The agent scheduling the appointment lied through her teeth, I made it very clear that I was not willing to sign any type of paperwork, allowing them to either be a buyers or a sellers agent. When the agent came here, it was clear they are nothing more than a wholesaler and they are just looking for a listing and they tried to tie up your property and then turn around and find an investor to give you a lowball offer. I had a terrible experience with Mark Vescio at Mark Spain realty. Below is the note I sent to Mark Spain realty. Good afternoon, I agreed to a 5% commission--2.5% for my agent and 2.5% for sellers agent. My agent slid in a clause to pay an additional $695 to him which takes the commission over the agreed upon 2.5% At the time of signing, I was put under the impression by Mark that this was a standard fee for closing. It is, in fact, not a standard fee. My home was already providing $22,000 to my agent. Further, no offer sheet until the final offer referred to this fee as an additional brokerage commission for Mark Spain Realty, but was cleverly listed as a "Transaction Fee". This alone is deceptive, and provided no opportunity to realize what was happening along the way. There were multiple changes to the list price which would have afforded me the opportunity to remove that clause. Additionally, I provided night time pictures because Mark Spain Realty did not. It was included in Mark Spain's listing with my permission. I also had to attend one of my own showings because my agent was in training. Both of these are tasks the realtor I paid should have done, especially for the amount I agreed to pay in commission, yet I did these on my own. Further, my agent with years of experience estimated that the findings from the buyers inspection would cost me $500. While I understand he is not an electrician, I certainly didn't expect him to be off by 6X, with these repairs costing me $3,000. On top of all of this, I was told by my agent that my house would sell for $950K by Christmas. My house sold for $880K in March. For the reasons set forth above, this fee is entirely unconscionable, and I respectfully request the fee be returned. read more

My wife came in as I was signing the dwelling information. Relator asked her to sign the "standard" paperwork as she sat down. It was an exclusive right to sell the property for several months. Predatory and Deceptive Practices - Please Read Before Listing! My family and I had an absolutely awful experience with Mark Spain Realty, specifically with agent Megan Hobson. After my father passed away, my siblings and I just wanted to sell his home and move on. Instead, this company turned the process into one of the most frustrating and dishonest experiences I've ever had. Megan came to us with a smooth, scripted pitch promising that she could bring us the best offers possible and that Mark Spain's "Guaranteed Offer" program would make selling quick and easy. In reality, we were lured into a setup designed to benefit the company's own investors, not the family actually selling the home. Our property sat on the market far longer than promised while we were pressured to lower the price--clearly so it could be scooped up cheap by one of their investors. The commission structure is completely unethical: they charge a 6% listing fee with no buyers' agent commission, which means the seller ultimately pays around 9% total when everything's said and done. When we realized how unfair and misleading this was, we asked to terminate the contract. We were told verbally that we could do so unconditionally--yet every written version they sent was packed with hidden wording to trap us into paying their commission no matter who we list with next. We caught this deceptive language several times, and every time, they sent another "updated" version that still worked in their favor. It was exhausting, manipulative, and deeply unprofessional. This company preys on families who are just trying to handle their business in good faith. Very disappointing. Felt almost like a scam. 'Experienced' agent came to me with the suggestion of selling my house for $30k less than its value just to get a quick sale. I could probably advertise it on Craig's List and get a quick sale at that price. The agent didn't even look at my house. Just marched in and requested to sit down and chat. Proceeded to give me her memorized speech, and seemed surprised that to me there was no value in her service. Expected a 3.5% commission because they have so much advertising and 'extras' to sell my home faster. No worries on her part that her suggestion would bring me significantly less than the equity I currently have in my house. And I was not over pricing it. Essentially said they couldn't sell it any faster than any other agent if I kept my price. Anyone could sell it quickly at the laughable price she wanted to sell it at. I get that it's a flat market and not the best time to sell, but in their commercials they act like they have magic wands and sell your house in a second. It's a joke. I may lose money on my home if I decide to sell right now, but I'm not also going to lose another 1% for her commission (I've since gotten commission quotes of 2.5%) just because of Mark Spain's name. read more

