Continuing from first review…read more.. Robert A. Miller made me subpoena a former roommate in order to get her to be a witness. This was unnecessary as her email to me was sufficient. Additionally, there are many instances where Robert A. Miller and David M. Sternberg revealed that they did not examine all of the evidence that I provided. Robert A. Miller kept stressing issues of my pet cat's bodily functions. There was not a single complaint (no email or text, but only something the landlord wanted to add to her retaliatory eviction) of cat urine smell from my two roommates and their partners. I stated that numerous friends of mine have visited and can be witnesses to support that cat urine smell was never an issue. Robert A. Miller responded that the plaintiff Juliet Welch would then call on the other four downstairs tenants as witnesses of cat urine smell. How can downstairs tenants witness what happens in my upstairs apartment when the units are separate and the downstairs tenants and upstairs tenants are not friends and therefore the downstairs tenants are never invited inside the upstairs unit. Moreover, the downstairs tenants have a senior dog and a new puppy, both of whom require puppy pads and potty training. The downstairs tenants also dogsit. There are multiple animals at the 61 Franciscan Way address. A week before my conference court date, Robert A. Miller and David M. Sternberg required an additional $18,000 in order to represent me, essentially abandoning me. At which point, I asked them to stop work. My new counsel reached a settlement of my staying until the end of December (as opposed to October) and $9000 in new money. The attorney fee agreement clearly states that the $5,000 (the one where I gave $10,000) would ensure the case goes to a jury trial. This is a breach of contract, fiduciary duty, and fraud. Neither Robert A. Miller nor David M. Sternberg went over the retainer fee agreement with me. As a matter of fact, David M. Sternberg did not even sign the retainer fee agreement until August 14th, 2019 after receiving the additional $5,000 (where I gave $10,000). I filed a Ca State Bar Mandatory fee dispute in Feb. 2022. Robert A. Miller answered to serve David M. Sternberg who did not agree to be served until November 2022. Robert A. Miller and David M. Sternberg ignored the CA State Bar Mandatory fee dispute so that the statute of limitations would expire. Robert A. Miller and David M. Sternberg responded after I filed small claims because the CA State Bar Dispute was not going anywhere. I called everyday and left messages and CA State Bar only responded once when I received a call back that they will not discipline attorneys for not answering. At the small claims court date, David M. Sternberg twisted the fee dispute to become legal malpractice to claim a one year statute of limitation. I never used the language of legal malpractice in any of my communication with Robert A. Miller and David M. Sternberg. Robert A. Miller and David M. Sternberg set themselves up nicely so that they can claim that any court proceeding waives my rights to pursue a fee dispute with Ca State Bar. Robert A. Miller and David M. Sternberg are unscrupulous lawyers who are greedy and take advantage of vulnerable clients.

I reached out to the Law offices of Robert Miller to see what steps I could take and what to do next since my requests to the landlord are going unanswered. Mr. Miller called me back within 24hrs of me reaching out and was very thorough in explaining what steps I should take before reaching the point of needing to officially engage legal counsel. Legal fees can add up quickly and I appreciated him pointing me in the right direction during our phone consultation. I intend on following his guidance and because of his willingness to help without my retaining him, when the time comes to engage counsel with this matter, I will absolutely be using his services. Thank you Robert!

I retained Thomas, who at every stage made me feel like family. He not only helped guide me through the legal process but also provided encouragement and guidance that helped me regain the strength to pick myself up, dust myself off, and keep moving forward on the right path. It took a number of months of work. Thomas suggested a good number of activities to help my case and that allowed me to grow as a person. I found Thomas to be honest, extremely knowledgeable, caring and responsive and a straight shooter toward me and others. The results were truly a blessing. The DUI charges were dismissed! I am a nurse and I thought that would be the end of my life and my career. It was the darkest time in my life that I lost trust in the system and humans. During this time, I found and retained attorney Thomas Fleming. He assured me everything would be ok. Throughout the legal process, Thomas guided me every step, recommending a number of activities that are good for my case, and also helped me grow as a person. Thomas then used these activities and my growth in court as one of many reasons why the court should give me a second chance despite any mistakes I may have made. Thomas then asked the judge to divert and dismiss my case. The prosecutor strongly objected to this. But, amazingly, the judge believed and agreed with Thomas, and granted his request to divert and dismiss my case. Amazing but true, the court dismissed my case at his request! Thomas then filed a motion to seal any record of my arrest, the court granted as well! Thomas has a lot of faith. I found him to be a smart, trustworthy, honest, professional, compassionate and genuinely cared for me as a person. He got to know me and my family as well. He always wanted the best for me, it showed in the result. God bless Thomas!

