I tried to help a tenant by referring them to the Eviction Defense Center. It did not go well. They were rude, unhelpful to me and unhelpful to the elder I was trying to get help for. They are clearly overworked. In this case they could not see clear enough to work with a cooperative property manager, and thus their involvement hurt and did not help anyone. read more

They are paper pusher's period, few staff attorneys but realistically EDE are over their head with cases that they cannot resolved but better, yet they will resort to submitting paperwork that they can't even defend just to put you on their roster so they can get more funding to put more black and brown tenants on the streets!!! As person with video, documentation and pictures, police report they are terrible instead of facing the Judge and advising they (EDC) could not argue the very defenses they put on a Answer they leave the client holding the bag, after 6 months they decide to approach me at court to inform me they could not dispute the facts and they were sorry, please contact a lawyer this GUY who handed me the fake settlement I asked what are my option he STRUGGED his shoulders, with no advice, what type of LEGAL Representative do that? Then went on to mention the landlord knows they are at fault, but this was the best they could do. NOPE what about my day in court, to provide my evidence that you are all so cowardly to do, so EDC drop the ball. You are a number on a excel spreadsheet, so they (EDC) can turn that information into whomever providing them funding for the poor legal service that they provide. For the funder a settlement listed would appear to be a win and give the appearance as if they are actually providing tenants with good legal service, but if they look deeper into the actual facts behind that settlement it is very much questionable. Please look for other resources, if you attend court session you will understand, they have you lined up in the court hallways like cattle waiting, no privacy, please look for another resource, they are other agencies these folks are in it for the dollar, the more completion of grants you have, you're in the money. You get what you paid, since I was referred by a city or county to contact these folks and they are flipping the bill, you get nothing, because you paid nothing, instead trusted the system. Unfortunately, its agencies like these that are now going to have to open those accounting books and show and prove how they are assisting, since money is tight and people or funders are watching how and where they put their money and who it is actually helping or if it is a money pit. They're not litigators folks. I had the defense attorney tell me she thinks they (EDC) do a great job for their clients, and they work with them a lot. They got me an agreement of a 90 day stay while I was trying to obtain help on my own while having no resources to move on my own nor did I have any assistance too. I know that the EDC can only provide legal services. I know what they're here for, but I clearly told them that several times while during this case - I'm having trouble moving out on my own it is not that I want to stay in this unit is that that I cannot physically move out of my own! I feel that the agreement that was created by the lawyer who finished the case with the opposing party of my Landlord. Created an agreement where I knew that I could not achieve because of the circumstances, I was going through the medical legal system of state insurance and the social network of Northern California for disabled services and waiting for said Services. I basically said that I was looking to retain move out services. I didn't even want to stay in this apartment. It was a fact that I had "no physical way " of moving out. I didn't expect EDC to do that for me, but at least to help me retain some type of service where I could start moving out my things I told them that 90 days wasn't a lot of time to go through state resources Oakland resources for relocation for homeless to disadvantage individuals. It wasn't ! It's been quite some issues going on in Oakland, where I believe the FBI is now having to investigate certain departments. I guess I have to go back to court. I felt I was coerced into signing the agreement , prior to that the legal help I was getting was good - till the lawyer that did my agreement at court, I didn't understand why the person that was doing my case switched out with another lawyer, nor was it told to me . I still don't know the person represented me. They never told me their name. I called over the phone to inquire about it. did they ever tell me their name. Tall, brunette Caucasian so say hi 2 him . Now I'm having to have my social workers and other organizations contact Rob Bonta about the issues I myself or them as organizations has faced during the pandemic/medi-Cal/and the eviction process under the scope of pandemic issues and protections. I was given a 90 day stay but I'm disabled and having to look for resources with no family, no friends and alone. While trying to obtain medical assistance was extremely hard. EDC was a help in the beginning but the lawyer who ended my case I felt was not truthful I also remember that he said to me look at who's in the courthouse "The people that are being evicted are mainly brown & Black people" which stuck to me because I thought that was an inappropriate