He stated that he cant give a quote but if i signed a contract they can list to his investor group. If the house sold to them he would get a commission. The house is 2000sf, 3/2 on 1 1/4 acre. There is paved drive, carport, 16x20 covered pation, 16x32 shed on proprty. The next street had 1500 3/2 on 1/2 acre sold for 470k 3 mos ago. I have posted pics of some of the numbers for those of you who are visual. Where to begin? This is NOT ADVANTAGEOUS AS IT IS CLAIMED. My experience was with the cash buy program. A company called "Homeward" is the "buyer" that the MS brokerage brings in to purchase. Any items that need maintenance or repair, including ANY painting and cleaning is charged back to the seller. So they say you don't have to do anything except move out, but that comes with a cost. Example, I had a deep cleaning done for $300, when they wanted to charge me $550. There were several overcharged maintenance fees like this. Their inspector claimed I had termites and they wanted me to pay for mitigation -until I hired a pest control company to come in and refute that. I kept having to sign the same paperwork over and over again-for mistakes and misprints. And they took an ENORMOUS fee, made me pay the HOA membership, all the closing costs, and the trash pick up for the entire year-not reimbursed, even though I closed on Jan 2. I also had to pay for the HOA clearance letter out of pocket. The process started off really quick-until I signed on. That's when they have you over a barrel. Then everything dragged on for long periods-sometimes with very little and inadequate, to no communication at all. I had already contracted for a new build and just needed to be done with the entire mess. After they sold for a higher price than what they originally estimated, they DID kickback some of the "overage" to me-but they charged fees on that too! I wouldNEVER do this again!!! I have already steered 9 of my friends and colleagues AWAY from this and I aim to steer as many more as possible away as well. Out of a $145k profit I ended up with a little more than half that. Never Again. If you absolutely have to do something like this, don't use THIER realtor. And consult a lawyer and accountant to help make things clear to you. And make demands. Our meeting with the Mark Spain agent was odd to say the least. He didn't seem very organized regarding the Mark Spain services or prepared to coherently describe them. We told him that we initially wanted to understand the Guaranteed Offer program and that a fast sale was of interest to us. That was when he was able to describe the Guaranteed Offer program, and we said we would like to see what the offers would be. After that, we discussed what we thought the house was worth. I told him about the house and that's when he insulted us for the first time. I told him we had a Class 4 roof. He then went into a discussion about how he hoped we used roof insurance money on the roof and didn't pocket it. He said that was where some people unknowingly commit a fraud. I assured him we didn't do that. He looked at comps and we thought we understood what the value (not the offer value) would be but the square footage of the lot on TAD.org didn't look right. So I went to get the survey to see what the sq ft really was. While I was in the office, this is when he insulted us the second time (I wasn't there, my wife heard it). He asked if we reported the lot footage low so we could save money on taxes. She assured him that we didn't, the builder reported the lot size. Even with this, we wanted to see the Guaranteed Offer. So he took videos and pictures for the investors and said he would be in touch with the offers in a few days (this was Thurs 7 Aug). On Sunday he sent a thanks for meeting text and said he would be in touch the few days. I hadn't heard from him by Fri 15 Aug, so I sent him a text asking "any progress to report?" On Saturday, 16 Aug, he responded by saying, "It's looking like the investors will be too far apart from what you're wanting." First, I had to chase him down to get a response. Second, we never said what we would take. So I responded by saying "We didn't talk about what we would take, so not sure how you came to that conclusion. But if you think so, ok. So much for the "guaranteed cash offer". So I guess we're done. Thanks for your time, but we'll be going a different way. Have a good day." I knew that by going the cash offer direction, we would be offered a good deal less than what the house was worth, but like we told the agent, we are in a position to still make a deal. Too bad we couldn't even get the "Guaranteed Offer" that we see in the commercials. Instead, Mark Spain appears to have made the decision for us. This is quite the business model they have. Good luck with it, but in my opinion, you really need to change the deceptive advertising that you put into those commercials. You're only as good your word, and you make a big deal out of stating that you offer the guaranteed biggest cash offer. Well, we received NO cash offer, and Mark Spain made the decision for us without reaching out to us. Maybe it would be best if Mark Spain would keep to selling tree houses like you show in the cute commercials. read more

