    My son had his first 2 hour lesson a few weeks ago. When he returned home I asked how it went and…read morehe said it was good, but he was concerned that his instructor was using the cellphone quite a lot during the lesson. He told me that it appeared as if the instructor was fiddling with it to get his musical playlists on the radio. It's worth noting that these cars have dual brakes and gas pedal, and that the instructor would be expected to grab the wheel if needed. I asked if the instructor had his phone in his lap during this and my son said yes. He honestly brought it up out of concern and, being new to driving, wasn't sure if this was typical. I visited the school some days later and spoke with the owner. I tried very hard to make it clear that the whole thing might be some sort of misunderstanding and that I wasn't there to get anyone in trouble, only to get clarification on phone policy. The owner told me that the cars have onboard audio/video recording and that he would watch the tape later and get back to me. Strangely, he also said that without this verification he did not believe my son's account and specifically said that teenagers are liars. After a week of not hearing back, I called him up. He said he had watched the tape and that the lesson was absolutely perfect. He said that the phone use my son reported was actually the instructor holding up his phone and making videos of the lesson to post on his Instagram page. I suggested that this is a pretty bad idea and that it diminishes safety. He insisted that it's perfectly fine and does not impact safety at all. At this point I realized I was wasting my breath and said I'd be going elsewhere, and asked that my balance be refunded. He agreed to a refund after charging me $210 for the first lesson. He said it didn't matter at all to him if he lost my business or not. He also continued insisting that cell phone use by instructors is legal. It is not. California law treats driving instructors with dual controls as co-operators of the vehicle and, as such, are prohibited from using cellphones. The ONLY reason I'm posting this at all is to give a heads-up to other parents who might not be comfortable with instructors on phones.