thing to say, but true from a Caucasian lawyer. The judge that wasn't even on my case & him trying to get me the sign in agreement for 90 day stay which I know I probably couldn't follow through with no service. The lack of the service I was getting through Medi-cal and Social Services. I was told that I could possibly potentially stay until the another month if I was still having trouble when I called on the last month to inquire about those services, the lawyer who finalize my case wouldn't even call me back I had to reach out several times on the day of my move out After calling there, He told me, he never even said anything like that. So this lawyer just basically try to get me the sign a piece an agreement to finalize this case which is misleading. At this point now I guess I'm gonna get sued by my landlord & you know what I'd rather go to court for that. Then to be misled by a legal team that doesn't even keep their word. I said to my lawyer and judge I didn't feel confident that I was going to be able to achieve that timeframe. Had to sign away my rights. there's something about the EDC where I feel like they only can help with certain cases in other cases that they mislead you on. I Don't feel like I got any help from them except for 90 days that were stressful and didn't really help me at all. So I guess it's up to me and my social worker to go through the state officials while trying to me out of this apartment into housing. read more

Despite the last experience these people did offer the girlfriend, a tad less than a week ago, they do deserve a recommendation and a consideration, if you find yourself subject to the many different types of hell a tenant/landlord relationship can bestow. Feeling naive for only recently realizing the authenticity to issues regarding harassment from a landlord in a rental unit, imagine the level of shock in realizing it can also come from nieghbors at the same time....in correlation with the landlord!!! The folks at Eviction Center heard our matter, wrote a short letter and things got real quiet around the girlfriends pad. It's probably a good idea to only visit their office if you have a notice to vacate or are facing a real emergency with housing. I am giving this review based on the experience I witnessed while showing up in court - to assist my brother who was being evicted from his apartment. My brother is a veteran - and the advice and assistance he received from Jodi-Kaye Haber, Esq of Eviction Defense Center was top notch. They are providing rather poor service, in an area where you don't really have much other choice (even if you want to pay for it) It's not all their fault. They simply don't have time to treat you like a client, and it shows. If you don't have a good defense, then you probably may as well try these guys because they have an extremely streamlined strategy, and apply it like a one-size-fits-all. It may work in many cases. But if your defense is better than their average clients, you will get better results with a different strategy, I believe. This "law firm" is a joke. They will literally not work for you. They treat everyone as if they have no money even if that's not even your situation. They will have you get your own court documents, take all your information, tell you to let them hold your rent money and not communicate to you. There's a chick that works there named Amanda who is very unprofessional. Instead of answering your questions, she will instead say you're having an attitude and being snarky. As if someone isn't allowed to be frustrated and confused and need clarification by someone they're paying to help them. After agreeing that working together wouldn't work due to Amanda's hostile work practices, I was able to negotiate a deal, win and pay in a little of 24 hours. These people had my money since Aug 2019 and weren't doing any negotiating on my behalf. What a joke! Unfortunately the people that need to see this the most probably doesn't even have a yelp page. Okay so look, I came to them freaked out and dealing with a really bad landlord situation. This place is constantly busy and has a ton of cases they are working on. Are they gonna coddle you and make you feel Ike you're at a restaurant that kisses your a$$$ when they take to you?! No, they are direct, sometimes short and to the point. Can this be scary when you're looking for more emotional support in a stressful scenario?! Sure. They will show up for you, fight for you, and make sure you are taken care of at no, or almost no cost. They are an amazing resource for the community and Im so thankful that I got to receive their help. This place is a saving grace!! Anyone who has anything bad to say is likely upset because they weren't able to help/take their case. At any rate, there is a female lawyer there who is not pleasant to work with or even be around due to her arrogant attitude (I didn't even work with her, just happened to be near her one day). Aside from that woman... I felt accepted and helped from every lawyer/person I came into contact with (male and female) at this office. Peter is the attorney who ended up finishing up my case and assisting me. He is incredibly intelligent, kind, and clearly genuinely enjoys the work that he does. It's a shame that not-for-profits like this one aren't better supported by our government... the results of having to move from a much larger