I hired Leon Design & Build for a concrete fence and gate project and expected the work to be planned and completed according to the written scope. That did not happen. The project began without any workable preconstruction plan developed by Leon Design & Build, and the supervisor arrived without the written layout plan I expected for a job of this size. The contract was never formally revised to reflect the changes that occurred during construction. Several parts of the project did not match the written scope, including the following: The fence height did not meet the contracted requirement at any point along the fence line, footing forms were not used as specified, and the gate work did not match the contract in size, materials, and finish. When I raised the issues and later requested a refund or credit, I received a partial settlement offer well below my already itemized fair demand, and it also included non-disclosure language I was not willing to accept.
