This libelous rebuttal to my review is fraught with lies. I never complained about any movers. I never met his movers. Movers are typically there for a total of one whole day on the day that the person moves in, yes? I didn't complain about this guy until he had been living there for about a month. He was very noisy in the middle of the night one night, at about 3 am, and I went upstairs, knocked on his door, and politely asked him to be quiet. He was nice enough then, saying "I'll try to calm myself down," and he was relatively quiet for the next few days. But then it started up again. And he was LOUD - dropping objects, moving furniture, talking and laughing loudly at all hours of the night. That is when I went to the apartment manager and asked her if she would simply extend a gentle reminder to him to be quiet between the hours of 11 pm and 6 am. That is implied, if not specified, in EVERY single lease and rental agreement. I never said anything about "domestic disturbances." That is a lie either from him, or from the apartment manager. But I never said that. And I never contacted law enforcement. The claim of racial biases is completely unfounded, not to mention offensive. And I never approached his mother. Not even once. She approached ME! It is amazing how many lies he has thrown in here. I had only approached HIM that one time that first month, and then tried to handle it by going to the manager, who later made it clear that she was not going to help me. Under common law & in every lease and rental agreement, all property owners are required to ensure the covenant of quiet enjoyment. This had absolutely nothing to do with anybody's race, gender, sexual orientation or ability. This management company did not provide a "safe space." What they did was drive out someone whose apartment was rent controlled so that they could hike up the rent. The new tenant above me was paying $700 more than I was. The writing was clearly on the wall. The "element" that was brought to this living situation was callousness, rudeness, inconsideration and disrespect. All I asked for was common courtesy from this person. That's all I expect from any neighbor. The previous tenant who lived above me was very courteous & mindful of the fact that someone lived beneath him. I just heard normal apartment sounds, not stomping or loud voices at 3 am, constantly. Yet this new tenant says he was "afraid" of ME when all I did was complain to management about the unecessary noise he was making that was triggering my PTSD. I'm a woman living alone who's been the victim of a violent crime. How dare anyone appropriate what that feels like.
*And another thing: the guy upstairs was not the only noise complaint that I had in the last year. Another tenant (a white guy, incidentally) with a souped up Mercedes started parking beneath my window & would rev his engine every single morning which triggered a startle reflex in me. I complained about that, and the landlord's response was the same. The landlord clearly had favorites, & the ones she favored were the ones who were paying significantly more rent. The upstairs guy had two Jaguars. You know what I can afford to drive? Nothing.
*I will add this: Being a PoC has nothing to do with the fact that this person was consistently loud & disruptive, making my life miserable. My purpose of writing this review was to explain how the management team mishandled what should have been a simple problem to solve. If there was any discrimination involved, it was against me, as I was paying less rent. I am certain that was a factor in how poorly I was treated. I wasn't trying to get this neighbor kicked out nor make any enemies. I just wanted him to be quiet like a considerate person. Most people in upper units understand that you shouldn't wear heavy shoes or drop objects nonchalantly or move furniture when most people are trying to sleep. I was constructively evicted. Now this person has edited his response to remove all the lies that he originally posted. Yes, they were libel. And furthermore, I never mentioned him by name in my review. HE is the one who outed himself. And what he wrote had nothing to do with his consumer experience, which is what Yelp is supposed to be for. It was a retaliatory smear against me trying to paint me as a "racist" when I actually had legitimate complaints about him. I did not even know that this person was Native American until he brought it up repeatedly in his defamation of me. And when something didn't actually happen, liking claiming a "domestic disturbance," and you say it did, that IS called a lie. And when I bang on the ceiling to send the message that you are being too loud & you stomp on the floor in retaliation, that is not "trying to be quiet." The last few months I rented that apartment, I was either staying at my parents' or at my boyfriend's place at night, because I was literally unable to sleep in my own home. read more