office into their current (now off the 12th st Oakland stop) because of their budget, really was apparent upon visiting their office multiple times during the course of Peter assisting me on my case. It made me very sad. But also really delighted to know that good people still exist and there is some form of justice to the people in some scenarios. I went to trial, my case ended March 8, 2019. This review has been a long time coming. Lauren Russo was lead attorney and Peter Selawsky was co-counsel in my case. Lauren was resourceful reaching out to other professionals surrounding housing, and to have Peter as co-council, this combination had one outcome. WIN!. My defense was the American Disability Act reasonable accommodation, as well as the 2013 Stipulation Agreement that was signed into order by Judge Carvill, The agreement has additional signatures by me, Mr. Ghaderi, and Daniel Bornstein. Jane Creason, who works with Daniel Bornstein was the appointed lawyer representing the owner. Both sides presented motions and argue their merits in front of the judge. The judge will either rule for or against a motion. He will only rule on motions specific to the case. I can recall several motions Ms. Creason wanted were ruled against, because it was not relevant to the case. Peter brought up case law several times in opposition to Ms. Creason's motions. I heard Ms. Creason say aloud, "Mr. Bornstein filed that, I didn't. Déjà vu! I was impressed with Peter's knowledge about the law, he was specific on the exact years and the relevancy of the cases as it pertained to Lauren's defense. One thing I noticed throughout my time working with Lauren, is, she has the ability to already know the outcome. For example, everyone is at the start line of a race, while Lauren finished and won the race. January 6, 2019 witness's are sworn in and testimonies begin. The plaintiffs' side goes first. The third witness was the husband and the fourth witness was the wife, both are tenants lived in the apartment below me "THIS WAS THE BEGINNING OF A TURNING POINT OF THIS TRIAL". Lauren asked the husband and wife this question, "Do you remember when this happened?" both replied it was, sometime in "March". Her follow up question, "Did this happened before July 3rd?" both answered, yes. Did you notify the owner, both said, Yes! (((THAT DESTROYED THE PLAINTIFFS CASE, BOTH OF Mr. GHADERI'S WITNESSES TURNED ON HM BY TELLING THE TRUTH. THIS TURN OF EVENTS WAS AN EYE OPENER TO EVERYONE IN THAT COURT ROOM, ESPECIALLY TO THE JUDGE))) Lauren uncovered, the lies, and turned this case in a totally different direction, moving in favor on the defendant's side. Everyone was gobsmacked in that courtroom. Judge Reilly asked Lauren to call her first witness. Lauren says, " I call Mr. Thomas Ellerby to the witness stand." I reposition the chair to turn in the direction of the Jurors. So that when I sit, I am looking at every one of the jurors and they are looking at me. My testimony was very emotional; Her line of questioning was a roller coaster full of emotions, at one point, Lauren said to me, "Take your time Mr. Ellerby". January 7, 2019 was the end of my trial, but not the end of my case. Something happened overnight, Judge Reilly reached out to another Judge, It took less than 20 minutes for the Commissioner/Judge to resolve the whole matter, He got everything Lauren and Peter proposed, with exception to one month, instead of 150 days, it was 120 days. I am so humbled by Lauren and Peter, and by the other talented lawyers working at the EDC. Lauren has the ability to calculate and see the outcome of a trial and Peter with the knowledge of an entire law library. Peter is a walking law library. That combination represents a dream team working at the Eviction Defense Center. The entire staff at the EDC made all of this work and made it all possible. Lauren Russo taught me patience and trust. Peter Selawsky taught me confidence and assurance. Both of them gave me my life back, and restored my dignity, and for that I will always be forever grateful. For the tenant who is fighting the good fight and genuinely at a disadvantage in defending themselves from the mountain of paperwork and threatening litigation landlords wage against them, EDC, combined with EBCLC can be salvation. For one, it's low cost for most working poor people, and they are a nonprofit so the lawyers arent corrupt like most private rental attorneys. However, you should make a contribution regardless as they are a threadbare nonprofit working harder than the devil to save people from homelessness and hardships. If you have the money for a private attorney, good luck finding one that gives a shit, but if you have enough for EDC take a day off from work and a few hundred out of the bank, show up early and listen carefully. You may be able to repair and deduct from your rent if your landlord hasnt performed needed repairs in 30 days with notice, or prevent your being evicted without redress! It also helps if you have already created a paper trail of violations your landlord has purpetrated to make it easier if your case goes to trial. EDC is now one of my emergency contacts when I have legal forms served to me by my landlord, and I contribute every time even if it is "free" because every real nonprofit is struggling whether they admit it or not. read more