After my horrible experience with Mark Spain Real Estate, I immediately called my contractor and with in two weeks, had all the cosmetic work done on my house plus any other minor issues so it could be move in ready. The Mark Spain Real Estate agent texted me about two weeks after our last conversation asking if I wanted him to list the house again. I politely declined. I then found a realtor who was familiar with the area and she took over from there. Not only did my new realtor put a lock box on the home, but she handled everything, knowing that I was long distant. Within 3 days of her listing, my home, we had several offers above asking and ended up selling my home for 50k above what Mark Spain listed my home for. If you are in a desperate situation and have no money to put in your home and just want to get rid of it. While taking anything someone will give you, then Mark Spain Real Estate might be for you. read more

Well where do I even begin to tell you how terrible the experience was with Mark Spain Real Estate. I first met with a realtor who came to my home and at first everything seemed really great. Seemed knowledgeable. Seemed eager to sell my home. After signing that went away immediately. Trying to get ahold of my realtor was really difficult. I call, no answer. I'd text her, I would get a response back 8 hours later. I rode it out for another few weeks thinking maybe she was working hard. Turns out she wasn't. 30 days In we had 1 showing. I ended up firing her and transferring to another Mark Spain Realror. While he was more responsive he was not really knowledgeable in the field of work. I asked him what we needed to do to get showings and to get people interested. We lowered the price by $10k and got some traction. However, I would say 80% of the people loved the house but no one would bite. I asked if we should paint. My realtor says "no, whoever buys the house will paint it anyway". I said ok thinking maybe he knew what he was talking about. We ended up lowering the price again and got 2 showings and 2 people saying "my clients are going to make an offer tomorrow but they want to see the house one more time" they came and the next day they walked away from our home and offered on a different home. The results were so discouraging that I ended up firing Mark Spain all together and asked them to send me the documentation to break away from our deal. They accepted as I started getting very short with them. One of the worst parts of this whole deal was Mark Spain said I would only Make $5k on my home after selling (long story short I refied knowing I was selling 2 years prior to this). I was a little discouraged that we wouldn't be making that big of a profit. (One thousand percent thought they were skimming more of the profit off the top. Can't prove how or why but they did just pay a settlement for doing the same thing.) After we fired Mark Spain we chose to go with a different real estate company in which I was so happy with. We sold our home 1 day after we re listed the home. Why, because we painted, because we did minor touch ups that made major improvements. On top of that we sold the house at the price we listed for originally and got over asking. Where we would have made $5k with Mark Spain on a $399k home sale. We made $18k for the same asking price. We sold for $400k and made $18k. Mark Spain is crooked as it gets. I have no doubt in my mind. On top of all of that. When we left Mark Spain, I had spoken to 4 different realtors who all said the same thing. If a home is listed by Mark Spain they will not even show their clients the home unless they really want to see it. if they don't have to the good majority of realtors will not show it. They try to avoid Mark Spain like it's the plague. After my experiences with them, I would too! If you're thinking about buying or selling a home please be cautious of these people. Obviously you must do what is best for you, but I wouldn't recommend these people to anyone. Don't live my mistakes. Know you're in better hands with pretty much anyone else. read more

I have bought and sold over 40 homes in the past six years, and this was by far the worst transaction I've ever been through. Working with Mark Spain was frustrating from start to finish. The buyer's agent clearly had little to no understanding of how to properly fill out a purchase contract, which should have been a major red flag. We were supposed to close in 30 days -- a timeline that was completely disregarded. During due diligence, they tried to make a completely unacceptable change, attempting to alter the contract to make our deal contingent on the sale of one of the buyer's other homes. Then they asked for 30 more days. That delay was followed by a failed reverse 1031 exchange at Day 45. And just when I thought it couldn't get worse, they came back asking for another 15 days to add someone