong, cannot remember, but miraculously remembers more of years later. I have to force myself to stop remembering this because I am just killing myself over this. And the constant thought on how this all could have gone and the things I saw up front and in my face was just unbelievable. But what cop doesn't want his arrest to go thru? Clearly it's worth it to lie under oat :: reply to David:: No one is tarnishing your reputation here. I'm sure that after my trial and my conviction your still doing DUI cases and you have likely learned from my trial as I would hope. Learning and growing into something better is not terrible. This is not an attack, just that as I already knew the outcome of that second trial, so should have you. However, live and learn. Which I hope you as well as I have been able to do. Like I said thinking over and over on this is only killing me. So learn, and move on. I am sure my experience has only made you a better lawyer, and if you have to go thru a trial like I did again, you should outright know the outcome and how the cop will be trained to answers questions when asked. So I hope you learned too. It's called truth, I'm sorry you feel this is tarnishing, but I did meet with many other lawyers and you were not the only one I interviewed, if you think none of them wanted to go to trial then you also have much to learn about your competition. I would avoid him at any cost. I went to David for my DUI first offense(0.09). He was very nice and attentive during the initial stages of case and gave lot of emotional support. I also felt that he is very knowledgeable and knows his stuff. David promised me that the charges would be lowered to reckless driving. He used to remind me about my court dates and was very responsible initially. But once I finished paying off my installments, everything changed suddenly. The DUI negotiation suddenly transformed into a plead guilty case. I was left with no option other than pleading guilty. The public prosecutor once said that he forget to fax her the case documents while negotiating the case. I feel that he never spent enough time with the prosecutor and that is the reason why i lost my case. I am not writing this review because i lost. I do not think that attorneys are magicians who can deliver things that are promised. But I would expect them to be honest and realistic throughout, which is clearly not the case with David. Initially, I called another law firm where I was only able to speak to a receptionist who was very inconsistent about returning calls, and kept changing the cost of legal fees. Needless to say I did not trust nor want to hire a lawyer I didn't even get to speak with. After that, I reached out to David over the phone a few days before my arraignment hearing for a DUI and a minor in possession charges. Even though my arraignment was on a Saturday, David assured me he would be able to get someone there. Throughout my case I worked with both David and Tim. they were both great and listened to me and answered all of my questions. He was also very flexible with payments. In the end he was able to get my DUI dismissed if I plead to a deferred MIP. But, it's possible he could have had it dismissed had I not admitted to drinking upon arrest. I am re-posting my wife's review as it was removed due to being "second hand." I have adjusted and added to the info to put it in my words. Would not recommend. One star provided because (whether by correlation or causation) upon receipt of my last payment, the partner assigned to my case (Annie) began to ignore emails and phone calls requesting information regarding my case and work on my behalf. I have many emails and texts that went completely unanswered. In one instance, she had David step in to represent me in court and David was unfamiliar with my case. Literally minutes before pleading guilty (after sitting in court with David for 4 hours) he looked at my paperwork and said "wait that's your BAC? We're going to get a continuance again and I'll let you know how it's going in a week." A month later I hadn't heard a thing until I was in court again after multiple requests of asking if anything had happened yet. And for that court appearance and the next one another month later I find that David hadn't even met with the person he said he would 7 weeks earlier. Then since we obviously showed our hand with a torn up guilty plea 2 months prior the prosecution wouldn't budge. David was just representing me because he was going to be in court anyway for another client and me pleading guilty wasn't a big dealt to them. It seemed like David had hardly seen my case at all before that day. After a year of limited support and continuance after continuance, we may have been better off just pleading guilty at the outset due to the legal fees and multiple days of lost wages. Update: Upon reading this review, Annie called me discuss. A little too late to show interest and concern now that the case has been settled.
