I was to drop off my car at Caliber, who would then contact Enterprise to pick me up and take me to their location to pick up a rental car. Unfortunately, Enterprise never picked up the call so Caliber had their driver drop me off at Enterprise. There was a line of people waiting to pick up a car. By the time it was my turn, the car size that I was supposed to get were all out. Instead I was given an SUV, and was given a discount and charged the original price of the car I was supposed to receive. Overall time took 30 minutes. When I returned the car, the process was faster and the person who helped me was professional and tried to make my experience a good one. I also received a ride to Caliber Collisions to pick up my car. Overall time took 20 minutes.

I needed to book a rental and thought I'd go through this location than the SJC airport one since it was closer. BIG MISTAKE. It let me reserve the car I wanted online (as in it said they had it available) and was all set for my pick up date. When I came to the shop there was one party ahead of me waiting with no staff person in sight. A staff member came in after about 10 minutes and helped that first party waiting (more on that later). Once it was my turn he told me they didn't have the type of vehicle I reserved available and that I could get another for a significant up charge than what I had reserved. I almost did but the general shadiness of the staff and office convinced me otherwise. I went straight to the airport where I was able to get what I wanted and not get scammed. Also there are seemingly some shady/off books transactions happening here because the person that "helped" me first helped the other party waiting. He clearly knew them and was getting them a car but nothing that the group wanted was available because everything was reserved. Then he said he could get them a sedan that was available (which is what I had reserved) and they said that was fine. Anyway he just gave them the keys and there was absolutely no check out process, no license checking, no payment, no paperwork, nothing. Also he told them they could come by for a better car in a few weeks. I don't know, it just all seemed soo shady. Avoid at all costs.

I had to carve out an hour on Saturday to get it fixed. Later that same day, the same tire went flat again. There was no nail or visible cause, but it required another trip and another hour of my time. For someone with a flexible schedule, two hours may not seem like a lot. But for me, carving out that much time was difficult and set me back quite a bit. I wish the vehicles were inspected more thoroughly before being put back into the fleet. This could have easily turned into a dangerous situation if it had happened while driving at higher speeds.

The price was $4,000 cash, not including taxes and fees. THE FRAUD & SAFETY ISSUE: Immediately after purchase, I took the car to an independent mechanic for the alignment. The mechanic found the vehicle to be unsafe and unroadworthy, requiring over $6,000 in safety-critical repairs, including: Three wheels were severely bent/warped. All tires needed immediate replacement. The front struts were blown out. The engine had a serious oil leak. THE DEALERSHIP'S RESPONSE: When I presented Lux Auto Sales with the detailed, written repair estimate, they refused to take the car back. They claimed the vehicle was sold "AS IS," ignoring the fact that California law prohibits licensed dealers from knowingly misrepresenting a vehicle's condition or selling an unsafe vehicle (Vehicle Code § 24007). Their only offer was a suspicious $1,700 repair through their own shop, which does not even cover the cost of the necessary safety parts. ACTION TAKEN: As a result of this fraudulent misrepresentation, I have taken the following official actions: A formal demand for rescission of the contract and a full $4,000 refund has been asked of management. A formal complaint has been filed with the California Department of Motor Vehicles (DMV) Investigations Division regarding dealer fraud. A complaint has been filed with the Bureau of Automotive Repair (BAR). I am currently filing a lawsuit in Santa Clara County Small Claims Court to recover the full purchase price and costs.