else to the loan. This was a disorganized, unprofessional, and frankly exhausting process. Communication was poor, expectations were constantly shifting, and it felt like no one at Mark Spain had the knowledge or care to manage the transaction properly. I called mark spain to understand their "cash offer guarantee" only wanting to understand how it works. Instead they sent a realtor to my house. I am selling my house and would prefer not to go through showings etc as say in their ads. Sounds great, right!The agent who came to my home told me that this program only works for a small percent of their clients. I was also told that I would have to sign an agreement stating that he would be my exclusive listing agent and that this would have to signed before they would even consider looking into this program. The TV commercial and promises of a fair cash offer are severely oversold. My offers were 70-75% of the fair market value. My home was in a good real estate market and very good shape with new appliances and new roof. These offers did not include the extra fees which lowers the cash offers below 70%. The Mark Spain guaranteed offer sounds great but wow its a deceptive practice. They sent me a proposed offer amount by email so I setup the appointment with an agent. The paperwork he had "pre-filled" was a formality and not a contract to sell my home. He said it was required by the real estate commission and it was not a listing agreement. Here we are two months later with 3 offers that are 65% of the market value. Based on the email response the lowest estimated value didn't even come close to what Mark Spain presented me with. I waited for a month to get the lowball offers that were less than two cash buyers I procured myself in less than 2 days. The lack of communication, not receiving the spreadsheet breakdown as promised, and presenting over the phone is shady. Why is nothing in writing? Essentially discouraging you from using a cash buyer so that you are in desperate need of listing with Mark Spain. It is a deceptive practice to get you to list the home with them. Of course part of the process is that they connect you with a buyers agent, their partnered lenders, and all while setting you up to spend more money with them when you list the home. The commissions are high, no cashback incentives, and fees on top of it all. After the agent advised that we go live on the market, which was supposed to be the 3rd step in the process. Initially he said there was no obligation with the guaranteed cash offer, then a "market wholesale" type of offering both not listing on the retail market. Which would have been steps 1 and 2, then we would visit listing on the MLS retail market. Well he skipped the 2nd and went right to the listing which apparently I had already signed without my knowledge. A legally binding listing agreement for my no obligation cash offer. "Bait and Switch" does not even begin to describe the legal and ethical implications of doing business this way! There was no listing disclosure provided, which would have made it clear that I was signing a listing agreement. I would not have chose this company to list my home with if not for the legally binding contract that I was duped into signing. There are a lot of options out there with lower costs, better support and clear communication, and they will get your house sold. I've had 1 showing in over a month on the market. This agent even dropped the ball on the last showing request where I asked for an extra 30 minutes to prepare. He didn't contact the agent or follow-up, I had to find the agents contact information and message him myself. Which turns out the timing would have worked had the client not have already parted ways. An email that I received from Mark Spain even says that you can opt out of the listing agreement hassle free, this was sent before my house was even on the market, because they are aware of the contract you signed. The house is sitting on the market, listed in the MLS and the agent has done nothing to get it sold. Being on a tight timeline, stressed and cheated while taking a huge step selling my beloved home. They talk a good game but when all is said and done I feel it's a scam to get property at the bare minimum then they want to charge you for every thing and then they mkt it and sell it while the original owner is expected to leave utilities in their name even after closing until they sell it. Instead of a call I get an email from Missy Barry telling me she had left and that I would be working with a guy named John Garms. He called me a few hours later and started telling me what we were going to do. I told him I wasn't happy about this and he told me 'trust me', This is my specialty and then proceeded bad mouth the original agent and to tell me that's why she was no longer there. I told him I wasn't moving forward with someone like him and he said ok and hung up. His boss Missy Barry did not care either. I was sent over a termination agreement in under 5 minute to sign. It's signed and I am done with Mark Spain. Find a real realtor and leave these people. read more