I'd highly recommend avoiding this firm. Please read below and anything I said below can be…read moreverified or is a statement of opinion. Joe Wolch and Kate Mignani my message for you, don't ever forget how a 30 year old respondent with no law experience and a $20 a month ChatGPT subscription outsmarted and beat your entire firm in court. Law School 101: It's not what you know, what you feel or think, it's what you can prove in court Joe. (I did also have an attorney but most of my preparation was done with AI). Big thanks to Joe Wolch and Kathryn Mignani for representing my ex in both our divorce and a restraining order case. In my opinion, it lacked evidentiary support and may have been tactically motivated, as I've come to learn is not uncommon in Family Law cases for leverage in negotiating. For a marriage that lasted just six months with roughly around $5,000 in total community property, no kids, no houses, they still managed to rack up over $57,220 in legal fees on her side. This review is legitimate and follows Yelps TOS as it deals with my experience with them being the OC in this case. Their client (my ex) was ultimately found not credible and impeached multiple times in court, leading Honorable Judge Wendy Coates to dismiss the TRO completely. And at the end of the divorce case, she had to write me a equalizing check for property division.... Kathryn Mignani specifically was the attorney that questioned me when I was on the stand testifying. During my testimony, I observed Kate Mignani struggling with basic questioning and often stuttering over her words, and seemingly not able to respond with how I was answering the questioning. From my perspective, she seemed unprepared to challenge testimony that I had carefully and anticipated for months. I studied for hours on how to properly answer these questions and Mignani didn't grasp I was able to circumvent what she was wanting me to say. In my opinion, this demonstrated a lack of competence in trial advocacy. My attorney and I were expecting at least a little more in-depth questioning but got nothing of substance. I have no formal legal training, so I actually used AI and large language models to simulate potential cross-examination questions from Wolch, Mignani, and their paralegal (I believe her name is Kate Gums). I fed the system our prior correspondences and noted their behavioral patterns in how they reacted to documents my attorney, Aaron, and I would submit. This helped me prepare extensively for what I anticipated would be a much more thorough line of questioning. The AI was actually more in-depth and subjectively speaking, harder to answer than Mignani herself. In my personal opinion, it was fairly obvious from the start that this wasn't truly a domestic violence case, but rather an attempt to manage my ex's public image. Now I don't know whether or not Wolch's team advised my ex this claim had no foundation, but one can only hope they did. Looking back, I'm surprised Wolch's firm chose to proceed. But seeing the attorney's fees disclosure each party exchanged, showing around $57,220 plus several days of trial that hadn't been billed yet, it now puts the situation into a clearer perspective. I left the courtroom genuinely surprised that someone this terrible in trial advocacy could be in active legal practice. Joe Wolch, who I assume owns the firm and I'd assume is responsible for approving this case and continuing it to depths of ridiculousness, continued to pursue the matter despite the absence of any credible evidence indicating wrongdoing on my part. This resulted in an unwarranted challenge and attempt to ruin my reputation and professional standing. I understand not every attorney shines in litigation, but in my perspective, this felt more like someone winging it than advocating effectively. Kate Mignani was absolutely terrible at questioning me up on the stand and I'd highly advise contacting me if you want to see the transcripts of how awful she was during the trial. If anyone is interested in reviewing the partially redacted public transcript or the case itself, feel free to reach out, everything was said on the record and is available for verification. Thank you again, Joe and Kate, for representing my ex throughout both our brief marriage and a lengthy restraining order dispute. Despite a marriage that lasted just over six months with limited community property and no children, legal fees on her side exceeded $57,220. In my opinion, the TRO lacked evidentiary support and appeared strategically motivated. Ultimately, Honorable Judge Wendy Coates dismissed the restraining order after finding my ex's testimony not credible and specifically noting that certain claims were impeached by video and witness evidence. It turns out the court sided with actual evidence over uncorroborated allegations. I never had any doubt I'd win.