I was staying with a landlord here in Oakland for 7 months in a 3br house. One of the roommates had a drinking problem and one night cake into my room super waisted. After working 14 hours... I asked the guy if he could please give me my privacy. Obviously, I've been around drinkers before and politely asked him several times to head on over to his room because I was a bit exhausted. Clearly, the drinker did not want to call it an easy night and refused to head out. However, at this point in my life that is not something I'd like to deal with, as I've lived a sober life for 9years now. The very smell of alcohol on his breath is a trigger for me, and I've stayed away from alcohol for years. The very next day the owner who is friends with the other roommates sent me emails telling me that I needed to move within 3 days, due to me calling to police on him for my own protection and documentation's. I did have an incident report from Oakland PD stating that I called them to peacefully get that guy out of my room, so that I could shower and go to bed. I wake up wbu day for work at 5am and have no time for that. Andrea was an amazing help abs had to write me several letters to give me more time to find me a place without the owner touching my personal belongings while I'm was at work. I would definitely recommend her if you have having landlord issues here in Alameda county. She is amazing at what she does, and I would have had my stuff put out on the streets because other people felt like they "knew what my rights are". The very next day the property owner was extremely disrespectful forwards me even though my rent is always paid on time and due to the fact that he was taking sides, and not on the side of rationality through sobriety. All of this was provided to me at no cost. I was able to move at the end of the month to a new place I got, which is what I paid for to live comfortably with no one going into my room. Went here because I received an eviction notice. They told me to let them handle everything and Never under any circumstances talk to the other lawyer. Well I let them handle everything and the best they could get me was an extra 30 days... I left the preliminary hearing upset because I really needed money in addition with to 30 days because I have kids and didn't have anywhere else to go. After I left the hearing I decided to contact the evicting lawyer and struck a deal worth 8,000 plus an extra 60 days to move. BAM! The lawyer evicting me was 10xs friendlier than my lawyers. Don't be afraid to reach out to the evicting lawyer. I might could have gotten a better deal but I only asked for what I needed. Super easy and quick. No need for a middle man. Trust me on this one and contact the lawyer thats evicting you. You have nothing to lose. Im certain you will get a better deal by contacting whoever's evicting you. Sounds crazy but it worked for me. If you're getting evicted don't seek help from these guys. You've just been given free game. read more

Eric answered the phone and hang up because he did not like me laughing over t phone !!!!!!!!!!!!!!! Total waste of time for me. lack of Kindness and compassion. Bottom line is : you are at EDC MERCY People who care and believe in self respect would not want to visit EDC. It is one of my remarkable experience on American soil. This firm might be doing an excellent work but does not give them the rights to treat people in a rude or rebuffed manner to low income clients. I believe showing rudeness and insulting low income client defeats the purpose of EDC resources. Why even establish a resource if they cannot handle people with respect and kindness. Eric, one well trained staff in insulting and upsetting client. Obviously, in 22 years of my US experiences, i haven't met a single abusive person like him. My case was dismissed on February 14, 2013. I've waited to write a review because I had to get my medical and health back on track. The defense for my eviction was the Americans with Disability Act. Reasonable Accommodations. The Notion for any lawyers, or landlords, owners or management companies, to have that the Eviction Defense Center only go up to a certain point defending their clients is a misconceived notion and not at all informed to what they really do. In fact the Eviction Defense Center worked well with the AIDS Legal Referral Panel, based in San Francisco. The collaboration with the two agencies were key to helping me stay in my apartment. The EDC legal team (lawyers in the office) worked together, with my lawyer Barry Gerharz in defending me. Barry went above and beyond helping me. We were ready for trial, Barry subpoenaed, key witnesses, and prepared me for my trial. My trial date was January 7, 2013. The day of the trial, the owner's council, Borensein & Borenstien were not ready for trial. Whatever the required documents that had to be filed were not filed by the owner's lawyers. Judge Carvill was not happy at all, I'm sure he had some choice words with the owner's lawyer in his chambers. It resulted in me signing a stipulation agreement, and a motion of limine was drafted that went together. The stipulation agreement has an AIDS Legal Referal Panel Lawyer, Dmitri Pikman mentioned as a third party, to insure oversight and coordination with the owner so I do not have to deal with him. A motion of limine is a document requesting that the judge rule that certain evidence may not be used. Basically everything the owner filed in order to evict me. The stipulation agreement was signed by all parties and signed into order by Judge Carvill that day. After signing, the judge, spoke specifically to me, and the owner, we were both told their will be a compliance hearing on February 14, 2013 in his courtroom and that both parties MUST SHOW UP. I completed all of the terms that were stipulated for me to do, and showed up to the court ordered date February 14, 2013 compliance hearing. Barry also showed up that day. Borensein & Borenstien or the owner ..NEVER SHOWED UP.... The judge was not happy at all, I could hear the frustration, agitation and disappointment in his voice as he dismissed my case. I thank god a stipulation agreement was drafted, because the judge sided in my favor. So for any Lawyers or Owners, or management companies think the eviction defense center only go up to a certain point is foolish to think that. Further I might add, I can only imagine what it would be like for Borensein & Borenstien to appear back in Judge Carvill's courtroom. Or, if the Owner files another eviction, and showing his face in Judge Carvill's courtroom. (to me it was like a slap in the Judge's face to not show) * Judges don't forget ! I was able to make payment, it was hard but it can be done. I down sized my bills, and got assistance through other non-profit agencies to help on bills. The sacrifice is an individual thing. If you feel you have been wronged you will find it within yourself to make it work. I prayed a lot, I had support from my lawyer who gave me hope. THE MOST IMPORTANT THING IS TO PAY THE EVICTION DEFENSE CENTER. ( ON TIME ) * DO WHAT YOUR LAWYER TELLS YOU TO DO.* .because you will not find a defense for evictions at the rate you have to pay. Also keep in mind, your payment keeps the doors open for the next person that needs their help. Barry gave me some good advice, he told me " You stick with the AIDS legal Referral Panel" and seek out other non-profit agencies that will help you. I took his advice, I have case management that comes to my apartment twice a month. I am currently working with Dmitri Pickman ESQ.at the AIDS Legal Referral Panel who remains as the third party dealing with the owner. Written reviews are left because people feel they have something good or bad to say. Without this agency, the homeless population would increase, and landlords and owners would continue the practice of doing unlawful things to people. Barry Gerharz is a champion for disabled people, and enforces the Americans with Disabilities act, when it comes to housing. I am a property manager, and I had to evict a tenant (multiple years of non-payment). When the tenant responded to the unlawful detainer it was expected. But when the tenant moved to get a jury trial I was impressed. I went to court with the owner and sure enough they were being represented by these guys, EDC. Court was funny, every landlord went up with their own lawyer and the head lawyer for these guys just stayed up there saying, I'm here representing this person or that person. In the end the head lawyer gave almost all the tenants more time. So yes, if you are being mistreated or abused or not being treated properly, go to these guys for help. But please don't waste their time. As a property manager I have to evict people who deserve to be evicted. But some property managers and owners do break laws and treat people like trash. For those of you who are being mistreated and treated unfairly then go here for help. If you are working the system trying to get free rent, because you don't feel like paying, please don't waste EDC's time, there are true victims in the Bay Area and I would hate to see these real victims be ignored because a person who just wants free rent takes up EDC's time. If EDC is ever rude or unprofessional it's because they have a lot of people to help. When you go here come prepared, be concise. Time does not equal money for these guys. Time equals helping people and doing good. So if they push you to hurry the heck up it's because their may be someone waiting who needs help more than you do. Brenda is great! The EDC is awesome and has a glorious mission. They listened to my problems, were very patient with my questions, and provides affordable legal service. Due to it being so busy and hectic, the people that answer the phones tend to be lesser on the warm side and more on the snappier and unpatient side causing you to feel a lil "iffy". What is the deal with this firm? The lady who answered their phone kept cutting me off and talking over me, not letting me explain my situation. She didn't give her name and was belligerent. She said they don't serve the area I live, but it shows on their website that they do! I was absolutely blown away by the advocacy EDC was able to provide. I work as a lawyer in another field and a client of mine was served with a pay-or-quit notice, then eviction papers by his landlord not long after his mother (who was the only tenant on the lease) passed away. I referred my client to EDC, but (due to his numerous disabilities) he didn't follow through with them after the initial intake interview. I figured that it was up to me to represent the client in the eviction proceedings, even though that's not my field of specialty. I called EDC for some advice and they were able to make an appointment for my client and me to come in the day I called. The next morning (!!!) the attorney from EDC was there at the courthouse and she was able negotiate a very generous timeline for my client to leave the property; the landlord waived all of the back rent; and the landlord agreed to pay generous moving expenses. I could never have hoped to achieve such a positive outcome on my own. The EDC attorney was able to work with very difficult circumstances and not only recognize the landlord's interests (using them to the client's benefit), but she remained compassionate and sensitive, putting my client's mind at ease, even though he was not able to follow through at a number of stages throughout the eviction process. The California hotel is still open providing affordable housing with dignity thanks to the highly effective work of the Oakland Defense Cent in conjunction with the attorney John Murcko. Thanks to the valiant work of all the people at O.D.C. the tenants are still here and the entire hotel is being restored to it's former grandeur Anne Omura has been the court appointed pro bono trustee for the last several years and along with the rest of the staff at O.D.C. have worked what appears to be miracles in the face of what appeared to be over whelming odds. I was having a housing issue. During this pandemic it has been hard for me to contact appropriate housing advocate offices to get some resolve. Most places I tried to contact either were not answering the phone or when I did contact someone they were not dealing with housing issues at this time. Many many years ago I had an issue and I contacted the Eviction Defense Center in Oakland and they were extremely helpful. The issue I was having was not an eviction issue but I thought I'd give them a call anyway to see if they could direct my inquiries to some appropriate office. Once again they came through for me. They were extremely helpful and got me the resolve I was seeking. Their expertise, knowledge and willingness to take on my case was refreshing. I would recommend them to anyone that is going through issues with their housing during these trying times, especially lower income tenants. They are here for us. read more

Bastards. That's what these "people" are. We made a BS settlement agreement with them in court early in the year before the pandemic hit. My roommate and their lead client died of COVID-related symptoms during the government shutdown which was when we were scheduled to move out. We were all planning on moving together too as time was running out. Convenient, right? Unprecedented. Called EDC to tell them their client died and all some woman there had to say was "So? Other clients have managed to find housing." Joey our attorney refused to ever take another call from us despite repeated messages and emails when we announced we were staying (on the advice of Alameda County Sheriffs) until the government reopened (an extra month). It should also be mentioned we forfeited our puny cash settlement for doing so. I am homeless with a disability and chronic illness living in my damn car now. If they had been even the slightest bit more communicative I wouldn't find myself in this situation. I can't recommend these terrible people to anyone but at the same time where else are vulnerable people going to turn? Libby Schaff? Hahahahahahahahahahaha. Thanks EDC! Here's the thing. There's no public defender in eviction cases, even though a good lawyer is the only thing standing between you and homelessness. Eviction Defense Center doesn't just provide you with a good lawyer, they are GREAT lawyers. Take a close look at the rants above. Notice how the two LANDLORDS give them one star. Personally, I'd never hire an eviction DEFENSE attorney who was rated higher than one star by landlords. If a landlord liked the eviction defenders, then they aren't doing their job! I have had nothing but positive experiences in my dealings with Eviction Defense Center. I am constantly referring clients to them, and I have watched them in action at the courthouse enough times to know that they know their shit. You enter a rather cluttered office, filled with file cabinets that are busting at the seems. You can hear both English and Spanish being spoken. The receptionist greets you and asks a variety of questions and then you meet with the Director and if you meet the requirements are assigned an attorney. This office of young hard working people is the best! I found them to be a life saver. If you need help keep a roof over your head this is the place to come. Useless to me. A child called me back and between uhs, ums and rote memorization of script, I managed to learn they can't do anything unless an eviction is imminent as in, immediate. Not much help to someone trying to understand the eviction process itself, in a more nuanced situation. Represent low-income clients only. I'm mid-income and the only option for us to get effective information about tenant rights seems to be through a private lawyer. What mid-income person can afford that, in the bay area? I placed a call to the EDC after they closed on Thursday and left a message. I got a call back Friday morning at 9:13 AM. The woman was patient and answered my questions. I didn't need anything else from them but my simple experience was pleasant. They only handle Unlawful Detainer suits so unless you've got that weight on your shoulders they might not be able to help. read more
